To the Honorable Board of County Commissioners , Greeley, Colo. Gentlemen:. Some two years since a highway was opened immedi- ately south of the east and west half section line through Section 31, Township 7 North, Range 65 West leading into the town of Eaton. This highway was constructed across the old Eaton and McClellan ditch commonly known as the Boye ditch immediately sout* of the center of said section. At this point a 25 foot concrete arch, bridge or culvert was con. structed in the ditch and, I understand, so built at the cost of Weld County and under direction of the then county commis. sioner, Elmer Rowe , but in constructing the bridge , whoever put it in placed the floor of the culvert or bridge some 1.8 feet above the bottom of the Eaton and McClellan ditch, as the same was then constructed and existed upon the ground, the bottom of said ditch being defined by a wooden box which extends from the railroad crossing some 4000 feet above the culvert to the Sugar Factory inlet some distance below the culvert. The above mentioned wooden box was constructed by August Boye, my predecessor in title , some years since in order to prevent the canal from filling with gravel and sand washed down from the upper reaches of the canal between the Sugar Factory sump and the Larimer and Weld Canal. The effect of the faulty construction of the culvert across the • road near the center of section 31 has been to cause the ditch to fill with sand and gravel for considerable distance above the culvert . This in turn has prevented the ditch through that section from properly draining the adjacent lands and the owners of the north half of the section are very bitterly complaining of the reappearance of seepage upon their lands by reason of the filling of this ditch. At the time the culvert was constructed for the high- way no person, either in authority or otherwise consulted with me or any other person interested in the ditch. On the contrary, whoever constructed the culvert tool] the whole matter in his own hands with the result above stated. jiv 1 / 00/7, 8-.3 Mad S�. , 1 County Commissioners #2. I have taken this natter up with your Highway Engineer and he advises me that he is unable to ascertain who is liable for the faulty construction of this culvert. The culvert must be removed or the bottom thereof lowered 1.8 feet within the next ten days in order that the seepage upon adjacent lands may be forthwith removed and the flow of the ditdh no longer obstructed. In as match as this culvert is said to have been placed in this canal by direction of the County Commissioners r am addressing you this communication for the purpose of not only calling the same to your attention but also for the purpose of requesting the removal of the obstruction or the lowering of the floor thereof within the time above stated. I regret to state that unless the condition is removed at that point within ten days I shall be forced to remove the obstruction my- self in order that the water in the canal may be permitted to flow to the depth established long prior to the construction of the bridge .
