The Weld County Department of Public Health and Environment has reviewed this application. We
recommend approval of the proposed dairy with the following recommendations:
The Department recommends the following requirement be met prior to allowing the plat to be recorded:
1. A management plan for nuisance control shall be submitted and approved by the Weld County
Department of Public Health&Environment. This"nuisance control plan"plan must address
control measures for dust, odors, flies and pests.
2. The applicant shall provide evidence to the Weld County Department of Public Health&
Environment that an adequate sewage disposal system is available to serve the proposed use. An
Individual Sewage Disposal System(I.S.D.S.) evaluation shall be conducted by a Colorado
Registered Professional Engineer for the barn system(G19810022). The review shall consist of
�^^ observation of the system and a technical review describing the systems ability to handle the
proposed hydraulic load. The review shall be submitted to the Environmental Health Services
Division of the Weld County Department of Public Health and Environment. In the event the
system is found to be inadequately sized or constructed, the system shall be brought into
compliance with current Regulations.
The Department recommends the following requirements be incorporated into the permit as development
standards:
1) The facility shall utilize Best Management Practices and operate in compliance with Water
Quality Control Commission(WQCC)Regulation#81.
2) There shall be no permanent disposal of solid wastes,as defined in the Regulations Pertaining
to Solid Waste Disposal Sites and Facilities(6 CCR 1007-2), at this site.
3) The applicant shall remove, handle, and stockpile manure from the livestock area in a manner
that will prevent nuisance conditions. The manure piles shall not be allowed to exist or
deteriorate to a condition that facilitates excessive odors, flies, insect pests,or pollutant
runoff. The surface beneath the manure storage areas shall be of materials which are
protective of State waters. These areas shall be constructed to minimize seepage or
percolation of manure contaminated water. In no event shall the facility impact or degrade
waters of the State in violation of Colorado Water Quality Control Commission Regulation
Number 81.
4) The facility shall control fugitive dust on this site and operate in accordance with the
approved nuisance control plan.
5) The facility shall be operated in a manner to control pests. The facility shall be operated in
accordance, at all times, with the approved nuisance control plan. Additional control
measures shall be implemented at the request of the Weld County Department of Public
Health and Environment in the event that rodents(which can be determined to be associated
with the facility) are in such a number to be considered a nuisance condition.
6) The facility shall be operated in a manner to control flies. The facility shall be operated in
accordance,at all times, with the approved nuisance control plan. Additional fly control
measures shall be implemented at the request of the Weld County Department of Public
Health and Environment in the event that flies(which can be determined to be associated with
the facility) are in such a number to be considered a nuisance condition. The plan shall also
be implemented in the event the Weld County Department of Public Health and Environment
receives a significant number of fly(associated with facility)complaints, and in the judgment
of the Weld County Health Officer, there exists a fly condition requiring abatement.
7) The facility shall be operated in accordance with the approved nuisance control plan. Odors
detected off site shall not equal or exceed the level of fifteen-to-one dilution threshold, as
measured pursuant to Regulation 2 of the Colorado Air Pollution Control Regulations.
Additional controls shall be implemented at the request of the Weld County Department of
Public Health and Environment in the event odor levels detected off site of the facility meet or
exceed the level of fifteen-to-one dilution threshold, or in the judgment of the Weld County
Health Officer, there exists an odor condition requiring abatement.
8) The facility shall operate in compliance with applicable Colorado Air Quality Control
Regulations. There shall be no open burning except"agricultural open burning"as defined by
Colorado Air Quality Control Commission's Regulation 9.
9) The facility shall adhere to the maximum permissible noise levels allowed in the Light ,
Industrial Zone as delineated in Section 25-12-103 C.R.S, as amended.
10) Waste materials,not specifically addressed by other development standards, shall be handled,
stored, and disposed in a manner that controls fugitive dust, blowing debris, and other
potential nuisance conditions.

The Weld County Public Works Department has reviewed this proposal. This project falls primarily under the
Use by Special Review Standards, Weld County Code, Chapter 23, Article II, Division 4, Section 23. Our
comments and requirements are as follows:
COMMENTS:
Weld County Road Classification Plan (FHU): (June 2002) WCRs 15 and 80 are local gravel road and
requires a 60-foot right-of-way at full build out. There is presently a 60-foot right-of-way. This road is
maintained by Weld County. Pursuant to the definition of SETBACK in the Weld County Zoning Ordinance
(23-1-90), the required setback is measured from the future right-of-way line.
Traffic Counts: The most recent traffic count for WCR 15 between WCR 13 and State Highway 257 range
from 226 to 279. I have no counts reflecting the volume on WCR 80 at this location.
•operty Line: The proposed USR covers two individual parcels. Does that create a problem for the Planning
Department?
REQUIREMENTS:
Intersection: At the intersection of WCR 15 and WCR 80, the applicant is proposing to install a berm a
proposed waste water pond. The applicant needs to place on the plat drawing a diagram showing sight
distance for westbound traffic on WCR 80 by berming either the intersection. Verification needs to be place
that this does not become a blind intersection. Utilize the AASTO or the state requirements on sight distance
at intersections. The sight distance at 55 mph needs to be a minimum of 583 feet.
Access: The applicant is proposing two new accesses to the new USR. The western most access is
approximately 450 feet from the intersection, and the eastern access is 1,850 feet from the intersection.
Road Access Policy: (Policy Established Sec. 8-2-10) If a drainage culvert is required, a 15-inch
corrugated metal pipe is the County's minimum size requirement. If the applicant chooses to place a larger
culvert, please contact the Public Works Department to adequately size your culvert.
The access shall be placed in such a location to have adequate sight distance in both directions and not below
the crest of a hill or where physical obstructions are present.
The applicant shall utilize the existing residential access to this parcel.
Mtilize the existing agricultural, oil and gas, and ditch roads that are necessary for your agricultural operation.

Pursuant to Chapter 15, Articles I and II of the Weld County Code, if noxious weeds exist on the property or
become established as a result of the proposed development, the applicant/landowner shall be responsible for
controlling the noxious weeds.
Off-street parking spaces including the access drive shall be surfaced with gravel, asphalt, concrete or the
equivalent and shall be graded to prevent drainage problems.
Storm Water: The waste water retention ponds will be maintained and operated in accordance with the
Colorado Confined Animal Feeding Control Regulations. I am referring the storm water drainage to the
Department of Health and Environment, as it has jurisdiction over any Use by Special Review that would deal
with animal units.
Circulation: All alleyways should be surfaced with gravel and shall be graded to prevent drainage problems.
Site Grading: A site grading permit will be required to grade the site and the retention ponds. Check with the
Planning Department if this is necessary.

performing agricultural, animal husbandry or horticultural services on a fee or contract basis including Livestock
Confinement operations (a dairy operation for a total of 900 head) in the A (Agricultural )Zone) District.
USR-1554
1. A building permit shall be obtained prior to the construction of the commodity shed and the office.
2. A plan review is required for each building for which a building permit is required. Plans shall bear the wet
stamp of a Colorado registered architect or engineer.Two complete sets of plans are required when applying
for each permit. Building plans shall also be submitted to the Poude Valley Fire Protection District.
3. Buildings shall conform to the requirements of the various codes adopted at the time of permit application.
Currently the following has been adopted by Weld County: 2003 International Building Code; 2003
International Mechanical Code; 2003 International Plumbing Code; 2003 International Fuel Gas Code; and
the 2002 National Electrical Code and Chapter 29 of the Weld County Code.
4. Each building will require an engineered foundation based on a site-specific geotechnical report or an
open hole inspection performed by a Colorado registered engineer. Engineered foundations shall be
designed by a Colorado registered engineer.
5. The structure will probably be classified as a U (commodity shed) and B (office) occupancy. Fire
resistance of walls and openings, construction requirements, maximum building height and allowable
areas will be reviewed at the plan review. Setback and offset distances shall be determined by the
Zoning Ordinance.
6. Building height shall be measured in accordance with the 2003 International Building Code for the purpose of
determining the maximum building size and height for various uses and types of construction and to determine
compliance with the Bulk Requirements from Chapter 23 of the Weld County Code. Building height shall be
measured in accordance with Chapter 23 of the Weld County Code in order to determine compliance with offset
and setback requirements. When measuring buildings to determine offset and setback requirements, buildings are
measured to the farthest projection from the building. Property lines shall be clearly identified and all property pins
shall be staked prior to the first site inspection.

Subject: Weld County referral—Use by Special Review(USR-1554)—Barkey's Bossies Dairy
Dear Mr.Mueller:
The Town of Windsor Planning Commission reviewed this referral at its regular meeting of April 19, 2006.
The subject property is located outside the Town's Growth Management Area, but within the Community
Influence Area. Since the property is located outside the Town's GMA boundary, annexation is not
recommended.
The subject property is depicted as Low Density Estate Single Family Residential on the Town's Land Use
Plan map. This land use depiction provides for the lowest of all of the residential densities outlined in the
Comprehensive Plan and such areas typically consist of low density subdivisions and agricultural land at the
edge of the incorporated area. Agricultural activities such as irrigated crops, the raising of livestock and
dairies are typical of the immediate vicinity and the closest Town of Windsor subdivision is more than 1'/z
miles away.
Therefore, based upon the aforementioned information, the Planning Commission recommends approval of
USR-1554 to the Weld County Department of Planning Services subject to the following conditions:
1. The applicant shall dedicate any additional right-of-way along the entire length of the west property
line for Weld County Road 15 in accordance with Weld County Public Works Department standards.
2. The applicant shall dedicate any additional right-of-way along the entire length of the south property
line for Weld County Road 80 in accordance with Weld County Public Works Department standards.
