HomeMy WebLinkAbout20062090 RESOLUTION RE: APPROVE LEASE FOR OFFICE SPACE IN SOCIAL SERVICES BUILDING AND AUTHORIZECHAIRTO SIGN-MULTI-DISCIPLINARYYOUTH ASSESSMENT(MYAT) TEAM WHEREAS,the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS,the Board has been presented with a Lease for office space in the Social Services Building between the County of Weld, State of Colorado, by and through the Board of County Commissioners of Weld County, on behalf of the Department of Social Services, and the Multidisciplinary Youth Assessment Team, including the Departments of Human Services and Public Health and Environment, Weld County School District 6, LifeBridge Christian Church, Centennial Board of Cooperative Educational Services, Probation Department of the 19th Judicial District, Saint Vrain School District, North Range Behavioral Health, and Island Grove Regional Treatment Center, commencing July 1, 2006, and ending June 30, 2007, with further terms and conditions being as stated in said lease, and WHEREAS,after review, the Board deems it advisable to approve said lease, a copy of which is attached hereto and incorporated herein by reference. NOW,THEREFORE,BE IT RESOLVED by the Board of County Commissioners of Weld County,Colorado, ex-officio Board of Social Services,that the Lease for office space in the Social Services Building between the County of Weld, State of Colorado, by and through the Board of County Commissioners of Weld County, on behalf of the Department of Social Services, and the Multidisciplinary Youth Assessment Team, including the Departments of Human Services and Public Health and Environment, Weld County School District 6, LifeBridge Christian Church, Centennial Board of Cooperative Educational Services, Probation Department of the 19th Judicial District, Saint Vrain School District, North Range Behavioral Health, and Island Grove Regional Treatment Center, be, and hereby is, approved. Griego, Director, Social Services _ ^ te�.t,1 a ,Ur RE: Lease Agreement with Various Multi-Disci linary Youth Assessment Team Contractors Enclosed for Board approval is a Lease Agreement for Services between the Weld County Department of Social Services (Department) and Multi-Disciplinary Youth Assessment (MYAT) Contractors: Weld County District 6, LifeBridge Christian Church, Centennial Board of Cooperative Educational Services, Probation Department of the 19th Judicial District,North Range Behavioral Health, Island Grove Regional Treatment Center, Weld County Department of Public Health and Environment, Weld County Division of Human Services and St. Vrain School District. The Lease Agreement was reviewed at the Board's Work Session held on June 26, 2006. The major provisions of the contract are as follows: 1. The term of the contract is July 1,2006 through June 30, 2007. 2. The Department is providing facility space for its MYAT Contractors in the Greeley Social Services Office and for St. Vrain and LifeBridge facility space in its Southwest Administration Building. 3. Under the Agreement, the Department will not charge rent and will provide for appropriate accommodations. If you have any questions,please telephone me at extension 6510. 2006-2090 MYAT Lease; FY06/07 LEASE THIS LEASE, made and entered into this day of June 2006, by and between the COUNTY OF WELD, a political subdivision of the State of Colorado, by and through the Board of County Commissioners of the County of Weld, whose address is 915 10'h Street, Greeley, Colorado 80631, hereinafter to as "Lessor", and sitting as the Board of Social Services for the Weld County Department of Social Services, herein after referred to as ("Social Services"); and members of the Multidisciplinary Youth Assessment Team ("MYAT"), hereinafter collectively referred to as "Lessee": the Weld County Division of Human Services, hereinafter referred to as ("Human Services"); Island Grove Regional Treatment Center, Inc., hereinafter referred to as ("Island Grove"); North Range Behavioral Health, Inc., hereinafter referred to as ("North Range"); Weld County Department of Public Health and Environment, hereinafter referred to as ("Public Health"); Weld County District 6, hereinafter referred to as ("District 6"); LifeBridge Christian Church, hereinafter referred to as ("LifeBridge"); the Centennial Board of Cooperative Educational Services, hereinafter referred to as ("BOCES"); Probation Department 19th Judicial District, hereinafter referred to as ("Probation"); and St. Vrain School District, hereinafter referred to as ("St. Vrain"). WITNESSETH: That in consideration of the keeping and performance of the covenants and agreements by Lessee, hereinafter set forth, Lessor hereby leases unto Lessee one cubicle, office, or work space per MYAT Contractor, collectively referred to herein as "Office Space", located in either the Weld County Department of Social Services Building at 315 North 11'" Avenue, Greeley, Colorado, hereinafter referred to as "the Premises" or located in the Weld County Southwest Administration Building at 4209 WCR 24 1/2, Longmont, Colorado, hereinafter referred to as "the Southwest Premises", as follows: a. One cubicle for Human Services to be located at the Premises; b. One cubicle for North Range to be located at the Premises; c. One cubicle for Island Grove to be located at the Premises; d. One cubicle for Public Health to be located at the Premises; e. One cubicle for District 6 to be located at the Premises; f. For St. Vrain, one office to be located at the Southwest Premises and one work space to be located at the Premises; g. For LifeBridge, one office to be located at the Southwest Premises and one work space to be located at the Premises; h. One cubicle for Probation to be located at the Premises; and i. One cubicle for BOCES to be located at the Premises. Furthermore, the Lessee, in consideration of leasing of the aforesaid, covenants and agrees as follows: a. There will be no rent charged to the Lessee by the Lessor for use of the Office Space; b. To use ordinary care when using the Office Space; c. To sublet no part of the Office Space; d. To use the Office Space for no purpose other than conducting the business and duties as 1 MYAT Lease; FY06/07 a MYAT Contractor; e. To keep the Office Space clean and in the sanitary condition; f. To allow Lessor at any reasonable hour of the day to enter into or upon the Office Space. Furthermore, the parties hereto agree as follows: 1. That all costs for utilities and trash removal shall be paid for by Lessor; 2. That no assent, express or implied, to any breach of any one or more of the covenants or agreements hereof shall be deemed or taken to be a waiver or any succeeding or other breach; 3. That Lessee agrees to indemnify, save, and hold harmless Lessor from any and all loss, injury, or damage whatsoever, incurred by Lessee as the result of fire, flood, inclement weather, or other casualty, other than by negligence of the Lessor; 4. That Lessor shall own and maintain the filing cabinets and computer systems including computers, modems, printers, and associated computer equipment, used in the Office Space, unless provided by the Lessee; 5. That Lessee shall escort all MYAT clients to and from the Office Space and reception area; 6. The Lessor shall pay for use of the telephones and all miscellaneous office supplies used by the Lessee, including photocopying for purposes of MYAT functions only; 7. That the duration of the lease agreement shall commence on July 1, 2006, to and until June 30, 2007, unless sooner terminated by any of the parties hereto, upon the delivery of thirty (30) days notice of such termination to the other parties.
