HomeMy WebLinkAbout800439.tiff RESOLUTION RE: APPROVAL OF AGREEMENTS AND PLANS CONCERNING SPECIAL USE PERMIT FOR OPEN CUT MINING PERMIT - ADOLPH COORS COMPANY. WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, on June 20, 1979 , the Board of County Commissioners of Weld County, Colorado approved a Special Use Permit for an open cut mining permit for Adolph Coors Company, and WHEREAS , on December 19 , 1979 , the Board of County Commis- sioners adopted a resolution concerning said Special Use Permit, a portion of which states as follows : "BE IT FURTHER RESOLVED by the Board that the agreements and plans shall be assimi- lated when final corrections have been completed in such a manner to be acted on by the Board no later than January 30 , 1980 . The aforementioned agreements and plans will be, by reference, made a part of this action. " WHEREAS, the Department of Planning Services has presented such documents , as mentioned above, to the Board of County Com- missioners for approval , and WHEREAS, the Board deems it advisable to approve said docu- ments . NOW, THEREFORE, BE IT RESOLVED by the Board of County Com- missioners that the documents concerning the Special Use Permit for Adolph Coors Company, as mentioned herein, be and hereby are, approved. Phillips, Vice President, Energy Division, Adolph Coors Company. That letter, attached narative, plans, and specifications supplied by Coors have been reviewed by the Engineering Department and are acceptable. There are two items that have not been finalized. Right-of-way from Station 185+95 to Station 200+00 has not been acquired. The Engineering Department and Coors are proceeding together on that matter. Also, soils information from Chen and Associates, Inc., was not completed at the time of final submittal. The amount of base course will be determined by the final soils report. Although the right-of-way and base items are not settled they are addressed in Mr. Phillips' letter. I think the S.U.P. could get final approval at this time. PHILLIPS Vice President January 22, 1980 Energy Mr. Norman Carlson, Chairman Board of Commissioners, Weld County 915 Tenth Street Greeley, Colorado 80631 Re: Public Roadway to Keenesburg Mine Site Dear Commissioner Carlson: At work sessions earlier this year, Coors agreed and we reiterate now, that we will upgrade Weld County Road No. 18 from the south quarter corner of Section 23, Township 2 North, Range 64 West easterly to County Road 59, and Weld County Road No. 59 north from County Road No. 18 to the south line of Sections 11 and 12, Township 2 North, Range 64 West under the following terms and conditions: 1. The roadway will be upgraded according to the attached specifications and Coors drawing No. KM-4-1, KM-4-10, KM-4-11, and KM-4-12. 2. The County will furnish right-of-way for the roadway improvements to the north line of Sections 11 and 12, Township 2 North, Range 64 West with the exception of the curve at the intersection of County Road No. 18 and 59. 3. According to a letter of understanding of December 12, 1979 between Coors and Mr. and Mrs. Andreas Arnusch, right-of-way for improvements to the above mentioned curve will be granted to Weld County by the Arnusch's. Coors will construct a new driveway on the Arnusch property in conside- ration of the right-of-way grant. 4. Weld County will permit Coors to use gravel from a County pit for road- base on the public portion of the roadway. Coors will be responsible for digging, crushing and hauling of the gravel. 5. Coors agrees to share costs of applying dust suppressants to the portion of roadway to be upgraded until asphalt surfacing can be accomplished, which will be as soon as weather permits after the hauling of coal begins from the mine site. After inspection of the completed roadway improvements, the Weld County Engineering Manager will furnish Coors a letter accepting all portions of the public roadway for future maintenance. We find the above terms and conditions satisfactory and request the Board to pass a final resolution accepting the terms as a final agreement on our Special Use Permit for an open cut mining operation granted by the Board on June 20, 1979. Phillips Vice-President Energy Division, Dept. #200 AP:kr Enclosure ADOPH COORS COMPANY Keenesburg Mine Site Project Specifications of Roadway Upgrading Location: Weld County Road No. 18 from the south quarter corner of Section 23, Town- ship 2 North, Range 64 West easterly to County Road 59 and Weld County Road No. 59 north from County Road 18 to the south line of Sections 11 and 12, Township 2 North, Range 64 West. Improvements : The road improvement designs are based upon the January 14 soils report by Chen&Associates, Incorporated and an anticipated traffic load of approximately 70 trucks per day with maximum 18 kip axle loads per lane. The January 14 report is not yet complete and final base course design will be based on the final soils report. The sand materials fall into the A.A.S.H.T.O. classification A-3 with a group index of 0 and were located between stations 175+00 to station 200+00. The clay soils located between Interstate 76 and station 175+00 classify as A-6 with group indexes varying from 9 to 11 . The design C.B.R. of the silty and sandy clays when they are compacted to 98% standard proctor density should be 4. The typical roadway section of County Road 18 and 59 from Interstate 76 to station 84+00 and station 105+55 to station 200+00 should consist of 24' width of 4" asphaltic concrete surface course, Colorado State High- way Department specification Grade "EX" placed on top of 10" of high quality base course, Colorado State Highway Department specification Class VI . The shoulders in these areas will be a width of 4' . The Section of County Road 59 located between station 84+00 and station 105+55 shall be to the same Colorado State Highway Department specifi- cations, but the paved roadway section will be 30' wide of 4" asphaltic concrete surface course. Prior to placing the base course from Interstate 76 to station 200+00 , the entire subgrade area shall be scarified to a depth of 6" , moistened to near optimum moisture ,content and compacted to 98% standard proctor density. The collection and diversion of surface drainage away from the pavement sections have been studied, and drainage structures and ditches were designed under State of Colorado Highway Department specifications . The County Road 18 and 59 roadway elevation will follow closely existing elevations between Interstate 76 to station 99+62 and between station 106+73 to station 200+00. Between station 99+62 to station 106+73 the roadway will be relocated to the west on a roadway centerline radius of 572.96' . Some grade work will be done in this area, but all the construction will be done in accordance to the Colorado Highway Department specifications.
