AMENDED USE BY SPECIAL REVIEW(USR)QUESTIONNAIRE
The following questions are to be answered and submitted as part of the USR application.
If a question does not pertain in to your use, please respond with "not applicable",with an
explanation as to why the question is not applicable.
Explain, in detail,the proposed use of the property.
This property is owned by Longmont Broadcasting, LLC and has been through the complete Use
by Special Review process and approval for construction of 2 broadcast towers of approximately
1,180 feet in height. Approval was granted by the Weld County Board of County Commissioners
at their August 3, 2005 meeting. The"West"tower of the 2 permitted has been constructed and
became operational with the primary broadcast tenant(NBC) on July 1, 2006, meeting the
requirements of both the tenant and the Federal Communications Commission construction
approval. This application for Amended USR is submitted with the sole intent of increasing the
permitted overall height of the towers to approximately 1,459 feet, pending and subject to
approval by the Federal Aviation Administration.
The property consists of 93.882 acres+/-and is described as Lot"B"of RE-3507, being part of
the North ''A of Section 33, Township 2 North, Range 67 West of the 6th P.M. The current use of
the property is as agricultural grazing land and has situate upon it 3 oil &gas wells, and one
broadcast tower of 1,180 feet in height as constructed per the approval of USR-1508. The
proposed use of the property is to erect 2 broadcast towers of approximately 1,459 feet in height
with associated broadcast support buildings. The towers will be owned and used by Longmont
Broadcasting, LLC for purposes of their own broadcast facilities as well as the leasing of
broadcast sites(on the towers)for other users. The broadcast users include, but are not limited
to: television, radio, private radio communications, emergency radio communications, cell phone
sites, satellite send/receive equipment, and private signal relays. The advent of FCC digital
television requirements beginning in 2006 (and mandatory by 2009)creates additional need for
the broadcast facilities. These uses are needed in this location due to the rapid growth in
population in the Northern Colorado area, particularly the southwest portion of Weld County,
including Erie, Dacono, Frederick, Firestone, Fort Lupton, Brighton, Berthoud, and Mead. Public,
private and emergency uses will be available to users of the tower. The surrounding site will
continue to be used as agricultural grazing land.
Explain how this proposal is consistent with the intent of the Weld County Code, Chapter
22(Comprehensive Plan).
The proposed use of the property for commercial broadcast towers is allowed in the"A"
Agricultural District through Use by Special Review(USR).
Explain how this proposal is consistent with the intent of the Weld County Code, Chapter
23(Zoning)and the zone district in which it is located.

What types of uses surround the site?Explain how the proposed use is consistent and
compatible with surrounding land uses.
The proposed use of the property for commercial broadcast tower is allowed in the"A"
Agricultural District through Use by Special Review(USR). Surrounding lands would not be
materially impacted by this use. Surrounding properties are utilized for agricultural production
and the adjacent parcel to the southwest already has situate upon it a broadcast tower similar to
the ones proposed by this application. That particular tower includes relay sites for the Weld
County Communications system used by Weld County Sheriffs Office,Weld County Ambulance,
and other users of the emergency system. Within one mile of the property, other uses of
surrounding properties are: ag grazing, ag production, rural residential, dairy, natural gas
processing plant, rural water district facility&tanks, oil &gas well operations, and high density
residential use(Frederick/Firestone/Dacono). See Exhibit X. NOTE: Since original approval of
USR-1508, 2 nearby facilities have been proposed and one is under construction. These consist
of a power generating "peaking" station to be built on a site just southeast of the subject property
on lands which are the subject of a petition for annexation to the Town of Frederick. The other
project is the construction of additional water storage tanks immediately to the southwest of the
tower site. The proposed height of the exhaust stacks for the power plant and the height and
proximity of the water tanks have the potential to affect broadcast signals from the very lower
portions of the Longmont Broadcasting tower facilities. While the final effects won't be known
until the neighboring facilities are built, the ability to obtain additional tower height would mitigate
any signal blockage that would result.
Describe, in detail,the following:
How many people will use this site?
Personnel requirements on site are minimal for the operation and maintenance of the towers.
There will be no public use or access to the site. The facility operates automatically 24 hours a
day, 7 days a week with personnel visits only intermittently to check facility operation.
How many employees are proposed to be employed at this site?
It is anticipated that one or two employees will visit the site 2 to 4 days per week for inspection,
operation, and maintenance. During construction or if facilities are being repaired or upgraded,
construction crews will visit the site as necessary, but this will be on a minimal and intermittent
basis.
What are the hours of operation?
The broadcast sites on the towers are designed to operate on demand and on the basis of 24
hours per day, 7 days per week. Operation is automatic and remote, thus no on-site operator is
required full time. There will be no stated hours of operation as the facility is accessed on an as-
needed basis with no public access.
What type and how many structures will be erected (built)on this site?
Please refer to the attached USR site plan details. The original proposed construction consists of
2 broadcast towers with support operations buildings and associated utilities. The first("west")
tower has been completed to a height of 1,180 feet. The USR amendment would allow an
additional approximately 300 feet in height to the current tower and apply the height allowance to
the east tower, if or when the applicant should decide to build the other tower. The towers are
anchored in concrete at the base and secured with 3 guy wire cable"legs"extending up to 950'
from the tower center. The tower base foundation creates a relatively small footprint of 20' x 20'.
The west tower is now operational and economics and the business climate and demand will
dictate if the applicant will construct the east tower. Each tower will require construction of an
operations building to house the tower monitoring and operation equipment. Each building will be
approximately 45' by 45' in size with gravel parking spaces. The building and parking area will be
located to protect from ice falls where possible. Parking areas will be covered to protect vehicles
and personnel from potential ice falls. Each tower site will provide for the construction of up to
eight(8) small base sites for satellite receiving dishes. The satellite receiver dishes will be
constructed near the center of the base of each tower at ground level with a height not to exceed
20 feet each.
What type and how many animals, if any,will be on this site?
None
What kind (type,size,weight)of vehicles will access this site and how often?
After construction is complete,the vehicles accessing the site will consist primarily of passenger
vehicles(cars, pick-ups)for site employees 3-4 days per week, and an occasional on-site visit by
larger trucks or vehicles for upgrading or maintenance purposes. Vehicle traffic to the site is
minimal and should provide very little traffic impact to Weld County roads or surrounding
properties.
Who will provide fire protection to the site?
The property lies within the boundaries of the Fort Lupton Fire Protection District. Contained in
this application is approval of accesses from the Fort Lupton Fire Marshall. See Exhibit Z.
What is the water source on the property?(Both domestic and irrigation).
Water supply for the site(both domestic and landscape irrigation)will be provided by a water tap
from Central Weld County Water District,which is installed and operational. See Exhibit E.
What is the sewage disposal system on the property?(Existing and proposed).
The small number of on-site employees and visitors creates a very small demand for sewage
disposal. The septic system was constructed under permit#SP-060045, issued by the Weld
County Department of Environmental Health. See Exhibit Y for engineering report.
If storage or warehousing is proposed,what type of items will be stored?
No bulk storage or warehousing is proposed beyond the on-site equipment and operational
supplies. There will be no retail uses on the site. There are no commercial goods to be
inventoried and the proposed buildings will be adequate for the applicants minimal storage
needs. Any hazardous materials will be properly stored and secured.
Explain the proposed landscaping for the site.The landscaping shall be separately
submitted as a landscape plan map as part of the application submittal.
No landscaping is planned as there will be minimal disturbance to the existing landscape and
ground cover. The is no practical way to screen a tower of over 1,000 feet in height, however the
structures have such a minimal profile as to not create a major visual blockage. Buildings are all
relatively low profile and will be located well off the county road right-of-way so as not to create a
structure requiring screening. Building colors will be neutral colors to blend with soil&vegetation
on site. The chain link security fencing or other security means surrounding the tower structure
and buildings as well as the tower guy anchors will not be screened, as the see-through nature of
chain link provides better visual inspection for security purposes. The screening of the chain link
fencing would create a much greater visual impact to the site than unscreened chain link. There
may be a need to construct an earthen berm near the proposed satellite send/receive dishes in
order to reduce terrestrial radio interference to those devices. If there is a need for the berms to
be constructed, soil disturbance will be kept to a minimum and the surface of the site and berms
will be reclaimed to compatible status(grass and ground cover to prevent erosion).
Explain any proposed reclamation procedures when termination of the Use by Special
Review activity occurs.
Dismantling of the towers on site with debris removed from the site is the only reclamation ever
anticipated. This is intended to be a permanent installation; it is unlikely that the facility use will
terminate. If use is terminated for any reason, applicant will agree to proper dismantling of the
tower and equipment. See Exhibit W.
Explain how the storm water drainage will be handled on the site.
The site has adequate natural drainage. No changes to site drainage area anticipated. Any
gravel surfaced interior roads will utilize roadside channels for drainage. Beyond that,the
proposed small buildings and non-paved internal roads will not materially change or impact the
current drainage and precipitation absorption, or create an erosion hazard.
Explain how long it will take to construct this site and when construction and landscaping
is scheduled to begin.
The"West"tower has been constructed per the original USR approval and became operational
with primary broadcaster(NBC)on July 1, 2006. The construction of the proposed second (East)
tower is based on future need. If and when the applicant decides to construct the second tower,
the construction timeline would be similar to the completed tower.
Explain where storage and/or stockpile of wastes will occur on this site.
Operations for the broadcast towers do not create waste beyond typical small office or small
household volumes of trash which can easily be disposed of with a commercial refuse firm.
ADDENDUM QUESTIONNAIRE FOR
AMENDED USE BY SPECIAL REVIEW(USR)
ADDRESSING WELD COUNTY CODE TOWER REGULATIONS
Weld County Zoning Regulations, Commercial Towers-Sec. 23-4-810
Regulation is paraphrased in standard type. Response is in italics.
Sec.234-810. Preferred Commercial Tower facilities.
Antenna towers. The proposed uses for the towers on this site cannot be otherwise
served by any other type of tower or facility.
Sec.234-820. General requirement
Antenna Towers are permitted by Special Use Review in the following zone districts: C, I,
A and PUD.
This property is in the "A"zoning district and application is being made by Use by Special
Review.
Accessory uses to a commercial tower shall not include offices, broadcast studios,
long-term vehicle storage or other outdoor storage, or other uses not needed to send,
receive or relay transmissions.
No offices or studios are planned or proposed. Proposed facilities are only those which
are necessary for the staffing and operation of the tower facility.
Radial Spacing.Antenna towers over seventy (70)feet high must be located at least one
thousand (1,000)feet from other antenna towers over seventy(70)feet high that are
capable of supporting Commercial Tower facilities. Closer spacing between towers may
be granted through the Special Use Review process. This radial spacing requirement
does not apply to facilities located at designated antenna farms.
This proposal is the equivalent of an antenna farm in that a total of 2 new towers are
planned(over time)and they will be located adjacent to an existing tower of essentially
equivalent appearance and use. The proposed towers are of the latest technology,
design, and engineering and will exceed the standard of the existing, adjacent tower.
Applicant seeks approval of tower design, location, &setbacks set forth on the USR plat.
The radial spacing of the towers will meet or exceed the stated 1,000 foot requirement.
See Exhibit C.
In addition to meeting the Special Use Review standards set forth in article 11, Division 5
of this Chapter, the applicant shall submit documentation addressing the following
standards:
1. Existing or approved towers cannot accommodate the telecommunications equipment
planned for the proposed tower.
The existing tower adjacent to the site is estimated to be 300%of planned antenna
capacity. The population growth in Northern Colorado and the federally mandated switch
to digital television mom than justifies the additional capacity of the proposed towers. An
analysis of the technical and loading capacities of the existing tower am included in this
application to demonstrate the further need for additional tower structures. See Exhibit
M.
2. The tower shall not constitute a hazard to aircraft.
FAA approval letter included in application. See Exhibit N. The applicant has a pending
request in process with FM for the amended increased tower height.
3. The tower shall be placed on the property to contain on site all ice-fall or debris from
tower failure.
Any ice fall is contained fully on the property, and the tower engineering is such that any
debris from unlikely tower failure would be contained on site. The property is over 93
acres in size and is more than adequate to contain and ice or debris fall on site.
4. The proposed tower shall provide for shared capacity, if technically practicable.
The proposed towers will provide for shared capacity and leasing of sites on the tower up
to the maximum allowed under applicable regulations. The attached proposal for the
facility provided by ERI contains the design which accommodates numerous shared
users, potential cell phone sites, and expansion of users as necessary. See also the
attached letter regarding shared capacity. See Exhibit O.
5. The tower shall have the least practicable adverse visual impact on the environment.
While it is impossible to "hide"a tower of over 1,000 feet in height, the visual impact is
minimized by the very small profile of the tower itself. (see photo-syms attached).
Support buildings are low profile. Security fencing is "see-through"chain link to minimize
visual impact. See attached photo-syms of the project to help illustrate the minimal visual
impact. See Exhibit P.
6. The proposed tower shall not emit radiation that will adversely affect human health.
No studies have proven adverse health effects from broadcast towers of this type when
constructed and operated within allowable regulatory guidelines. The strongest signals
are emitted from the very top most sections of the tower, which are farthest from any
persons in the area. FCC requires all applicants for such broadcast facilities to meet the
current ANSI standards for broadcast non-ionizing radiation. Attached is a report
containing the requirements set forth by FCC that must be met before FCC will issue a
construction permit. The applicant has been granted the FCC permit, thus the tower
construction proposal has satisfied the FCC regulations in regard to non-ionizing
radiation. See Exhibit Q.
7. The proposed tower shall be the minimum height needed to accommodate the
antenna.
The proposed height increase is made to accommodate additional broadcast range and
coverage in the primary broadcast area. The original height of 1,180 feet was based
upon what the Federal Aviation Administration would reasonable approve at that time. It
appears that there may be some consideration by the Agency to allow a height increase
to 1,459 feet if they can analyze and determine no additional risk to air traffic. The
primary impact resulting from additional tower height is to the airspace controlled by the
Federal Aviation Administration. The applicant understands and will accept a condition of
approval that provides no building permit for the additional height without the written prior
approval of the FAA.
8. The proposed tower shall comply with all applicable federal and state regulations.
The original FM and FCC approvals are included as a part of the application. See
Exhibits N&R. The FAA would still have to approve the additional height in order for any
construction to occur.
9. The design of the proposed tower shall insure structural integrity.
The tower is designed to FCC standards for wind loading and ice accumulation. The
tower is designed to fold and collapse in the event of a catastrophic failure. The
proposed tower will be of the most recent, modem design which is specifically
engineered for maximum structural integrity. The design is described in the ERI
documents attached. See Exhibit S.
10. The proposed tower shall have adequate measures to discourage unauthorized
climbing and to insure the security thereof.
There will be adequate guy wires to maintain the structural integrity of the towers. All
buildings, the tower bases, and guy wire anchor structures will be secured with tall chain
link security fences which remain locked at all times, or at the option of the applicant
other security measures may be implemented such as guy cable blocking plates or other
devices to discourage or prevent climbing or trespassing.
11.All reasonably possible sites for the tower have been considered, and the proposed
site is the most appropriate, available site from a land use perspective.
The elevation, topography, and location to potential signal recipients make this the best
location for these towers. The coverage area is shown in the attached coverage map(s).
Co-location of these towers adjacent to the existing tower will provide for less visual and
land impact than other sites while providing the required coverage by potential users of
the tower. See Exhibit T.
12. The proposed tower shall not adversely impact wildlife.
No changes to the site will materially impact wildlife. The tower has no moving parts or
operations which will materially adversely impact birds, bats, or terrestrial wildlife. No
fencing or structure is proposed that would interfere with migration or wildlife habitat.
A.Antenna Tower and Equipment Setbacks.
From property lines of properties in the E, R, PUD,A: one hundred percent(100%)of
tower height but not less than minimum building setbacks in the underlying zoning
district. This application proposes a setback of slightly less than 100%of tower height.
The proposal is for 2 towers co-located next to an existing tower, essentially creating a
tower farm. The addition of extra guy anchors for the proposed height increase will still be
within appropriate setbacks. All similar modem guyed antenna towers are designed to
fold and collapse in the event of catastrophic failure, thus they would not fall over in a
linear manner like a "stick" The careful design of these structures combined with the
proposed setbacks should provide more than adequate setbacks to accommodate ice
falls, falling debris, or even a catastrophic failure. The applicant requests approval of the
location and setbacks as shown on the USR plat. See Exhibits C& V.
4. Guy wires and equipment buildings and cabinets. Minimum setbacks for guy wires and
equipment buildings and cabinets are the same as minimum building setbacks in the
underlying zoning district.
Structures, cabinets, and guy wire bases will all meet minimum setbacks for the "A"
zoning district.
B. Equipment Design.
Antenna towers must not be artificially lighted unless required by the FAA or other state
or federal agency. If safety lighting is required, the use of red beacons is preferred to
flashing strobe lights. Security lighting on the site may be mounted up to twenty(20)feet
high and must be directed toward the ground to reduce light pollution, prevent offsite light
spillage and avoid illuminating the tower.
Safety and security lighting must meet all FAA or other requirements. The existing "west'
tower had some minor changes to painting and lighting from the original USR, all of
which were noticed to the WCDPS staff. The tower material is coated with a "galvanized"
coating in a grayish color that helps to blend with sky and clouds to reduce the visual
impact of the tower from any ground location. The tower has been equipped with the
latest technology utilizing directional strobe lights that operate in daytime, dusk, and
nighttime modes. The lights use varying levels of intensity and are aimed in an upward
direction to better alert nearby aircraft and to help reduce nighttime visual impact from
ground level.
4. Equipment buildings must be compatible with the architectural style of the surrounding
building environment with consideration given to exterior materials, roof form, scale,
mass, color.
Buildings will be constructed within the area designated on the USR plat, and am
planned to be low profile and security fenced. Building colors will be neutral colors which
blend with the surrounding soil&vegetative cover. As shown on the plat, the buildings
are designed to be expanded as necessary to accommodate future co-location of
additional broadcast tenants. See Exhibit C.
5. The maximum permissible noise level shall adhere to the maximum permissible noise
levels allowed in the underlying Zone district as delineated in Section 25-12-102, C.R.S.,
as provided by the Department of Public Health and Environment. Equipment must not
generate noise that can be heard beyond the site. However, this does not apply to
generators used in emergency situations where the regular power supply for a facility is
temporarily interrupted. It also does not apply to air conditioners or noise made during
regular maintenance and upkeep of the facility and site. (Weld County Code Ordinance
2002-9)
The applicant will comply with all regulations regarding noise set forth in the Weld County
code.

Sec. 234-840. Base or accessory site design.
A. Screening and landscaping appropriate to the context of the site and in harmony with
the character of the surrounding environment is required when any part of the facility is
visible from public rights-of-way or adjacent properties.
All structures are either low profile or have a small visual profile(width). While visible
from the county road right-of-way, the structures are located a minimum of 200 feet from
county ROW and have less visual impact than the existing oil&gas facilities on the site.
No screening landscaping is proposed due to the profiles and distance to county road
ROW The chain link security fence is a see-through fencing that provides security while
allowing a visual survey of the facility for security purposes. If screening is added to the
chain link, the visual impact is much greater from county road ROW than unscreened,
see-through chain link, thus no screening is proposed.
B. Existing vegetation and grades on the site should be improved or preserved to the
extent possible.
Minimal disturbance of the surface will occur during construction. Existing vegetation will
be maintained or improved to minimize erosion hazard. Noxious weeds will be controlled
on the site. Post construction, the disturbed areas will be reclaimed to agricultural
grazing status and will continue to be used for grazing purposes.
C. Signage at the site is limited to nonilluminated waming and equipment identification
signs.
The only proposed signage is nonilluminated warning, emergency contacts, equipment
designation signs, and federally required non-illuminated signage.
D. Commercial Tower facilities, except those in the C and I zones, must not include
manned offices, long term vehicle storage or other outdoor storage, or other uses not
needed to send, receive or relay transmissions. (Weld County Code Ordinance 2002-9).
Agreed. The facility is not manned, but will be operational 24 hours a day, seven days a
week. The only equipment storage proposed will be inside the security fenced areas and
will be limited to the time and equipment needs required to operate the ongoing
broadcast send and receive operations.
Sec. 234-850.Co-location on Antenna Towers.
A. Commercial Tower providers must not exclude other providers from co-locating on the
same tower when co-location is structurally, technically or otherwise possible.
Other users are included in the proposal and users will be actively sought at fair market
rates. The towers are designed specifically for co-location of additional providers.
Please see letter attached. See Exhibit O.
B. In addition to equipment proposed for the applicant's use, proposed antenna towers
(excepting concealed antennas)and sites must be designed to accommodate co-location
of additional Commercial Tower providers.
Other users are included in the proposal and users will be actively sought at fair market
rates. The towers are designed specifically for co-location of additional providers. Please
see letter attached. See Exhibit O.
A. Removal of abandoned Commercial Towers shall be addressed in all lease
agreements and shall specifically address the duties and obligations of the lessee and its
assigns as well as the property owner regarding the removal of Commercial Towers
deemed by the County to be abandoned.
Co-locations will be on the existing towers, so termination, abandonment, or non-use of a
co-located facility will not involve removal of a tower, only the tenant's broadcast
equipment mounted on the tower. Lease agreements will address equipment removal
with each individual tenant. Please see letter attached. See Exhibit W.
B. The applicant or owner shall submit an improvements agreement agreeing to remove
the improvements as shown in the application, plans, plat and other supporting
documents. The agreement shall be made in conformance with the County policy on
collateral for improvements. The agreement shall be approved by the Board of County
Commissioners prior to commencement of operations, as applicable. (Weld County Code

accomplish the stated use of television and radio broadcast, digital television
broadcasting, satellite send/receive, microwave signal relay, emergency
communications, and cell phone communication. See Exhibit S.

Executive Summary
This analysis was performed by ERI to determine the present structure's capability to meet the
requirements of the ANSUTIA/EIA-RS 222-F structural design standard for steel antenna towers
and antenna supporting structures with the addition of antennas as specified by the customer.
This tower was analyzed under three(3)loading configurations;first,with the current existing
loads only;second,with the ERI 6 Bay FM Panel and corresponding transmission line at 1000'
to 1060'removed and replaced with the proposed Dielectric TFU-28DSC-R P210 fed by a 4"
rigid transmission line;and third,with the ERI 6 Bay FM Panel and corresponding transmission
line at 1000'to 1060'removed and replaced with the proposed Dielectric TFU-26DSC-R P210
fed by a 6"rigid transmission line.
This report details the tower history,the present design code history and application,and the
impact of the wind speed and antennas on the structure. The ERI analysis finds:
1. Under all three loading configurations,the tower will not meet the minimum
requirements of the ANSI/TIA/EIA-RS Standard 222-F for the prescribed design
wind speed of 85 mph and 74 mph concurrent with 1/2"of radial ice. However,it
should be noted the structure's overall condition is improved with the 6 Bay ERI
Panel FM,currently located at 1000'to 1060',removed and replaced with either
proposed TV antenna as specified by the customer.
2. According to ERI's records,this structure has never been compliant to full design
wind speed requirements of the ANSI/ IA/EIA-RS design standards. The maximum
rating this structure has achieved is a 70 mph design wind speed without
consideration to ice.
3. Intensive reinforcement is required for the structure to be brought up to current
industry standards with the analyzed loading considered(see`Recommendations'). If
the tower is to maintain all antenna loading in accordance with current industry
standards,ERI recommends a new structure be considered for economic reasons
associated with required reinforcement costs.
Authority and Purpose
As authorized by William Vanderpole,of Blair Media,in a purchase order signed October 23,
2001,a structural analysis was performed to investigate the adequacy of an 1161'guyed tower in
Frederick,Colorado,to support additional antenna loading.
Method of Analysis
The analysis was performed using ERI Tower,a computer operation which investigates the
structure using both a linear and non-linear(P-delta)analysis. Only this technique determines
the true forces,displacements,and second order effects in the structure.
Unlike most other analysis programs,which assume the tower to be a continuous beam-column
on non-linear elastic supports,the ERI Tower program properly investigates all internal forces as
they apply to each individual member of the structure. The tower was analyzed considering
wind directions of 180 degrees(or"normal"),60 degrees,and 90 degrees to a tower face,and
considering appurtenance and gravity loads for the design wind velocity and when considering
the additional effects of radial ice where appropriate. Also,wind escalation and wind thrust on
the tower and appurtenances were considered.

We have analyzed this tower based upon the following information:
1. KYOU Antenna Tower/Frederick,Colorado/Original Antenna Configuration tower
drawing dated 1988.
2. Redwine-Reizian Incorporated evaluation report for this structure dated May 10,
1994.
3. Related ERI analyzes and evaluation reports dated from 1994 to 1998 (SP 209;SP
359;281/2059;285/1223;292/4645;292/4646;1080/136).

Loads and Stresses
The analysis was performed using the basic wind speed of 85 mph and 74 mph concurrent with
1/2"of radial ice. The loads were calculated and applied in accordance with the provisions of
the ANSWIT.A/EIA Standard 222-F,Structural Standards for Steel Antenna Towers and Antenna
Supporting Structures,effective March 29, 19%to present date.
Historic Review and Design Criteria
According to our records,the tower was originally manufactured by Vector Structural
Incorporated in 1988. The accepted design standard at that time was the ANSI/EIA Standard
222-D,effective for June of 1987 to February of 1991.
From 1994 to 1998,ERI conducted several evaluations of this structure. During this time period,
ERI recommended/designed leg member reinforcement,transmission line brackets,one
additional top guy level,and one additional guy anchor to accommodate the new guy level in
order to improve the structure to a rating of 70 mph basic wind speed without ice. According to
ERI's records,this structure has never been compliant to full design wind speed requirements of
the ANSI/DA/EA-RS design standards. The maximum rating this structure has achieved(after
previous reinforcement)is a 70 mph design wind speed without consideration to ice. It remains
ERI's position to not accept or recommend anything less than a structure complying with at least
the minimum rating specified by the current version of the ANSI/EIA/fIA Standard 222-F,and
to any local and/or state code requirements.
The current EIA/I'IA-222-F standard employs a basic wind speed to determine the design forces.
It is important to understand the difference between the forces generated by a gust wind speed
and the forces generated by the designated basic design wind speed or"fastest mile"wind speed.
A gust wind speed is generally reported by the weather service after a severe storm. By
definition it is the maximum wind velocity as a result of a three second or very short duration of
wind as measured 10 meters or 33 feet above ground level.
The basic or"fastest mile"wind speed is used to determine the design forces for a tower and
differs greatly from a gust wind. The fastest mile wind is the average wind velocity as measured
33 feet above ground level for a duration of the time required for a particle of air to travel one
mile at the specified average velocity. As an example,a 60 mph"fastest mile"wind speed
would be the average wind velocity fora 60 second duration. A 60 mph"fastest mile"wind
speed would typically include gust winds of much greater velocity.
The resulting design forces created by each type of wind are also much different. The resulting
design force created by a 70 mph basic or"fastest mile"wind velocity is approximately 1.4 times
greater than the force created by a 70 mph gust wind. The typical probability of a"fastest mile"
wind speed used for the design in the current standard is 1 in 50 years.
Considering these differences it is easier to understand why a tower designed to meet a specified
fastest mile wind will withstand much faster reported gust wind speeds. And conversely,why an
analysis may indicate an over stressed condition may exist at a design wind speed which is less
than a reported gust wind speed which the tower has successfully withstood.
Assumptions
This analysis is based upon the theoretical capacity of the structure. It is not a condition
ascnsment of the tower.
In offering this report ERI assumes:
1. Customer supplied information is accurate and correct. The Discrete(appurtenant)
Tower Loads are shown on the following pages. Antenna and appurtenance loading
is also portrayed on drawing E-1. These should be checked for accuracy and any
corrections communicated to ERI.
2. Existing transmission lines are distributed on the tower as portrayed on drawing E-7.
These should be checked for accuracy and any corrections communicated to ERI.
3. In absence of confirmed values from original tower manufacturer,leg member steel
was analyzed at minimum yield strengths(Fy)of 50 ksi. All other steel was analyzed
at minimum yield strengths of 36 ksi.
4. There has been no damage or modifications to the original design and materials either
by man or nature,either gradual or sudden,except where may be disclosed elsewhere
in this report.

Recommendations
1. Considering the severity of the tower stresses,if the tower is to maintain all antenna
loading in accordance with current industry standards,ERI recommends a new structure
be considered for economic reasons associated with required reinforcement costs.
Though no tower loading configuration meets current industry standard requirements,
with the 6 Bay ERI Panel FM,currently located at 1000'to 1060',removed and replaced
with either proposed TV antenna as specified by the customer,the structures overall
condition is improved.
2. Overstressed guy levels can be replaced with properly sized guying cable and attachment
hardware.
3. Overstressed tower leg members may be reinforced by the applications of welded and/or
bolted split pipe sections or angle members to increase their effective cross-sectional
area,or by adding intermittent horizontal members to reduce their un-braced length.

4. Overstressed horizontal and diagonal inner members could be reinforced by replacing the
member or by adding additional redundant bracing to reduce their un-braced length.
Accurate measurements on members would be necessary.
5. Overstressed connection bolts may be replaced with a higher strength bolts and/or
connections welded.
6. Original tower foundation drawings should be located,if possible,to properly analyze
capacities.
7. Re-analysis of the structure considering the additional wind loading of any reinforcing
members should be performed prior to installation of the new materials.
8. All structural changes made to the tower should be performed by professionally trained
individuals in tower erection and post-erection modifications.
9. The ANSI/17A/EIA-222-F standard recommends owners of guyed towers perform initial
and periodic tower inspections and maintenance to assure safety and to extend the
tower's service life. Major inspections should be performed at a minimum of every three
years by authorized personnel experienced in climbing and tower adjustments. A
complete list of the recommended maintenance and inspection procedure is contained in
Annex E of the ANSI TIA/EIA-222-F standard. Copies of the complete standard may be
obtained from Global Engineering Documents, 1-800-854-7179.

Executive Summary
This re-analysis was performed by ERI to determine the present structure's capability to meet the
requirements of the ANSIl'IA/EIA-RS 222-F structural design standard for steel antenna towers
and antenna supporting structures with loading modifications as specified by the customer.
This tower was analyzed under a fourth proposed loading configuration(Proposed Loading
Configuration 4)which included all existing tower loads except for the ERI 6-Bay FM and
transmission feed at 1,000'to 1,060'which was replaced with a low-power ALP 12L2 HSNR 29
UHF antenna fed by a 3"transmission line.
This report details the tower history,the present design code history and application,and the
impact of the wind speed and antennas on the structure. The ER1 analysis finds:
1. With the analyzed loading in Proposed Loading Configuration 4,the tower will not
meet the minimum requirements of the ANSUPIA/EIA-RS Standard 222-F for the
prescribed design wind speed of 85 mph and 74 mph concurrent with 1/2"of radial
ice.
2. Though the structure will not meet full requirements of the current ANSI/fIA/ElA-
RS Standard 222-F,the structure's overall condition is improved with the loading
changes listed above.
Authority and Purpose
As authorized by William Vanderpole,of Blair Media,in a purchase order signed October 23,
2001,a structural analysis was performed to investigate the adequacy of an 1161'guyed tower in
Frederick,Colorado,to support specified loading.
Method of Analysis
Refer to previous report(#09043).
Loads and Stresses
The analysis was performed using the basic wind speed of 85 mph and 74 mph concurrent with
1/2"of radial ice. The loads were calculated and applied in accordance with the provisions of
the ANSI/TIA/EIA Standard 222-F,Structural Standards for Steel Antenna Towers and Antenna
Supporting Structures,effective March 29, 1996 to present date.

Recommendations
I. With the specified loads removed for Proposed Loading Configuration 4,the tower will
not meet the minimum requirements of the ANSI/TIA/EIA-RS Standard 222-F for the
prescribed design wind speed of 85 mph and 74 mph concurrent with 1/2"of radial ice.
Tremendous reinforcement costs would be incurred to bring this tower into full
compliance with current industry standards.
2. Though the structure will not meet full requirements of the current ANSI/TIA/EIA-RS
Standard 222-F,the stnrcture's overall condition is improved with the loading changes
specified for this loading configuration(Proposed Loading Configuration 4).
3. Overstressed guy levels can be replaced with properly sized guying cable and attachment
hardware.
4. Overstressed tower leg members may be reinforced by the applications of welded and/or
bolted split pipe sections or angle members to increase their effective cross-sectional
area,or by adding intermittent horizontal members to reduce their un-braced length.
5. Overstressed horizontal and diagonal inner members could be reinforced by replacing the
member or by adding additional redundant bracing to reduce their un-braced length.
Accurate measurements on members would be necessary.
6. Overstressed connection bolts may be replaced with a higher strength bolts and/or
connections welded.
7. Original tower foundation drawings should be located,if possible,to properly analyze
capacities.
8. Re-analysis of the structure considering the additional wind loading of any reinforcing
members should be performed prior to installation of the new materials.
9. All structural changes made to the tower should be performed by professionally trained
individuals in tower erection and post-erection modifications.
10.The ANSI/TIA/EIA-222-F standard recommends owners of guyed towers perform initial
and periodic tower inspections and maintenance to assure safety and to extend the
tower's service life. Major inspections should be performed at a minimum of every three
years by authorized personnel experienced in climbing and tower adjustments. A
complete list of the recommended maintenance and inspection procedure is contained in
Annex E of the ANSI/TIAJEIA-222-F standard. Copies of the complete standard may be
obtained from Global Engineering Documents, 1-800-854-7179.

the impact of other existing or proposed structures. The study disclosed that
the described structure would have no substantial adverse effect on air

AERONAUTICAL STUDY NO. 2004-ANR(-47/48-08
1. LOCATION OF PROPOSED CONSTRUCTION
The proposed structures will be located approximately 9.6 nautical miles
northeast of the Erie Municipal Tri-County Airport, Erie Colorado.
2. OBSTRUCTION STANDARDS EXCEEDED
The proposed structures are identified as an obstruction under the standards of
Federal Aviation Regulations, Part 77, as follows:
Section 77.23 (a) (5).: The surface of a takeoff and landing area of an airport or
any imaginary surface established under 77.25, 77.28, or 77.29. Exceeds by 660
and 659 feet, respectively.
3. EFFECT ON AERONAUTICAL OPERATIONS
a. The impact on arrival, departure, and en route procedures for aircraft
operating under visual flight-rules (VTR) follows:
Adverse Impact- The proposed antennas would exceed the Federal Aviation
Regulation (FAR) , Part 77 Horizontal Surface by 680 and 659 feet. However, there
are already two existing structures in the vicinity at the same height above sea
level. The impact of the proposed antenna towers can be mitigated with
obstruction marking and lighting.
b. The impact on arrival, departure, and en route procedures for aircraft
operating under instrument flight rules (IFR) follows:
None.
c. The impact on all-existing public-use airports and aeronautical facilities

Dear Ms. Mika,
I would like to state some of the key elements of our business plan for our proposed
Commercial Tower project. We are designing our towers from a structural and technical
perspective to accommodate co-location with other providers of communication services
to the surrounding communities.
In fact, we believe for our tower project to be commercially viable, we must attract a
reasonable number of new and existing providers. We hope that we could provide tower
space for the facilities of some combination of commercial, municipal,or other
governmental entity. We will then work diligently to finalize commercially reasonable
lease agreements with the co-located service providers and within our structural and
technical design criteria.
Additionally, once we have our necessary approvals and if it's appropriate, we would
appreciate the County's making this information available to any service providers
looking for tower locations.

I am a Consulting Engineer, an employee in the firm of Carl T. Jones Corporation,
with offices located in Springfield, Virginia. My education and experience are a matter of
record with the Federal Communications Commission. I am a registered Professional
Engineer in the Commonwealth of Virginia, Registration No.7418, and in the State of New
York, Registration No. 63418.
GENERAL
This office has been authorized by Longmont Channel 25, Inc., licensee of
KDEN(TV), channel 25, Longmont, Colorado, to prepare this statement, FCC Form 301,
Sections III and III-C, and the associated exhibits in support of an application for
construction permit for modification of KDEN(TV)'s licensed transmission facility. It is
proposed herein to re-locate KDEN(TV)'s transmission facilities to a new tower support
structure to be located at 40..5' 57" North latitude, 104•.53'48"West longitude. The FAA
has been properly notified and the licensee will dutifully registerthe proposed structure with
the Commission upon receipt of a determination of no hazard to air navigation. This
application seeks to co-locate KDEN(TV)with the facilities of KDEN-DT as is proposed in
a separate application for modification of construction permit BPCDT-19991018AAS. The
re-location of KDEN(TV), and KDEN-DT, is necessary because the licensed and CP site
is leased, and can not be sufficiently altered to accommodate KDEN-DT.

PROPOSED DIRECTIONAL ANTENNA
The applicant proposes to relocate KDEN(TV)'s existing licensed antenna, a
Dielectric Model TFU-33JSC-R (S), to the new support structure. It is intended to install
KDEN's existing antenna on the new tower structure below the KDEN-DT antenna, which
is to be top-mounted. The manufacturer's horizontal plane azimuth directional radiation
pattern is shown in exhibit 2. The manufacturer's vertical plane elevation radiation pattern,
illustrating the proposed antenna's radiation characteristics above and below the horizontal
plane, is shown in exhibits 3 and 4. A vertical plan antenna sketch is shown in exhibit 1.
PREDICTED COVERAGE CONTOURS
The predicted coverage contours were calculated in accordance with the method
described in Section 73.684 of the Rules, utilizing the appropriate F(50,50) propagation
curves (47 CFR Section 73.699, Figure 9), power, and antenna height above average
terrain as determined for each profile radial. The average terrain on the eight cardinal
radials from 3 kilometers to 16 kilometers from the site,was determined using the National
Geophysical Data Center Thirty Second Point Database (TPG-0050) as prescribed in the
FCC Rules. The antenna site elevation and coordinates were determined from data
provided by a licensed surveyor. Exhibit 5 contains the predicted Grade B (64 dBu)
contour, the predicted Grade A (74 dBu) contour and the principal community (80 dBu)
contour. It is readily apparent that the 80 dBu contour completely encompasses the
principal community of license, Longmont, Colorado.

ALLOCATION CONSIDERATIONS
NTSC Allocation Considerations
An allocation study was performed to ensure that the proposed transmitter site
complies with the Commission's minimum distance separation requirements of Section
73.610. The study revealed that the proposed site satisfies the minimum distance spacing
requirements to all pertinent authorized NTSC facilities.
DTV Allocation Considerations
A study was performed to determine if the proposed relocation of KDEN(TV) is
predicted to cause any level of new prohibited interference to DTV stations, expansion
construction permits or DTV allotments. Results of the FCC program"tv-process"indicate
that the instant proposal to relocate KDEN(TV)is predicted to cause no unacceptable level
of new interference to the populations served by any DTV station, expansion construction
permit or allotment.
Class A Television Allocation Considerations
As required in Section 73.613 of the FCC's Rules, a study of interference contour
overlap was considered, based on the proposed relocated KDEN(TV)facility, to establish
compliance with the protection requirements contained therein. The study results indicate
that no prohibited contour overlap exists with any LPN stations which have obtained
Class A Status.

Table Mountain Radio Receiving Zone
Section 73.1030(b)of the Commission's Rules requires all applicants to protect the
area therein designated from potentially harmful interference. The modifications proposed
herein were evaluated to determine compliance with those requirements. The predicted
signal strength from any proposed facility operating in the 470 MHz to 890 MHz band
should not exceed a field value of 30 millivolts per meter within its authorized bandwidth.
As shown in exhibit 6 the Table Mountain Radio Receiving Zone is located entirely outside
the predicted KDEN(TV) 30 mV/m (89.5 dBu) signal strength contour.
BLANKETING AND INTERMODULATION INTERFERENCE
A number of broadcast and non-broadcast facilities are located within 10 km of the
proposed KDEN(TV)transmitter/antenna site. The applicant recognizes its responsibility
to remedy complaints of interference created by this proposal in accordance with
applicable Rules.
ENVIRONMENTAL CONSIDERATIONS
RADIO FREQUENCY IMPACT
Effective October 15, 1997 the FCC adopted new guidelines and procedures for
evaluating environmental effects of radio frequency (RF) emissions. The guidelines are
generally based on recommendations by the National Council on Radiation Protection and

Measurements (NCRP) in NCRP Report No. 86 (19861 and by the American National
Standards Institute and the Institute of Electrical and Electronic Engineers, LLC (IEEE) in
ANSI/IEEE C95.1-1992 (IEEE C95.1-1991). The guidelines establish a maximum
permissible exposure (MPE) level for occupational or"controlled" situations that apply in
cases that affect the general public. The FCC Office of Engineering and Technology's
technical bulletin No. 65 entitled, "Evaluating Compliance with FCC Guidelines for Human
Exposure to Radio Frequency Electromagnetic Fields" (DA 04-319, February 6, 2004),
provides assistance in the determination of whether FCC-regulated transmitting facilities,
operations or devices comply with guideline limits for human exposure to radio frequency
electromagnetic fields as adopted by the Commission in 1996. Bulletin No. 65 provides
the technical data required to evaluate compliance with the FCC's policies and guidelines.
The FCC's Maximum Permitted Exposure (MPE) level for "uncontrolled"
environments is 0.2 milliwatts per centimeter squared(mW/cml when applied to broadcast
facilities operating between 30 MHz and 300 MHz, and for broadcast facilities operating
between 300 MHZ and 1500 MHz, primarily UHF TV stations, is derived from the formula,
(frequency/1500). The MPE level for "controlled" environments is 1.0 milliwatts per
centimeter squared (mW/cm2) for operations between 30 MHz and 300 MHz, and for
broadcast stations operating between 300 MHz and 1500 MHz is derived from the formula,
(frequency/300). The predicted emissions of KDEN(TV) must be considered, along with
the predicted emissions from other proposed stations at the site. For KDEN(TV), which

operates on television Channel 25 (536-542 MHz), the MPE is 0.359 milliwatts per
centimeter squared (mW/cm2) in an "uncontrolled" environment and 1.795 mW/cm2 in a
"controlled" environment. The proposed KDEN(TV) facility will operate with a maximum
ERP of 2200 kW using a horizontally polarized transmitting antenna at a centerline height
of 466.9 meters above ground level(AGL). Considering a very conservative vertical plane
relative field factor of 0.3,the KDEN(TV)facility is predicted to produce a power density at
two meters above ground level of 0.01536 mW/cm2, which is 4.28% of the FCC guideline
value for "uncontrolled" environments, and 0.856% of the FCC guideline value for
"controlled" environments (see Appendix A). The total percentage of the ANSI value
including all station at the proposed site is only 57.37% of the limit for "uncontrolled"
environments, and 11.47% of the limit for"controlled"environments.
OCCUPATIONAL SAFETY
The licensee of KDEN(TV)is committed to the protection of station personnel and/or
tower contractors working in the vicinity of the KDEN(TV) antenna. The applicant is
committed to reducing power and/or ceasing operation during times of service or
maintenance of the transmission systems, when necessary, to ensure protection to
personnel.
SUMMARY
It is submitted that the instant application for construction permit seeking to relocate
the transmission facilities of KDEN(TV) as described herein complies with the Rules,

PE sealed documents do not include nor imply any special, local authority
^ mandated fabrication inspection or site foundation or tower erection inspection
responsibilities. Any special inspection requirements must be specified at the time
of work authorization and may necessitate additional costs. Special inspection of
fabricated material can not be accomplished with the same degree of accuracy after
galvanization and often will not be accepted by the requesting authority.
It is the purchaser's nosponsibility to notify ERI of any stipulations in addition to the
ANSUfIA/EIA-222-F design standard which may be required by state or local
authorities prior to the start of the contracted services. Failure to make timely
notification may necessitate additional charges if supplemental services are
requested or the quoted design is changed in order to satisfy state or local
jurisdiction requirements.
The foundation design for the above described quote is based upon the"Standard
Foundation"as defined in Section 7 of the TWEIA-222-F Standard for Steel
Antenna Towers and Antenna Supporting Structures. This definition
includes,"Standard Foundations and Anchors-Structures designed to support the
specified loads defined in Section 2(of this standard)for Normal Soil conditions as
defined in 7.1.3 and modified below. Pile construction, roof installations,
foundations or anchors designed for submerged soil conditions,saturated or
submerged soils(below the water table or perched water level), rock,noncohesive
soils(sands and sandy clays), etc., are not to be considered as standard."
This standard further states,"Standard foundations and anchors may be used for
bidding purposes and for construction when actual soil parameters equal or exceed
Normal Soil parameters." When standard foundations and anchors are utilized for
final design, it shall be the responsibility of the purchaser to verify by geotechnical
investigation that actual site soil parameters equal or exceed Normal Soil
parameters. If the purchaser elects to accept the Normal Soil foundation for
construction, he accepts the responsibility and liability for the adequacy of the
subsurface soil conditions.

EIA"Normal Soil"is defined as,"a cohesive soil(days and clayey sands)with an
allowable net vertical bearing capacity of 4000 psf and an allowable net horizontal
pressure of 400 psf/ft to a maximum of 4000 psf. Uplift forces shall be resisted by
the foundation weight plus the weight of earth enclosed within an inverted pyramid
or cone whose sides form an angle of 30°with vertical above the foundation. Earth
shall be considered to weigh 100 pcf and concrete 150 pcf. Straight shaft drilled
piers shall have an ultimate skin friction of 200 psf/ft to a maximum of 1000 psf."
ERI strongly recommends a geotechnical investigation be performed prior to final
design to verify the adequacy of these soil conditions.
Terms:
50%due upon receipt of order and balance due before shipment.
Any unpaid balance over 30 days will be charged a 1.8%per month finance charge.

1. This quotation is an otter made by Electronics Research,Incorporated(ERI)to sell to Buyer the products and services described in this
quotation(collectively the"products"on the terms and conditions contained M this document.This quotation and offer may be volt drawn or
revoked by ERI at any time prior to as receipt of Buyers acceptance.
2. Acceptance of this quotation and otter is limited to the terms and conditions contained herein.ERI hereby notifies Buyer of its objection to all
terms and conditions in ail communications from Buyer which we additional to,different from and conflicts;with the terms and conditions
contained herein.The quotation shell be deemed accepted if Buyer anal dispatch any communication,regardless of its label or purpose which
substantially agrees with Its quotation as to the quality,desalptlon and price of the products.
3. The prices quoted herein do not inducts applicable taxes,export licenses,building permits,cam-actors penNpAcenses or any other licenses
or permits which may be required by local,state,or national governments.M addition to such quoted prices the buyer ws pay all present and
future expenses or penalties related thereto applicable to the sales,purchase,transportation,deWery,or use of the products,except taxes
based upon ERI's income.To the extent ERI is required to pay or collect such taxes,Mee,Interest or penalties.the same will be paid by the
Buyer to ERI.upon invoiced rendered.
4. ERI will render invoices in accordance vita the payment sdhedde set forth in this quotation.Invoices will be paid in full within 30 days from the
date thereof,unless otherwise specified on the invoices,and any amounts net paid within that 30 day period w ll be deemed past de.Buyer
will pay to ERI a service charge equal to 1-1/2%per month(or portion thereof)of all past-due amounts and,in addition,will reimburse ERI for
all costs and expenses(including.but not fitted to,avert costs and reasonable attorneys fees and costs)Incurred by ERI in its efforts to
affect collection of any past-due amounts.
5. ERI reserves the right to use its judgment in selecting the appropriate means of shipment of the products,and has no obligation to provide or
obtain any insurance for the benefit of the Buyer.
8. To secure payment of all amounts%Rich are or may become due to ERI hereunder,Buyer hereby grew to ERI a secrity interest in the
products and all proceeds thereof and irrevocably authorizes ERI to execute and ile t iandng statements on Buyers behalf.Buyer ell
segregate or otherwise render easily Ideritllable all proceeds.Buyer w11 not grunt a security interest in the products or proceeds to any other
person,and will refrain from any ad tending to flak ERrs security interest in the products or proceeds.
7. If the Buyer makes an assignment forte benefit of creditors,or a voluntary or kwoknday petition or other actin in bankruptcy or
reorganization under any other insolvency law shall be lied by or against Buyer,or Buyer shall Snit to any person its inability or
unwillingness to pay any of its debts,a e tine,receiver or liquidator is appointed for any part of the assets of Buyer(whether such acts be
voluntary or involuntary)or Buyer fells to fulfill the terns of payment hereunder,or ERI reasonably deems wet insecure,then ERI may.at its
option,immediately terminate or suspend further work hereunder and charge Buyer on the basis of the percentage of cannplelbn of
perfomiance at the time and on the price stated herein and/or may require immediate ediate payment for all products delivered and/or may require
full or partial payment in advance for all products delivered and/or may require fit or partial payment in advance for all products not delivered.
Furthermore,ERI reserves the right at any time to require from Buyer satisfactory security and assurance for performance of Buyer's
obligation hereunder.Nothing stated in this section shall in any way inat ERI's rights or remedies upon default as provided esevrere herein
or as given by law.
8. ERI,in its sole decision,may suspend Its performance hereunder and shall not be liable for any delay,damage or loss occasioned thereby,if
ERI reasonably dabs Its abity to perform hereunder to be flied,kayaked,diminished,or otherwise adversely affected because of any act
of God.Me,explosion,labor dispute,strike or slowdown,embargoes,employee mess,war,police action,riot condition,delay of carrier,
failure,crtaiment or delay of ERIs operations or operations of ERrs suppliers ad/or subcontractors,current or roue governmental
regulation or order,inabtty to obtain pas,retedals,energy,equipment,inventory,labor or any of the components of rie products,or any
other Interruption of business,casualty.event or circumstance not within the exclusive control of ERI,similar or dissimilar.
9. No contract or order resulting here from is subject to tennabon,cancellation,modification or amendment in any respect by the Buyer,except
upon written request to ERI,accepted In writing by a Vice President or Corporate Officer of ERI.and then only upon payment by the Buyer of
all termination,cancellation,modification or amendment charges determined by ERI.In such event,ERI may,at Its option,revere its price,
payment schedule,completion and delivery schedules to provide for such modification or amendment.
10. If Buyer requires ERI to delay delivery of material and/or perfomhance of services,payment for material or services shall not thereby be
postponed or edended.Material held in storage for Buyer shall be at the risk and expense of the Buyer and shorts set by ERI at the time of
request for storage by Buyer or upon notification of Buyer by ERI that storage fees will be assessed.
11. ERI shall In no event be liable,in contract,tort or otherwise,for special,ndiect.Incidental or consequential loss or damage to Buyer or others,
or for loss or damage(whether personal properly or otherwise)in excess of the snout paid by Buyer pursuant to this quotation,resulting
from,or arising out of,the breach of any term or crdtlon(whether express or implied)of any contract resulting here from,or otherwise
resulting from,or arising out of,the manufacture,sale,delivery,Istallatlon ad/or servicing of the products or the performance or non-
performance of any contract resulting here from.
12. After ERI has completed performance hereunder,Buyer shall keep and maintain the products in good condition,In accordance with all
regulations or recommendations of any government ant agency or body and In accordance with generally accepted maintenance standards in
ERI's industry.Buyer shall forever protect,defend,indemnify and hold ERI free and harmless against any and all dens,demands,liabiltles,
cause of action(including,without antlation,legal costs and expenses and reasonable atorrsys fees)arising out of,or relating to Buyer's
failure to completely discharge as obligations hereunder.
13. Upon default or breach by Buyer,ERI is entitled to all remedies and damages specified herein as well as as those impaled by law or equity or
authorized by any statute,including without limitation consequential.incidental and direct damages,and the right to enjoin Buyers rights to
use the products.
14. General co dMias
a. ERI reserves the right to change or modify Its design and construction of the products and/or to substitute materials equal to or
superior to or functional equivalents to that airily toadied herein provided,however,that any substitution,change or
modification shall not materially and adversely affect Buyers ability b use the products.
b. ERI reserves the right to make changes in design and construction of the products it manufactures for others and to make and/or
add Improvements in such products at any time without inclining any obligation to install the sane in to products sold herein.
c. ERI shall have no ob igadon to change,modify or Improve any products to cordorm changes in designator engineering standards.

ERI shall furnish construction and Installation drawings and engineering data for a products upon request.
e. This quotation is submitted in accordance with the ANSUEIMIA-222-F-1996 standard.This standard is intended to set the
minimum criteria for design,fabrication ad construction of antenna support structures.It is the responsibility of the Buyer to provide
site specific data and any requirements differing from those contained in Uts standard to ERI prior to accepting this proposal.Please
refer to Appendix A of the ANSIIEINTIA-222-F-1996 edition for further information.
15. This quotation is based on won carried out in one continuous operation without Irternplbn or delays due to Buyer applied missing materials,
such as,but not limited to antennas,transmission lines,trensnissbn line halters,installation drawings,tower components,or electrical
power.M material necessary for campeWg installation,to be furnished by Buyer,must be on the tower site prior to starling of Installation or
scheduled in such a manner as to avoid delasing crew.
16. Down time resulting front situations beyond the control of ERI as described In nem niter 15 above,will be billed at normal labor rates.
17. The quotation on labor to inset tower and/or antenna and other retorted equlgsrt is based span weather and time suitable for outdoor
construction and during daylight hags.In the event the Buyer desires work done under the handicap of snow,rain,ice,severe Mid or old,or
nondaytght horn,then the cost of erection shall be increased to include the additional coat incurred unless otherwise specified in this proposal.

On January, 18 2005 using the FCC ASR Registration Search program I conducted an inventory
of all towers taller than 1000 feet in Weld County and with in one mile of the Weld County Line
in Colorado and Wyoming.Only one tower of that size was found in the defined area. That
tower is the current Clear Channel tower located adjacent to the towers proposed in this

Dear Mr.Freeman:
You have requested information in regards to the collapse mode of this structure, if it were to
fail. The ERI tower design is a guyed structure and has six guy anchor location points,with two in line
in each of three directions. These guys support a 7 foot face width triangular steel tower mast Due to
the slenderness of the guyed tower mast in relation to the towers height and the multiple guy anchor
locations the mode of collapse for this structure is in a folding configuration with the main portion
extending out 25%to 50%of the tower height. Any distance beyond this will be quite unusual. For the
outer limits of an unusual collapse condition I still do not expect any portion of the tower mast or other
significant debris to extend beyond 70%of the tower height,or in other words debris of any significance
will remain within the guying radius of this structure. Enclosed is a sketch which has a basic
representation of the guyed tower collapse mode described.

Dear Ms. Mika,
1"his letter acknowledges that Longmont Broadcasting,LLC will include in all of its lease
agreements specific provisions requiring any lessee and its assigns to promptly remove at
their expense all of its facilities from our tower and property upon the lease termination
and or abandonment of such facilities. In the event the lessee does not comply with the
duties and obligations of the lease in a commercially reasonable timeframe, Longmont
Broadcasting, LLC or its successors in interest be obligated to fulfill the responsibility of
the removal of the facilities.
Since co-location will be provided for and sought after, the termination,abandonment, or
non-use of a given facility will generally not impact the continued commercial viability
of our commercial towers,and therefore not require the removal of a tower.
However,in the event that Longmont Broadcasting, LIC or its successors in interest(the
owner)determine the towers are no longer commercially viable or if the County
reasonably deems the towers as abandoned,the owner will agree to dismantle and remove
the structure from the property at its expense.
