Upon review of my case files and computer, an open Violation (VI-0500192)was noted. The Violation was
initiated due to the operation of a"kennel/doggy day care"without the necessary permits. This violation has
not yet been presented to the Board of County Commissioners through the Violation Hearing process. Please
be advised that this violation was initiated through a drive by and not by a complaint from any surrounding
property owners.
This Use by Special Review application, if approved, will bring the property into compliance. If denied, the
number of dogs shall be reduced not to exceed 4 (four) per legal lot and all commercial activities shall be
removed; otherwise, the Violation case will proceed accordingly.

USR-1525
1. A building permit shall be obtained for the change of use of the existing 1800 square foot pole barn to a
(Kennel) B occupancy and the change of use of the milking room to the (office) B occupancy. A building
permit will also be required for the 120 square foot Victorian House.
2. A plan review is required for each building for which a building permit is required. Two complete sets of
plans are required when applying for each permit. Included should be a floor plan of each building.
3. Buildings shall conform to the requirements of the codes adopted by Weld County at the time of permit
application. Current adopted codes include the 2003 International Residential Code; 2003 International
Building Code; 2003 International Mechanical Code; 2003 International Plumbing Code; 2003 International
Fuel Gas Code; 2002 National Electrical Code and Chapter 29 of the Weld County Code.
4. The doggy dorm and the reception and office area shall be accessible to persons with disabilities.At least
one bathroom accessible to persons with disabilities shall be provided. Separate facilities for each sex shall
be provided when the number of employees and customer exceeds 15.
5. Fire resistance of walls and openings, construction requirements, maximum building height and allowable
areas will be reviewed at the plan review. Setback and offset distances shall be determined by the Zoning
Ordinance.
6. Building height shall be measured in accordance with the 2003 International Building Code for the purpose
of determining the maximum building size and height for various uses and types of construction and to
determine compliance with the Bulk Requirements from Chapter 23 of the Weld County Code. Building height
shall be measured in accordance with Chapter 23 of the Weld County Code in order to determine compliance
with offset and setback requirements. When measuring buildings to determine offset and setback
requirements, buildings are measured to the farthest projection from the building. Property lines shall be
clearly identified and all property pins shall be staked prior to the first site inspection.

purview of the Use by Special Review Standards, Weld County Code, Chapter 23, Article II, Division 4, Section
23. Our comments and requirements are as follows:
COMMENTS:
Weld County Road Classification Plan (FHU): (June 2002)
WCR 5 is a local gravel road and requires a 60-foot right-of-way at full build out. The applicant shall verify the
existing right-of-way and the documents creating the right-of-way. This road is maintained by Weld County. If
the right-of-way cannot be verified, it shall be dedicated.
.<EQUIREMENTS:
Off-street parking spaces including the access drive shall be surfaced with gravel, asphalt, concrete or the
equivalent and shall be graded to prevent drainage problems.
Each parking space shall be equipped with wheel guards or curb blocks when necessary to prevent vehicles
from extending beyond the boundary of the space and from coming into contact with other vehicles, walls,
fences or planting.
There will be staging or parking on WCR 5. Utilize the on-site parking only.
Storm Water Drainage:
The historical flow patterns and run-off amounts will be maintained on site in such a manner that it will
reasonably preserve the natural character of the area and prevent property damage of the type generally
attributed to run-off rate and velocity increases, diversions, concentration and/or unplanned ponding of storm
run-off.
The applicant must take into consideration storm water capture/quantity and provide accordingly for best
management practices.

Environmental Health Services has reviewed this proposal for a Dog boarding and
doggie day car facility (80 dogs). We have no objections to the proposal, however, we
do recommend that the following conditions be part of any approval:
We recommend that the following requirements be met prior to allowing the plat to be
recorded:
1. The applicant shall submit a dust abatement plan for review and approval, to the
Environmental Health Services, Weld County Department of Public Health &
Environment.
2. The Environmental Health Services Division (EHS) has discovered that the
"doggy dorm" building has restroom facilities. EHS file/record review indicates
that the "doggy dorm" building does not have a septic system permit . It is
understood that the sewage from the "doggy dorm" building is being diverted to
the existing septic system serving the home. The permit on file for the home is
for the residence only. Therefore, the septic system serving the home and now
"doggy dorm" shall be reviewed by a Colorado Registered Professional Engineer.
The review shall consist of observation of the system and a technical review
describing the systems ability to handle the proposed hydraulic load. The review
shall be submitted to the Environmental Health Services Division of the Weld
County Department of Public Health and Environment. In the event the system is
found to be inadequately sized or constructed the system shall be brought into
compliance with current Regulations.
3. The applicant shall submit a manure management plan to the Weld County
Department of Public Health and Environment for review and approval.
4. The applicant shall provide written evidence to the Weld County Department of
Public Health and Environment that the applicant has contacted the Colorado
Department of Agriculture (CDA), Division of Animal Industry. This contact shall
determine if a license under the Pet Animal Care Facilities Act (PACFA), as
defined under C.R.S. 35-80-101 through 117. C.R.S. is required, or provide
evidence that the applicant is not subject to the PACFA requirements.
5. The applicant shall submit a waste handling plan, for approval, to the
Environmental Health Services Division of the Weld County Department of Public
Health & Environment. The plan shall include at a minimum, the following:
1) A list of wastes which are expected to be generated on site (this should
include expected volumes and types of waste generated).
2) A list of the type and volume of chemicals expected to be stored on site.
3) The waste handler and facility where the waste will be disposed (including
the facility name, address, and phone number).
We recommend that the following requirements be incorporated into the permit as
development standards:
j 1. Animal and feed wastes, bedding, debris and other organic wastes shall be
disposed of so that vermin infestation, odors, disease hazards, and nuisances
are minimized. Such wastes shall be removed at least weekly from the facility
and disposed by a commercial hauler.
2. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and
Facilities Act, 30-20-100.5, C.R.S., as amended) shall be stored and removed for
final disposal in a manner that protects against surface and groundwater
contamination.
3. No permanent disposal of wastes shall be permitted at this site. This is not
meant to include those wastes specifically excluded from the definition of a solid
waste in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S.,
as amended.
4. Waste materials shall be handled, stored, and disposed in a manner that controls
fugitive dust, fugitive particulate emissions, blowing debris, and other potential
nuisance conditions.
5. The facility shall be operated in a manner to control flies.
6. The operation shall comply with all applicable rules and regulations of the
Colorado Department of Agriculture (CDA), Division of Animal Industry.

7. The applicant shall operate in accordance with the approved waste handling
plan.
8. The applicant shall operate in accordance with the approved manure handling
plan.
9. Fugitive dust and fugitive particulate emissions shall be controlled on this site.
The facility shall be operated in accordance with the approved dust abatement
plan at all times.
10.This facility shall adhere to the maximum permissible noise levels allowed in the
Commercial Zone as delineated in 25-12-103 C.R.S., as amended.
11.Adequate handwashing and toilet facilities shall be provided for employees and
patrons of the facility.
12.Any septic system located on the property must comply with all provisions of the
Weld County Code, pertaining to Individual Sewage Disposal Systems.
13.The facility shall utilize the existing public water supply. (Left Hand Water District)
14.The operation shall comply with all applicable rules and regulations of the State
and Federal agencies and the Weld County Code.

Dear Ms. Hatch:
I have reviewed the submitted material pertaining to the Site Development Plan and
Special Review Permit for a kennel, including doggy day care service at 7019 Weld
County Road 5 (Case Number: USR-1525, Case Name: Lowry). The Fire District does
not object to this request if the requirements of the District can be met. Based on my
review, I have the following comments and stipulations:
• Since the kennel operation will be using existing buildings, and the use as a kennel
will be similar to previous farming operations in the buildings, it will not be
necessary for the required fire flow to be provided to the existing buildings. However,
should additional buildings be constructed on the site, or moved onto the site, then the
required fire flow will have to be provided for those new buildings. The required fire
flow will be determined by the total floor area and type of construction, as defined by
the Uniform Building Code. However it will not be less than 1,500 gallons per minute
at 20 pounds per square inch. This will require the installation of one or more fire
hydrants on the site. There is a question whether that required fire flow is available to
the site.
• Provide access to the site that meets the standards of the Fire District. Fire
Department access roads must be 20 feet in width, have a clear height of 13 feet, 6
inches and must be capable of supporting an imposed load of 75,000 pounds. The
existing roads must be modified to must meet these standards.
• If not already provided, approved address numbers shall be placed on the residence or
on a freestanding sign in such a position to be plainly visible and legible from the
street fronting the property. Address numbers or letters shall contrast with their
background.

This letter is written with regard to the Site Development Plan and Special Review Permit
for a kennel, including doggy day care service at 7019 Weld County Road 5 (Case
Number: USR-1525, Case Name: Lowry).
I have completed a site visit of the facility and have the following revised Fire District
comments at this time:
• Since the kennel operation will be using existing buildings, and the use as a kennel
will be similar to previous farming operations in the buildings, it will not be
necessary for the required fire flow to be provided to the existing buildings. However,
should additional buildings be constructed on the site, or moved onto the site, then the
required fire flow will have to be provided for those new buildings. The required fire
flow will be determined by the total floor area and type of construction, as defined by
the Uniform Building Code. However it will not be less than 1,500 gallons per minute
at 20 pounds per square inch. This will require the installation of one or more fire
hydrants on the site. There is a question whether that required fire flow is available to
the site.
• The current access provides adequate access to the facility as long as trees are
trimmed to provide a clear height of 13 feet, 6 inches and an adequate all-weather
road surface is provided.
• A final inspection of the facility by the Fire District is requested before final approval
of the special use is approved.
