HomeMy WebLinkAbout20061620.tiff RESOLUTION RE: ACTION OF THE BOARD OF COMMISSIONERS REGARDING VIOLATION VI#0600029 AGAINST UNION PACIFIC RAILROAD COMPANY, ATM SALES, AND DARREL AND CHRISTINA FELTON FOR VIOLATION OF THE WELD COUNTY CODE WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS,Union Pacific Railroad Company,ATM Sales, and Darrel and Christina Felton, VI #0600029, are allegedly in violation of the Weld County Code, and WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has not been corrected, and WHEREAS, on the 9th day of May, 2006, a public hearing was held before the Board of County Commissioners for the purpose of hearing testimony relating to said violation, at which time this matter was continued to June 20, 2006, to allow time for the property owners to submit a Use by Special Review application, and WHEREAS, on the 20th day of June, 2006, a public hearing was held before the Board of County Commissioners for the purpose of hearing testimony relating to said violation, and WHEREAS,Union Pacific Railroad Company,ATM Sales, and Darrel and Christina Felton were not present or represented at said hearing, although all parties were notified of said hearing by Department of Planning Services staff, and WHEREAS, the Board of County Commissioners deems it advisable to refer said violation back to the Department of Planning Services, due to the property owners submitting a Use by Special Review application.
