The Weld County Public Works Department has reviewed this proposal; this project falls primarily under the purview of the Use by Special Review Standards, Weld County Code, Chapter 23, Article II, Division 4, Section 23. Our comments and requirements are as follows: COMMENTS: Weld County Road Classification Plan (FHU): (June 2002) WCR 27 is a major arterial road, which requires a 140-foot j'right-of-way at full build out. There is presently a 60-foot right-of-way. This road is maintained by Weld County. Pursuant to the definition of SETBACK in the Weld County Zoning Ordinance (23-1-90), the required setback is measured from the future right-of-way line. REQUIREMENTS: Access: The applicant has identified on the plat drawing two existing accesses from WCR 27. The existing north access by j office shall be utilized as the main access point for employees and vehicles. The secondary access is a dirt access with a gate to provide access to the pump house directly south of the main access gate. Utilize these two access points only. Off-Street Parking: The applicant has paved the approach to the existing office building and the new parking lot area. Each parking spot shall be adequately stripped and equipped with a wheel guard where needed to prevent vehicles from extending beyond boundaries, other spaces, and coming into contact with vehicles, walls, fences, sidewalks, or plantings. Vehicle Storage Area: The vehicle storage area shall be surfaced with gravel or the equivalent and shall be graded to prevent drainage problems. The plat drawing is identifying a 30-foot wide roadway for traffic flow throughout the facility. All access isles will have a typical maximum outside radius of 50-foot and a typical minimum inside radius of 30-foot. Future Right-of-Way: Additional right-of-way has been reserved for future expansion of WCR 27 for a total of 70 feet of right-of-way from the centerline of WCR 27. The applicant has placed solid fencing within the future right-of-way. The Weld County Public Works is agreeable with this that at some time in the future when WCR 27 is expanded, this solid fencing shall be removed and relocated at the cost of the applicant outside the future right-of-way. Storm Water Drainage: The applicant has submitted a final drainage report amended 1 dated April 25, 2006. This will be 'passed on to our drainage division for review and approval. Comments made during this phase of the review process may not be all-inclusive, as other concerns or issues may arise during the remaining application process. Drainage Comments The following comments are a result of the review of the Final Drainage Report—Addendum 1 for Copart Auto Auctions(AmUSR-1493) submitted by Jeremy Gacnik,P.E., (Colorado P.E. #38425) of Ware Malcomb on April 28, 2006. The report is dated April 25, 2006, and was not stamped, signed, or dated by a licensed P.E. The following items must be resolved PRIOR TO RECORDING OF FINAL PLATS: ❑ On-site detention must be provided for the 100-year fully-developed runoff and released at a rate not to exceed the 5-year historic discharge, as per Weld County CODE 24-7-130(D). The 100-year release rate of 57.65 cfs is not acceptable under Weld County CODE. o Please recalculate the required detention under the 5-year historic release rate and resubmit calculations for review. ❑ Please revise all hydrologic input variables to industry standards and Weld County drainage criteria. ❑ Please detail proposed contours for the entire site. ❑ The Final Drainage Report and all construction plan sheets included therein must be stamped, signed, and dated by a licensed P.E.registered to practice in the State of Colorado. Drainage Comments: ❑ Please address all redline comments provided in the Final Drainage Report, and the USR Drainage Report Checklist included with this memorandum. ❑ Please add the following note to the text of the Final Drainage Report: "Weld County will not be responsible for the maintenance of drainage related areas." ❑ Please reference the Urban Drainage and Flood Control District (UD&FCD) as our standard manual in the Engineer's Statement at the front of the report. ❑ The Vicinity Map in the Appendix of the report must have an appropriate scale. ❑ Please delineate site/property limits on the FIRM map provided in the Appendix of the report. ❑ The runoff coefficient for gravel streets in Table III of the Appendix is correct,but the percent impervious is not correct. Please use a similar table(i.e. UD&FCD Table RO-3)with the correct runoff coefficient and percent impervious values. o Please update all spreadsheets with a more appropriate percent imperviousness for gravel roads and resubmit for review. ❑ Please provide appropriate erosion control at pipe outlets and inlets, overflow areas, channel bends, high shear stress channels and swales, or any other areas requiring erosion control. Design calculations must be provided to support the selection of any and all erosion control measures. Page I of 2 o Please add rock riprap protection calculations for the culvert outlet at the detention pond. Include rock size(D50)and apron limits (length, width, and thickness), and show a stable erosion protection design. Please utilize UD&FCD methods, and include all design calculations and/or spreadsheets in the report appendix. o Any open-air culvert inlets shall include debris racks to prevent clogging due to debris accumulation and to protect the public safety. Debris racks shall be sloped at 3H:1V or flatter per UD&FCD research. ❑ Revegetation of all disturbed earth shall comply with all standards defined in the Revegetation section of the Weld County Storm Drainage Criteria Addendum dated February 2006. o Detention areas must be placed in a dedicated drainage easement. o Please identify and dimension all drainage easements and right-of-ways on all plan sheets submitted with the Final Drainage Report. ❑ Please provide calculations to show adequate sizing of the emergency overflow spillway and associated erosion control measures on the spillway. The maximum depth shall not exceed 6 inches for 100-year flows, and the spillway shall have adequate erosion protection on the upstream face, overflow crest, and downstream face to prevent erosion during operation. In February of 2003, the City of Brighton sent the Weld County Department of Planning Services a comment letter on Case Numbers: CZ-Ioz8 and CZ-Ioz9 in regards to the rezoning of the property from an agricultural designation to an industrial designation. As we stated in that letter, the City of Brighton was generally opposed to the rezoning designation to an industrial zone district. Within the letter we specifically noted the following: > The City of Brighton is particularly concerned with the prospect of potential industrial uses along HWY 8y(Case Number CZ-r028), which collectively forms the"gateway"to Brighton, and would request that such uses be precluded from the HWY 8y corridor, unless accompanied by stringent buffering and landscaping standards. > Likewise, the proposed rezoning of property with Case Number CZ-myinvokes similar concerns regarding WCR 27; the City of Brighton would request that, if approved, such approval would be contingent upon the inclusion of similar buffering and landscaping standards requested for the Hwy 85 corridor. The City of Brighton's position has not changed in regards to our belief that this area is not appropriate for industrial uses; however, the site is currently zoned industrial and thereby, steps should be taken to mitigate the impacts of the zoning and uses on the surrounding environs. The recent site plan referred to us (dated 5/1/06) along with the rest of the referral materials denotes an eight foot (8') high fence along the perimeter of the property. This fence is made of corrugated steel and will undoubtedly be vandalized and "tagged", perhaps on a regular basis. The city highly encourages a condition requiring routine maintenance of the perimeter fence, but would prefer an adjustment of the site plan in order to set the fence further within the property and the placement of evergreen trees on the outside of the fence along Weld County Road 27 in order to provide visual breaks in the fence and to decrease vast expanses of fencing, which may help deter vandals in "tagging" the perimeter fencing. "Nene: 303-655-2059 gat: 303-655-2019 Furthermore, the City of Brighton is concerned that due to the elevation of the site, vehicular traffic traveling along US-85(which is at a higher grade) will be able to see into the site. As the plan and accompanying material set forth, the site consists of approximately forty-five acres of damaged vehicles with a four acre non-standard vehicle area for vehicles over eight feet in height. Due to the change in elevation between US-85 and the site, passersby will still be able to view materials greater than eight feet in height, especially with only an eight foot fence "screening" the outdoor storage. The City of Brighton does not feel that the "screening" as provided is adequate. Perhaps a condition should be placed on the plans such that nothing over eight feet in height will be allowed to be stored on the property? Finally, the City of Brighton is concerned with the applicant's statements regarding how the proposal is consistent with the intent of the Weld County Code - Chapter 22 (Comprehensive Plan), and is compatible with surrounding uses. The applicant states, "The proposal is consistent with the intent of the Comprehensive Plan because there are other areas of industrial zoning in the immediate vicinity of this property..." However, on page z of the Use By Special Review questionnaire, the applicant denotes that the property to the west is a lake used for waterskiing purposes. How is an approximate sixty-acre site of damaged vehicles compatible or similar to a lake? Additionally, the questionnaire states that the property adjoins a residential use on the east. Is the proposal really compatible with residential? The validity of the proposal, as set forth by the applicant, should be seriously considered. In summary, the City of Brighton is opposed to the requested amendment and would ask that it be denied; however, if the Commission finds that the conditional use is acceptable, we would ask that the following conditions be considered: ee An adjustment of the site plan in order to set the fence further within the property and the placement of evergreen trees on the outside of the fence along Weld County Road 27 in order to provide visual breaks in the fence and to decrease vast expanses of fencing, which may help deter vandals in "tagging" the perimeter fencing. If this is not acceptable, the city would ask that a requirement be added for routine maintenance of the perimeter fence; and 4. The storage of materials over eight feet in height will not be allowed. If this is not acceptable, the city would ask that a requirement be added such that additional screening measures are to be taken on the west side of the property in order to block views into the site from US-85 due to elevation changes between the roadway and the site. We have no objections to the proposal, however, we do recommend that the following conditions be part of any approval: We recommend that the following requirements be incorporated into the permit as development standards: 1. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended) shall be stored and removed for final disposal in a manner that protects against surface and groundwater contamination. 2. No permanent disposal of wastes shall be permitted at this site. This is not meant to include those wastes specifically excluded from the definition of a solid waste in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended. 3. Waste materials shall be handled, stored, and disposed in a manner that controls fugitive dust, fugitive particulate emissions, blowing debris, and other potential nuisance conditions. 4. The applicant shall operate in accordance with the approved "waste handling plan". 5. Fugitive dust and fugitive particulate emissions shall be controlled on this site. 6. This facility shall adhere to the maximum permissible noise levels allowed in the Commercial Zone as delineated in 25-12-103 C.R.S., as amended. 7. Adequate handwashing and toilet facilities shall be provided for employees and patrons of the facility. 8. Any septic system located on the property must comply with all provisions of the Weld County Code, pertaining to Individual Sewage Disposal Systems. 9. A permanent, adequate water supply shall be provided for drinking and sanitary purposes. 10.All potentially hazardous chemicals must be stored and handled in a safe manner in accordance with product labeling and in a manner that minimizes the release of hazardous air pollutants (HAP's) and volatile organic compounds (VOC's). 11. If applicable, the applicant shall obtain a stormwater discharge permit from the Colorado Department of Public Health & Environment, Water Quality Control Division. 12.If applicable, the applicant shall comply with all provisions of the Underground and Above Ground Storage Tank Regulations (7 CCR 1101-14). 13.The operation shall comply with all applicable rules and regulations of the State and Federal agencies and the Weld County Code. 2 Hello
