The site is located south of and adjacent to State Highway 52 and approximately 1/4 mile east of County Road 3. The applicant is requesting that the original collateral in the amount of amount of three hundred sixty two thousand, four hundred and twenty six dollars and fifty five cents ($362,426.55) for on- site improvements approved by the Board of County Commissioners on August 15, 2005 be released. The Department of Planning Services has reviewed the site and finds that some of the improvements have not been completed. The items that still need to be completed include the monument sign with surrounding landscaping and additional landscaping per the final plat recorded on August 24, 2005. The Department of Planning Services is requesting that eight thousand, eight hundred and twenty six dollars ($8826.00) be retained for the remaining items to be completed on site. Shrubs, perennials, and grass = $3326.00 Monument sign = $5500.00 The Department of Public Works is requesting that 20% of the pavement item be retained (15% to be held for the pavement warranty and 5% for minor pavement repairs scheduled for the summer of 2006). The Department of Public Works is requesting that eighteen thousand two hundred and forty two dollars and sixty cents ($18,242.60) be retained. After review of the site Department of Public Works and the Department of Planning Services is in support of a partial vacation in the amount of three hundred and thirty five thousand three hundred and fifty seven dollars and ninety five cents ($335,357.95). The Department of Planning Services and the Department of Public Work is requesting that a total of twenty seven thousand and sixty eight dollars and sixty cents (27,068.60) be retained. The applicant is requesting for a release of collateral in the amount of three hundred and forty eight thousand and seven hundred and forty four dollars and sixty cents ($348,744.60) at this time (the County retaining thirteen thousand and sixty hundred and eighty one dollars and ninety five cents for the warranty collateral. The applicant has submitted the attached email dated March 3, 2006 stating that their attorney has advised the applicant the per the wording of the release of collateral terms in the improvements agreement, in his opinion a person would reasonably conclude that "substantial Compliance" for completion of the project has been met. We have a few deciduous trees and low shrubs that will be put in, but we will wait until later in the spring to do so. If we planted them now, they would just die. The signs (stop/street/etc.) are in. The monument has been carved and paid for, but I won't actually put it in the ground until I plant the shrubs that go around it. I received a copy from Peter that Public Works has signed off. My attorney has advised me that, per the wording of the release of collateral terms in the improvements agreement, in his opinion a person would reasonably conclude that"Substantial Compliance" for completion of the project has been met. The purpose of the agreement is to insure that I complete the project, which I have. I believe there is no longer any reason for the County to continue to hold the $362,426.55 in cash that I provided as collateral and would ask that you proceed. I'm assuming this would apply for the water and sewer, since we do the construction and the appropriate entity "accepts" the construction. This would not apply to gas, electrical and phone since each of these entities does their own construction. None of them provide letters since there's nothing for them to"accept"from me as the developer since they did the work. On Highland Farms we are doing individual septic systems, so no letter from a sanitation district is required. I have the acceptance letter from Left Hand for the water. Can you confirm this is what I need? A fire flow test was conducted on January 27. 2006. The flow test indicates that there is approximately 2,500 gallons per minute available at 20 pounds per square inch. This fire flow will provide adequate fire protection for homes up to 9,400 gross square feet in size. The Fire District still requests that streets be marked with permanent signs showing the street name. This had not been completed at the time we conducted the flow test last Friday. The applicant still needs to provide to the Fire District an eight and one half-inch by eleven-inch map of the subdivision showing the street configuration, street names, hydrant locations and addresses of the lots if available.
