(Andy) Scott Dianne Petermann 5451 WCR 16% Longmont, CO 80504 (303) 833 5962 RE: Case#USR-1523 Weld County Planning Commission 1 his letter concerns the upcoming hearing regarding the David& Beverly Heussmann Special Use Permit application for the property located on WCR 16%, Longmont, CO, in southwest Weld county. We own the property directly east and adjacent to Lot 26 in Dream Acres which is owned by the Heussmanns. We object to the potential approval of .A.,;,) portion of the Special Use Permit for a concrete forming business site and kennel of 1000 birds. History - Our land was 2 lots before we moved into our home in December, 1998. It had uts for a road. The vacant property to the west of us, owned by Dave Heussmann,had ,ine concrete business equipment parked on it which was operated by Aristocrat, a ,4.ucrete forming business. It was no big deal. We did have to build a road to our operty, from the entrance of Tim Rhoads' driveway across all of Blocks 24 and 25 and • toss the front of our home. Weld County would not put the road in to our property. e would like to bring attention to this road because the portion that is in front of the I ussmann's property is in very bad shape due to all of the heavy trucks carrying • ;:crete forms over the road, to the easement, and over our water line. The Aristocrat c nerete company is owned and operated by Wade Heussmann, Dave Heussmann's son. \:,,tocrat(Heussmann) Junk Yard - Over the years the condition of the property has ;:riorated and, in our view, has become a junk yard. Also, Wade's fuel tank is right .t to our fence, about 60 ft. from our home. This spring,we started to photograph the d and its contents. Often the concrete business equipment would cover the right-away • ;,ss the road from the Heussmann's and up against the Rhoads' fence. This spring ode told Andy that he was going to bring in some loads of old asphalt blacktop to put the road in front of the"junk yard". He also said that the traffic would eventually tid it up. Andy said no to the idea, but the black-top pieces were dumped anyway. l.idly of our friends and visitors say it looks like a junk yard. Would you like to sit on .:r front deck and see it or drive by it daily? We have enclosed some photographs. Pheasants and Chuckers -Part of the Heussmann property became a pheasant and ;;;maker pen when Wade Heussmann's daughter started raising about 10 baby ducks. He ti It a shed for them, which we did not mind. Nothing was said about any permits. After !lie ducks left, he told us that he was going to raise pheasants and chuckers in the shed. I he shed is about 60 ft. from our bedroom window. i�uut a year later, he started to build a large pen for the pheasants. We were both upset hen we saw how large it was. The pen is built very close to the irrigation ditch road hich is on its north side. The easement measures less than 4 ft. from the ditch road. All .nether the building is about 112 ft. long. The sides are covered with galvanized steel. Ilk,' pheasant shed has cement floors and walls. Wade Heussmann would raise the 2,000 so baby pheasants and chuckers in his garage in Firestone until they were big enough put in the pens near our home. ut that time, Dianne started to get allergies and sinus problems. They were so severe n,rt she couldn't lie down during the day or night because of the drainage. Our bedroom .\;ndow is approximately 60 ft. from the first pen. Dianne's doctor indicated that to Improve her condition-"environmental control measures (should) decrease contact to r itants and allergies in the air and thereby, decrease respiratory symptoms." Her condition was caused by"irritants (which) are substances that trigger symptoms by rritating the nose and airways and keeping the respiratory tissues constantly inflamed." I h. primary causes"of the irritants are road dust and strong odors." The dust, feathers, ihi volume of droppings from all of the birds have adversely affected Dianne's health. " !,d smell is very bad especially after a rain followed by hot weather. Other neighbors complained about the smell including Tim Rhoads who lives across Road 16% and ,"ighbor 2 lots away from the pens—about 200 ft. Dianne figured out the cause of her nus problem about late spring when Wade removed all of the birds. Within one week, ,out 80%of her problems went away. Then it all started up again when 4,000+/-birds rc brought in. We are also wondering about the potential for the Asian bird flu or scr strains that can be transmitted from birds to humans. We've enclosed photos of I, id birds in barrels that were left to rot for about a month. i ag in our home is like living next to a turkey farm. Andy grew up on a farm in Weld :nty and farmed for many years. The standard distance between any poultry building the main farm house had to be 250 feet or more to maintain proper health conditions is humans. This large bird operation is 60 ft. from our home today. The odor, the ;pings, the flies, mice, and possibly rats are health hazards next to which we would er choose to live. Please see photo taken from our front porch. 'nine has counted about 10 mice running in and out of the Heussmann's grain storage .I in one afternoon while working in the garden. She no longer spends time on the t side of our home due to the smell. Wade has told us he puts D-Con in the grain rage shed to poison the mice, so we have had to check over the yard for dead mice to . ent our dogs from eating them. We now have had to use D-Con under our home for mice and have used a lot during the past year. Our veterinarian has warned us that our dogs could be harmed from eating poisoned mice. ;ers are now a problem too. Our air conditioning unit(swamp cooler) is on the west of our home,but we aren't able to use it because so many feathers constantly cover rates, as well as, our yard, our front&back decks, and even our garage. The birds tap their beaks on the steel sides of their pen. When 4,000 birds start tapping at AM,the noise in our bedroom prevents any further rest. The lack of an easement between our properties leaves us within such close proximity to the concrete and bird activities that we feel encroached upon. The concrete and bird operations are not compatible with the neighborhood. The general quality of life&property values for ourselves and our neighbors has been diminished due to these activities. •e consider these concerns when evaluating the request for a Special Use Permit by Heussmann for this property. It also has trash and junk piled up quite often. The weeds inside and outside of the pen are taller than a human being. I can't believe that the county would allow such a facility in area such as this. I feel badly for all the neighbors that live next to this facility and have to look at it and put up with the odor and there could be possible health risk because of the way it has been maintained. Scott (Andy), and my sister in law Dianne Petermann who have resided at 5451 C.R. 16 'A in rural Weld County since December 15, 1998, have asked me to write this letter for them regarding Aristicate Pheasant and Chuckers that is next to their property. This land owner has had built a very large pen to hold up to 4000 pheasant and chuckers . Since my brother and his wife moved to their home I always felt that the Aristicate property had a very unkempt appearance to it but it was tolerable, but, this latest business is not only unsightly but also very unhealthy. The pheasant coop is only about 60 ft. from their bedroom window and is most unpleasant smelling especially in the heat of summer, and after it rains the odor is even worse. they have feathers in there yard, and dust stirred up, they have had a large increase in mice population and possibly rats. This has been very detrimental to my sister in laws (Dianne Petermann) health with allergies and respiratory symptoms etc. she has been on medication and her Dr. has stated that most of it is caused by dust and strong odors. I can see if my brother and sister in law had moved their and this had already been built, but to come in after they had houses all close and be able to erect this kind of business is and very unhealthy and disrespectful to any surrounding neighbors , whether it be a health matter or property value problem. -- Myself, my husband Larry York and My father George Scott SR. visit Dianne and Andy regularly and they have a very neat and attractive home and they take great pride in there home and property I hope you will take this into consideration.
