RE: AUTHORIZATION FOR THE WELD COUNTY ATTORNEY TO PROCEED WITH LEGAL
ACTION AGAINST LUTHER VINCENT FOR VIOLATION OF THE WELD COUNTY CODE
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS,Luther Vincent,VI#0500205, is allegedly in violation of the Weld County Code,
and
WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has
not been corrected, and
WHEREAS, on the 14th day of March, 2006, a public hearing was held before the Board
of County Commissioners for the purpose of hearing testimony relating to said violation, and
WHEREAS, Luther Vincent, property owner, was present at said hearing, and
WHEREAS,the Board of County Commissioners deems it advisable to refer said violation
to the Weld County Attorney's Office for legal action, with an instruction for delay of action upon
such referral until May 14, 2006, to allow adequate time for the property owner to demolish and
remove the mobile homes to bring the subject property into compliance and for an inspection of
the property by the Department of Planning Services staff.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that VI #0500205 be, and hereby is, referred to the Weld County Attorney's
Office for legal action against Luther Vincent to remedy the violation of the Weld County Code, and
any other persons occupying the properties, any persons claiming an interest in the properties, and
any persons acting in active concert with the identified parties, with an instruction for delay of action
upon such referral until May 14, 2006, to allow adequate time for the property owner to demolish
and remove the mobile homes to bring the subject property into compliance.

Currently the property is in violation of Chapter 23, Article III, Division 1 of Sections 23-3-20, 23-3-30, 23-
3-30.F, Chapter 23, Article IV, Division 3 of Sections 23-4-130, 23-4-140, 23-4-160 and Chapter 29, Article
VII of Section 29-7-10 of the Weld County Code.
REMEDY
To bring the property into compliance the mobile homes shall be permitted, demolished and the debris
removed or demolished and the pieces reutilized to make another structure.
RECOMMENDATION
The Department of Planning Services recommends that this case be referred to the County Attorney's
office for immediate legal action.
CASE HISTORY
May 31, 2005 Initial complaint received.
June 1, 2005 Initial inspection completed.
June 2, 2005 Five day compliance encouragement letter issued.
June 8, 2005 Received email from property owner's attorney.
June 16, 2005 Violation letter issued. A copy was sent to the attorney.
June 22, 2006 Received a letter from the property owner stating he would no longer occupy the
RV and he would be removing it from the property.

July 8, 2005 Property inspected. The RV had been removed, but two mobile homes without
permits were moved onto the property.
August 10, 2005 Courtesy letter sent to property owner stating that the nature of the violation had
changed.
August 18, 2005 A new violation letter was issued.
August 25, 2005 Exchanged emails with the attorney discussing Mr. Vincent's options for bringing
his property into compliance.
September 13, 2005 Received an email stating that the property owner would obtain demo permit for
the mobile home and at that time his 180 day timeline has begun.
February 2, 2006 Received call from complainant. Upset because no action was being taken. I
explained on voicemail that they had until March but a hearing could be
scheduled as March 14 would be the end of their deadline.
February 2, 2006 Letter sent to property owner indicating that the violation case was scheduled
before the Board of County Commissioners.

The property referenced above remains in violation of the Weld County Code. I have scheduled a
meeting with the Board of County Commissioners on March 14, 2006 at 10:00 a.m., to consider the
violations occurring on the property. The above mentioned property remains in violation of the
following Section(s) of the Weld County Code:
Chapter 23, Article Ill, Div 1 "A(Agricultural)Zone District"
Section 23-3-20 "Uses allowed by right"
Section 23-3-30 "Accessory Uses"
Section 23-3-30.F "Mobile Homes"
Chapter 23, Article IV, Div 3 "Mobile Homes and Manufactured Structures"
Section 23-4-130 "Permit Requirements"
Section 23-4-140 "Mobile homes permitted in the A Zone District"
Section 23-4-160 "Temporary Storage"
Chapter 29, Article VII "Mobile Manufactured or Factory Built Home Permits"

To bring the property into compliance:
During an inspection conducted on January 6, 2006 it was noted that the two mobile
homes on the property have not been demolished as was discussed with your attorney
Russell Lombardy via email on September 13, 2005. To my knowledge, a demolition
permit was obtained, but efforts to comply with the county seem to have ceased.
Additionally, it appears that people are still occupying an RV which was removed from
the property back in July, 2005 in an effort to ensure us of compliance. The RV shall be
disconnected from all utilities and not utilized as a dwelling unit.
You're options on the mobile homes remain as follows:
• They can be demolished and the pieces reutilized to make 10'x 12'sheds without a
building permit. Please keep in mind if electricity is added or any other utility, a
permit would then be required. Because you are not part of a subdivision you are
not limited to the number of 10' x 12' structures you can have.
• Mobile homes can De demolished and the demolition debris removed from the
property.
Additionally, after the mobile homes have been taken apart,you have 60 days to reuse
the materials to build separate storage units or the debris will be considered a
"Noncommercial Junkyard"
This hearing will take place in our Hearing Room, located at 918 10th Street, Greeley, Colorado. It is
recommended that you or a representative be in attendance to answer any questions the Board of
County Commissioners might have about the violations.
Please also be advised that I will be taking video and/or pictures from the road or adjacent properties
the business day before or as soon as possible to the above mentioned Violation Hearing date.
The Department of Planning Services' staff will be recommending that the Board of County
Commissioners authorize the County Attorney to proceed with legal action to remedy the violation. Our
records indicate that you were made aware of the nature of the violation including the action necessary
to correct the violation, and that you were given sufficient time to remedy this violation. If you have any

I hope your long holiday weekend went well. I apologize it has taken me so long to get back to you. After
discussing this matter with staff the following was determined:
Numbers 1 and 2 are not viable options. The Weld County Code says'once a mobile home, always a mobile
home'.
However in regards to #3 you are correct. Mr. Vincent can demolish and reutilize the pieces to make 10'x 12'
sheds without a building permit. Please keep in mind if he adds electricity, or any other utility, a permit would then
be required. Because he is not part of a subdivision he is not limited to the number of 10' x 12' structures he can
have.
If he chooses to demolish the mobile homes, a demolition permit is required. Each mobile home will require a
separate permit of$21 a piece. If the demolition work can be completed within 30 days we will not require a
zoning permit. However, if you foresee this to take more than 30 days a zoning permit will be required for each
mobile home. They cost$300 a piece.
Additionally, after the mobile homes have been taken apart, Mr. Vincent has 60 days to reuse the materials to
build separate storage units or the debris will be considered a "Noncommercial Junkyard".

Thank you in advance for your assistance with this matter. As I mentioned to you earlier, Mr. Vincent believed he
was complying with all applicable regulations (however, he spoke with the Colorado Department of Revenue,
Weld County Assessors Office and Larimer County, not your agency).

As you know, Mr. Vincent currently has two trailers on his property. He paid $650 for their transportation, and has
spent considerable time removing their internal structures. One is approximately 14' x 70', the other is
approximately 10' x 50'. It is my understanding that Mr. Vincent hopes to find a way to utilize them as storage for
two or three years until his house, barn, etc. are built on the property.
It is also my understanding that you have stated that he may only keep one trailer for storage, and then only for a
period of six months. Further, I understand that Mr. Vincent has only 30 days from August 18 to comply. I want
to assure you that once we understand what our options are (hopefully through your reply to this email), we will
take every step to fully comply within that time period.
I am looking to your for any guidance as to how Mr. Vincent may utilize the trailers for storage while complying
with your code. Specifically:
1) May he recharacterize the"trailers" as other structures for which he may acquire a permanent permit? If so,
how?
2) Is there any way he can remove the wheels and attach these structures to the ground in order to receive a
permit? He has no interest in having them permitted as residences.
3) Mr. Vincent is under the impression that he may have as many 10' x 12' storage structures on his property as
he needs. Is this correct? If so, will it be possible for Mr. Vincent to use the trailers for materials to make several
additionally 10' x 12' structures? If this is an option, are there any further zoning requirements I should make Mr.
Vincent aware of for such structures (e.g., do they need to be a certain amount of feet apart; is there a restriction
as to how many of these structures may be on each acre (or each lot), etc.).
4) If there is no solution based on the above suggestions, and the trailers must be removed from the property,
can Mr. Vincent demolish them (he has significant construction experience)? If so, what would be the cost of the
permits? Further, can he store and reuse the usable supplies (such as the 1"x6"s that make up the internal
structure of the trailers)?
I think you can see where my conversations are focused with Mr. Vincent. If there is any way he can use the
trailers or the materials that make up the trailers, he would like to. Alternatively, he would like any suggestion that
will save him from having to pay for professional removal.
Your thoughts (and those of the participants in your staff meeting) are honestly appreciated. I look forward to

I hope this email finds you well. I am writing again on behalf of Luther Vincent. As you know, he is non-compliant
on a number of issues regarding the two mobile homes on his property. As was the case with respect to the RV
on his property last month, he is eager to bring his property back into compliance (if you remember, he moved the
RV off his property within days of our conversation).
Based on information received by other county and state agencies, Mr. Vincent sincerely believed the mobile
homes would be compliant if placed on his property.
I want to explore several alternatives with you for making these structures compliant. Alternatively, I would like to
discuss the needed permits for demolishing these structures. However, I do not have the time to draft a more
detailed email this evening. Please be on the lookout for another email from me within a day or two with a list of
suggestions /questions. I will ask you to either reply by email, or give me a time when I may reach you by phone.

Thank you in advance for your assistance with this matter. As I mentioned to you earlier, Mr. Vincent believed he
was complying with all applicable regulations (however, he spoke with the Colorado Department of Revenue,
Weld County Assessors Office and Larimer County, not your agency).
As you know, Mr. Vincent currently has two trailers on his property. He paid $650 for their transportation, and has
spent considerable time removing their internal structures. One is approximately 14' x 70', the other is
approximately 10'x 50'. It is my understanding that Mr. Vincent hopes to find a way to utilize them as storage for
two or three years until his house, barn, etc. are built on the property.
It is also my understanding that you have stated that he may only keep one trailer for storage, and then only for a
period of six months. Further, I understand that Mr. Vincent has only 30 days from August 18 to comply. I want
to assure you that once we understand what our options are (hopefully through your reply to this email), we will
take every step to fully comply within that time period.
I am looking to your for any guidance as to how Mr. Vincent may utilize the trailers for storage while complying
with your code. Specifically:
1) May he recharacterize the "trailers" as other structures for which he may acquire a permanent permit? If so,
how?
2) Is there any way he can remove the wheels and attach these structures to the ground in order to receive a
permit? He has no interest in having them permitted as residences.
3) Mr. Vincent is under the impression that he may have as many 10' x 12' storage structures on his property as
he needs. Is this correct? If so, will it be possible for Mr. Vincent to use the trailers for materials to make several
additionally 10' x 12' structures? If this is an option, are there any further zoning requirements I should make Mr.
Vincent aware of for such structures (e.g., do they need to be a certain amount of feet apart; is there a restriction
as to how many of these structures may be on each acre (or each lot), etc.).
4) If there is no solution based on the above suggestions, and the trailers must be removed from the property,
can Mr. Vincent demolish them (he has significant construction experience)? If so, what would be the cost of the
permits? Further, can he store and reuse the usable supplies (such as the 1"x6"s that make up the internal
structure of the trailers)?
I think you can see where my conversations are focused with Mr. Vincent. If there is any way he can use the

trailers or the materials that make up the trailers, he would like to. Alternatively, he would like any suggestion that
will save him from having to pay for professional removal.

During my last inspection I noted that you have brought in 2(two)mobile homes without first
obtaining the necessary building and zoning permits. The Weld County Code no longer
allows mobile homes to be utilized as permanent storage units. Therefore at least 1 (one)of
the mobile homes shall be removed from the property. A Zoning Permit and Building Permit
application could be submitted for the remaining mobile home to be temporarily stored on the
site; otherwise, it shall be removed as well. If approved, the mobile home could remain
situated on the site for a period of 6 months. If your intent is to place them as residences, I
would recommend that you speak to one of our "On-Call" Planners. To better serve the
public, we have two locations open. Our North office is located at 918 10th Street, Greeley,
Colorado. At our North„trice, an"On-Call"Planner is available, Monociy thru Thursday from
7:30 a.m. - 11:30 a.m. Our Southwest office is located at 4209 CR 24.5, Longmont,
Colorado. At our Southwest office, an "On-Call"Planner is available Monday thru Thursday
from 12:30 P.M. - 4:30 P.M. You do not need to schedule an appointment, because

I received your letter dated June 16, 2005. My attorney, Russell Lombardy, informed me
that he spoke with you regarding the potential zoning violation caused by me spending
the night on my property. It is my honest intent to be a good neighbor. Mr. Lombardy
tells me that you need this letter from me stating that I will no longer spend the night in
the recreational vehicle.
I will not spend the night in the RV on the property. Additionally, I am moving the RV
off the property.
Please know that we are working hard to keep our property in great condition. Because
my wife is handicapped, the recreational vehicle on our property provided a place for her
to rest when she became tired. We have, in the past, also used it fui an occasional
overnight stay due to our age when we were working on the property and the day became
late(our home in Longmont is 75 miles away). By the time your receive this letter, the
RV will be moved off the property and will no longer be used for overnight stays.

RECREATIONAL VEHICLE: A transportation structure or self-propelled vehicle with or without
flexible, removable or collapsible walls and partitions designed to be used as a dwelling for
travel, recreation or vacation uses. The term recreational vehicle shall include: motor home,
camper bus and travel trailer, but shall not include pickup trucks with camper shells that do not
extend above the ca of the truck. For the purpose of this Code, a recreational vehicle shall be
subject to all requirements and restrictions fro mobile homes as provided in this Chapter when its
placement is intended for nontransient residency. A recreational vehicle shall not be used for
temporary storage, temporary accessory farm use, temporary accessory use during a medical
hardship, temporary accessory use as an office, or as a principal dwelling unit..
To bring your property into compliance with the Weld County Code:
The camper/trailer located on the property shall remain unoccupied and disconnected from all
utilities. I spoke with your attorney, Russell Lombardy, and he notified me of your intentions to
move a mobile home onto the property. There are some allowances with the Code to allow
temporary occupancy in a camper/trailer during construction, but certain permits need to be
obtained and there are regulations on this. Until then I will need a letter stating that you will not
be occupying the camper/trailer, all utilities will remain disconnected at all times and I will need
proof of current registration. When this letter is received I will be auie to close your case;
otherwise, a hearing will be scheduled before the Board of County Commissioners
It is the intention of this office to assist and cooperate with you without imposing undue hardships; however,

Regarding the violations reported by Randy and Mary James:
Ann and I just spoke with Mr. James and told him the status of the following two violations:
A demo permit was obtained for the mobile home at 49590 CR 96 on 10/26/04. There has been no response so
letters were mailed and site inspections performed to verify the mobile home is still on site. Mr. Gonzalez, the
owner, is scheduled for the violation hearing on 06/14. We have received the return receipt card that
acknowledges he received the letter.
A building permit was obtained for the "storage shed" on the property at 45392 CR 95. Roger Vigil did an
inspection in February and wrote several corrections so the permit is now valid until 08/23/05. Roger has taken
the lead on this one.
Mr. James gave us the information on the latest complaint so we will contact the property owners.
Mr. James stated it has taken the County four years and there seems to be no progress. Our copies of their
letters are dated February 23, 2004. He says he had reported it to the Game Warden a year before that but, to
our knowledge, the information was not passed on to this department.
