We have no objections to the proposal, however, we do recommend that the following conditions be part of any approval: We recommend that the following requirements be met prior to allowing the plat to be recorded: 1. The applicant shall submit evidence of an Air Pollution Emission Notice (A.P.E.N.) and Emissions Permit application from the Air Pollution Control Division, Colorado Department of Health and Environment. We recommend that the following requirements be incorporated into the permit as development standards: 1. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended) shall be stored and removed for final disposal in a manner that protects against surface and groundwater contamination. 2. No permanent disposal of wastes shall be permitted at this site. This is not meant to include those wastes specifically excluded from the definition of a solid waste in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended. 3. Waste materials shall be handled, stored, and disposed in a manner that controls fugitive dust, fugitive particulate emissions, blowing debris, and other potential nuisance conditions. 4. The applicant shall comply with all provisions of the Underground and Above Ground Storage Tank Regulations (7 CCR 1101-14). 5. Fugitive dust and fugitive particulate emissions shall be controlled on this site. 6. Storage, use, dispensing, mixing and handling of flammable and combustible liquids shall be in accordance with Article 79 of the 97 UFC. 4. Material classification. Flammable and combustible liquids shall be classified in accordance with Article 2 and as set forth in Table 7901.1-A of the 97 UFC. COMBUSTIBLE LIQUID is a liquid having a flash point at or above 100'F (37.8"C). Combustible liquids are subdivided as follows. The category of combustible liquids does not include compressed gases or cryogenic fluids. Class II liquids are those having closed cup flash points at or above 100'F (37.8'C) and below 140'F (60'C). Class III-A liquids are those having closed cup flash points at or above 140'F (60'C) and below 200'F (93.3'C). Class III-B liquids are those liquids having closed cup flashpoints at or above 200'F (93.3'C). FLAMMABLE LIQUID is a liquid having a closed cup flash point below 100"F (37.8'C). The category of flammable liquids does not include compressed gases or cryogenic fluids. Flammable liquids are further categorized into a group known as Class I liquids. The Class I category is subdivided as follows: Class I-A liquids include those having a flash point below 73'F (22.8"C) and having a boiling point below 100'F (37.8'C). Class I-B liquids include those having a flash point below 73'F (22.8'C) and having a boiling point at or above 100'F (37.8"C). A permit is required to: 1. Install, operate, repair or modify pipelines, equipment or facilities where flammable or combustible liquids are produced, processed, dispensed, stored, handled or used. 2. Store, handle, transport, dispense, mix, blend or use flammable or combustible liquids in excess of quantities specified in Section 105. 3. Remove, abandon,place temporarily out of service or otherwise dispose of a flammable or combustible liquids tank. 4. Install, construct, alter or operate tank vehicles, equipment, tanks, plants, terminals, wells, refineries and similar facilities where flammable and combustible liquids are produced, processed, transported, stored, dispensed or used. 5. Change the type of contents stored in a flammable or combustible liquid tank to a material other than that for which the tank was designed and constructed. 7901.3.2 Plans. Plans shall be submitted with each application for a permit to store more than 5,000 gallons (18 925 L) of liquids outside of buildings in drums or tanks. The plans shall indicate the method of storage, quantities to be stored, distances from buildings and property lines, access ways, fire-protection facilities, and provisions for spill control and secondary containment. Dear Ms. Lockman: The Town of Windsor Planning Commission reviewed this referral at its regular meeting of February 3, 2006. The subject property is currently located outside the Town's Growth Management Area(GMA) and is depicted as Heavy Industrial on the Town's Land Use Plan map. However, the subject property is located within the East Side Industrial Subarea Plan(ESISP)update to the Town's Land Use Plan map that is currently being reviewed by the Planning Commission. The ESISP currently anticipates that the subject property would be incorporated into the Town's GMA. The subject property is also part of the pending Great Western Third Annexation which is proposed to be zoned Heavy Industrial (I-H). If the property were annexed into the Town, the drilling of oil and gas wells in the I-H zoning district would be subject to conditional use grant approval by the Town Board following recommendation from the Planning Commission. While the actual impact on surface development of the property is not known at this time,the Town has discussed with the applicant the need for a comprehensive map of all planned future drilling sites on and adjacent to the property (those planned by the applicant, as well as any other sites of which the applicant may be aware) for consideration during the review of the applicant's surface development plans. This is due to the fact that the drilling of oil or gas wells in this area can impact future surface development due to the Municipal Code requirements regarding setbacks from oil and gas facilities. Section 16-148 requires, "The minimum setback distance between property included in any new land use proposal for low-density surface development and existing oil and gas wells shall be one hundred fifty (150) feet, measured from the nearest exterior property line of any proposed lot. For purposes of this Article, low-density areas shall include those areas zoned Estate Residential (E-1) and Limited and Heavy Industrial (I-L and I-H), and new land use proposal shall be defined as any proposal that has not yet received preliminary plat approval." Section 16- 150 also contains landscaping and buffering requirements for new land use proposals adjacent to existing oil and gas wells. The applicant has indicated that their two drill sites that are located on the property which is the subject of pending applications for annexation are proposed to be located adjacent to two existing wells. This will serve to minimize the impact on surface development since the new wells will utilize virtually the same setback area that was already established around the existing wells. The applicant further indicated that they plan to establish drill sites located on Kodak property in order to directional drill to other portions of the property, thereby preserving surface development potential on the property proposed for annexation to the Town. Finally, while the applicant has actively acquired many of the mineral interests under their property, several fractured interests remain, including holdings by Petro-Canada Resources (USA) Inc. The applicant is currently in negotiations with Petro-Canada to locate their wells in a manner that will limit the impact on future surface development and they have agreed to provide the Town with a map of known existing and planned future drill sites for planning purposes. Therefore, based upon the aforementioned information, the Planning Commission recommends of approval to the Weld County Department of Planning Services subject to the following condition: The applicant shall submit to the Town a plan depicting all of the future oil and gas production facilities planned by the applicant, as well as any other sites of which the applicant may be aware, located on or adjacent to the applicant's entire property that is proposed to be annexed to the Town.
