The Weld County Public Works Department has reviewed this proposal. This project falls
primarily under the purview of the Use by Special Review Standards, Weld County Code,
Chapter 23, Article II, Division 4, Section 23. Our comments and requirements are as follows:
COMMENTS:
WCR 21 is designated on the Weld County Road Classification Plan (FHU) as a local gravel
road, which requires a 60-foot right-of-way at full build out. There is presently a 60-foot right-of-
way. The road is maintained by Weld County. Pursuant to the definition of SETBACK in the
Weld County Code, Chapter 23, Article III, Section 23-3-50, the required setback is measured
from the future right-of-way line.
Our most recent traffic count reflects 79 vehicles per day travel north of WCR 8 on WCR 21.
REQUIREMENTS:
Access: Utilize the south existing access to the parcel. Direct access from the public road
shall be limited; only one access is allowed per legal residential parcel. No circle drives will be
allowed. In accordance with Chapter 8, Article II of the Weld County Code, this policy shall
apply to all new and existing accesses within the unincorporated area of Weld County.
Circulation and Parking: The applicant is identifying the south existing access as a 12-foot
gravel access, which would serve the existing one-story framed residence and the additional
one-story residence with the walk-out basement. The circulation appears to be good with
adequate parking for both residential facilities. The access, circulation, and parking shall have
adequate gravel and be graded to provide all-weather access to both existing residences.

Subject: USR-1510 Referral
Upon review of my case files and computer, an open Violation (VI-0200413)was noted. The violation was
initiated due to the utilization of a second home on one parcel. This case was presented to the Board of
County Commissioners through the Violation Hearing process on September 10,2002. At that time,the Board
referred this case to the County Attorney's Office, but delayed legal action for 120 days to allow Mr. Brand
adequate time to complete and submit a Recorded Exemption application.
This Use by Special Review application, if approved, will bring the property into compliance. If denied, the
second home shall be vacated as a dwelling unit or it shall be demolished. Furthermore, if denied, the
property shall be brought into compliance within 30 days or this case will proceed accordingly in District Court.

Environmental Health Services has reviewed this proposal for 2 single family dwellings. We
have no objections to the proposal, however, we do recommend that the following conditions be
part of any approval:
We recommend that the following requirements be incorporated into the permit as development
standards:
1. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and Facilities
Act, 30-20-100.5, C.R.S., as amended) shall be stored and removed for final disposal in
a manner that protects against surface and groundwater contamination.
2. No permanent disposal of wastes shall be permitted at this site. This is not meant to
include those wastes specifically excluded from the definition of a solid waste in the
Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended.
3. Waste materials shall be handled, stored, and disposed in a manner that controls
fugitive dust, fugitive particulate emissions, blowing debris, and other potential nuisance
conditions.
4. Fugitive dust and fugitive particulate emissions shall be controlled on this site.
5. This facility shall adhere to the maximum permissible noise levels allowed in the
Residential Zone as delineated in 25-12-103 C.R.S., as amended.
6. Adequate handwashing and toilet facilities shall be provided.
7. Any septic system located on the property must comply with all provisions of the Weld
County Code, pertaining to Individual Sewage Disposal Systems. (2 permits -
#SP0000080 & #FL19800032)
8. A permanent, adequate water supply shall be provided for drinking and sanitary
purposes.(Domestic Well # 99448-A)
9. The operation shall comply with all applicable rules and regulations of the State and
Federal agencies and the Weld County Code.
