HomeMy WebLinkAbout20061622 HEARING CERTIFICATION DOCKET NO. 2006-33 RE: SITE SPECIFIC DEVELOPMENT PLAN AND USE BY SPECIAL REVIEW PERMIT#1542 FOR MINERAL RESOURCE DEVELOPMENT FACILITIES,INCLUDING AN OIL AND GAS SUPPORT AND SERVICE FACILITY (STORAGE OF OILFIELD EQUIPMENT), IN THE A (AGRICULTURAL) ZONE DISTRICT - LANCE AND CHERYL MESSINGER A public hearing was conducted on May 24, 2006, at 10:00 a.m., with the following present: Commissioner M. J. Geile, Chair Commissioner David E. Long, Pro-Tern Commissioner William H. Jerke - EXCUSED Commissioner Robert D. Masden Commissioner Glenn Vaad Also present: Acting Clerk to the Board, Esther Gesick Assistant County Attorney, Cyndy Giauque Planning Department representative, Michelle Martin Health Department representative, Char Davis Public Works representative, Donald Carroll The following business was transacted: I hereby certify that pursuant to a notice dated May 5, 2006, and duly published May 10, 2006, in the Fort Lupton Press, a public hearing was conducted to consider the request of Lance and Cheryl Messinger for a Site Specific Development Plan and Use by Special Review Permit #1542 for Mineral Resource Development Facilities, including an Oil and Gas Support and Service Facility (storage of oilfield equipment), in the A (Agricultural) Zone District. Cyndy Giauque, Assistant County Attorney, made this a matter of record, and advised Lance Messinger, applicant, that he has the option of continuing this matter to a date when the full Board will be present. However, if he decides to proceed today, it will require three affirmative votes, or in the case of a tie vote, Commissioner Jerke will listen to the record and make the determining vote. Mr. Messinger indicated he would like to proceed today. Michelle Martin, Department of Planning Services, presented a brief summary of the proposal, entered the favorable recommendation of the Planning Commission into the record as written, and gave a brief description of the location of the site and surrounding land uses. She stated the site is currently fenced with a green mesh fabric, and staff recommends replacing the fence with plastic slats, and the applicant has agreed. She further stated the applicant is requesting two signs which meet the Commercial Zone sign requirements. In response to Commissioner Geile, Ms. Martin stated Condition of Approval#1.B.13 needs to remain until the applicant has completed the fencing project, as agreed upon. Responding to Commissioner Masden, Ms. Martin stated the applicant is currently operating from the site; however, since the property was split through the Recorded Exemption process, the original Use by Special Review Permit is being amended to include only Lot B, and the applicant has applied for this permit on Lot A. p 2006-1622 (k1 . Y t; SC) /1-/ PL1839 C6_r4.Z_U 4; HEARING CERTIFICATION - LANCE AND CHERYL MESSINGER (USR #1542) PAGE 2 Char Davis, Department of Public Health and Environment, stated the site will be serviced with a commercial well and a permitted septic system for the metal building/shop,and staff is requesting a Waste Handling Plan. Donald Carroll, Department of Public Works, stated the site is accessed from Weld County Road 25.5,and U.S. Highway 85 is located at the back of the property. He stated there is a paved approach and parking,and the retention pond is landscaped and will accommodate runoff from the site and adjacent buildings. He further stated this is an existing facility and the site is very clean. In response to Commissioner Masden,Mr. Messinger stated he has been operating since 1998,and there will be no change in the activities. Responding to Commissioner Geile, Mr. Messinger stated he has reviewed and concurs with the Conditions of Approval and Development Standards as proposed, and he also agrees with changing the fencing material, since it will be an improvement to the site. No public testimony was offered concerning this matter. Commissioner Masden moved to approve the request of Lance and Cheryl Messinger for a Site Specific Development Plan and Use by Special Review Permit #1542 for Mineral Resource Development Facilities, including an Oil and Gas Support and Service Facility(storage of oilfield equipment),in the A(Agricultural)Zone District,based on the recommendations of the Planning staff and the Planning Commission, with the Conditions of Approval and Development Standards as entered into the record. The motion was seconded by Commissioner Long, and it carried unanimously.
