RE: AUTHORIZATION FOR THE WELD COUNTY ATTORNEY TO PROCEED WITH
LEGALACTION AGAINST RONALD GRABRIAN FOR VIOLATION OF THE WELD
COUNTY CODE
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, Ronald Grabrian, VI #0500417, is allegedly in violation of the Weld County
Code, and
WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has
not been corrected, and
WHEREAS, on the 14th day of March, 2006, a public hearing was held before the Board
of County Commissioners for the purpose of hearing testimony relating to said violation, at which
time this matter was continued to April 11, 2006, to allow the property owner adequate time to
complete the forms needed to justify the Accessory to the Farm permits, and
WHEREAS, on the 11th day of April, 2006, a public hearing was held before the Board of
County Commissioners for the purpose of hearing testimony relating to said violation, and
WHEREAS, Ronald Grabrian, property owner, was present at said hearing, and
WHEREAS,the Board of County Commissioners deems it advisable to refer said violation
to the Weld County Attorney's Office for legal action, with an instruction for delay of action upon
such referral until June 11, 2006, to allow adequate time for the property owner to provide proper
documents to justify an Accessory to the Farm or remove the mobile homes, and to decide whether
to lease out the milk production part of the farm, to bring the subject property into compliance and
for an inspection of the property by the Department of Planning Services staff.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that VI #0500417 be, and hereby is, referred to the Weld County Attorney's
Office for legal action against Ronald Grabrian to remedy the violation of the Weld County Code,
and any other persons occupying the properties, any persons claiming an interest in the properties,
and any persons acting in active concert with the identified parties, with an instruction for delay of
action upon such referral until June 11, 2006, to allow adequate time for the property owner to
provide proper documents to justify an Accessory to the Farm or to remove the mobile homes, and
to decide whether to lease out the milk production part of the farm, to bring the subject property
into compliance.

REMEDY
•
To bring the property into compliance ZPMH-2401, 2402 and 2403 shall be re-justified annually as
required for all "Accessory to the Farm"Zoning Permits.
RECOMMENDATION
The Department of Planning Services recommends that this case be referred to the County Attorney's
Office for immediate legal action.

January 10, 2006 Mr. Grabrian came into the office and met with Wendi Inloes and myself.
February 7, 2006 Property inspected. Property remains in violation.
February 15, 2006 Letter sent to property owner indicating that the violation case was scheduled
before the Board of County Commissioners.
March 14, 2006 Staff met with Mr. Grabrian after Violation Hearing to discuss remedies. Mr.
Grabrian disclosed that he sold all milking cows and could only substantiate 1
maybe 2 employees.
March 14, 2006 Letter sent to property owner indicating that the violation case was scheduled
before the Board of County Commissioners.

Dear Mr. Grabrian:
The property referenced above remains in violation of the Weld County Code. I have scheduled a
meeting with the Board of County Commissioners on April 11, 2006, at 10:00 a.m., to consider the
violations occurring on the property. The above mentioned property remains in violation of the
following Section(s) of the Weld County Code:
Chapter 23, Article III, Div 1 "A (Agricultural)Zone District"
Section 23-3-20 "Uses allowed by right."
Section 23-3-30 "Accessory uses."
Section 23-3-30.F "Mobile homes subject to the additional requirements of Article IV,
Division 3 of this Chapter."
Chapter 23, Article IV(4), Division 3 "Mobile Homes and Manufactured Structures."
Section 23-4-140 "Mobile homes permitted in the A Zone District."
Section 23-4-170 "Temporary accessory farm use."
Section 23-4-170.D "All mobile homes as accessory farm uses are temporary...."
To bring the property into compliance:
During our discussion on March 14,2006,we discussed the fact that you have sold off all
of your milking cattle. You indicated that you think you might be able to substantiate 1
(one) or possibly 2 (two) full time employees. It is our understanding that you want to
bring in a new mobile home (ZPMH-2439); therefore, Wendi Inloes (Planning
Coordinator), indicated that the best way to correct the violation might be to remove the 2
older trailers (currently permitted under ZPMH-2402 &2403)and re-justify the 2 mobile
homes (ZPMH-2401 & ZPMH-2439). We also discussed the possibility of you leasing
out your dairy farm. Wendi explained that any lessee would need to re-apply for any
proposed housing with new Zoning Permit applications. Lastly,you indicated a desire to
move your current part-time tenant from the mobile home located up by the road to the
back mobile home (which you would be bringing in) and then rent out the mobile home
up by the road. As we have previously discussed, per Section 23-4-170.A.3 of the Weld
County Code, a mobile home permitted as an "Accessory to the Farm" cannot be used
as an income source by the applicant for rental to persons who are not principally
employed upon the lot. •

This hearing will take place in our Hearing Room, located at 918 10th Street, Greeley, Colorado. It is
recommended that you or a representative be in attendance to answer any questions the Board of
County Commissioners might have about the violations.
Please also be advised that I will be taking video and/or pictures from the road or adjacent properties
the business day before or as soon as possible to the above mentioned Violation Hearing date.
The Department of Planning Services' staff will be recommending that the Board of County
Commissioners authorize the County Attorney to proceed with legal action to remedy the violation. Our
records indicate that you were made aware of the nature of the violation including the action necessary
to correct the violation, and that you were given sufficient time to remedy this violation. If you have any
questions concerning this matter, please call me.
