You asked me to address items IA and 1B of the January 31,2006 check list. Below is my response.
1A. Proposed water supply for 5,000 gallon water Storage tank for fire protection to DPS:
The water for the 5,000 gallon water storage tank will be supplied by the well to be located on Lot No.
1. All depletions from the filling and re-filling of the 5,000 water storage tank will be included the
pending Plan for Augmentation 04CW342.
„—, IB. Status of six well permits issued by the State Engineer:
Enclosed are copies of the exempt wells permits issued by the State Engineer on September 6, 2002.
These permits have expired since they were not drilled by the expiration date of September 6, 2004 as
noted on the bottom right hand corner of the permits. The pending Plan for Augmentation, 04CW342
seeks 17 domestic wells and 2 additional irrigation wells.

I do not get to speak with you as often as I used to, when I was doing more planning type items, but I do have an
issue that has popped up...
I left Lee a voice mail a few minutes ago related to the change in zone hearing this afternoon for the Trinity
Properties parcel. I am concerned with a single issue for today's hearing —whether proof of well permits should
be a prerequisite to the submittal of the final plat, or a prerequisite to recording of the final plat. The attached draft
checklist lists it as a prerequisite to the submittal of the final plat, but we believe it should be a prerequisite to
recording the plat. The augmentation plan case is set for trial August. My guess is that the case will settle, but if it
does not, we should have a ruling from the court by the end of September, so the end is definitely in sight. It just
makes sense to let these folks proceed with all the other details related to the play while I am wrapping up the
water issues. Lee, I it looks like you reached the same conclusion, per your email (attached).
If at all possible, could you please let Todd Hodges know if you will recommend moving the well permit
requirement before the hearing (his email is above). This would relieve some uncertainty and alleviate the need
for us to make a presentation on this point.
