Good Afternoon, Jacqueline:
My apology for the delayed reply ... I have checked with PW staff members on the release of warranty collateral.
Historically and typically Public Works has not coordinated collateral with the Clerk,for subdivisions.
This topic has been discussed on at least two other occasions between Planning & Public Works.
These discussions returned to the fact that Planning is designated as the 'center hub' of development activity (and
subdivisions) in Weld County-with Public Works being a referral agency, similarly as Sheriff, Health, etc.
I have no record of direction for PW to release any collateral for subdivisions.
After discussion with Drew ... he suggested that PW sit down with Planning to discuss this topic further.
There will be more complicated collateral items with the Big Boom Industry of Development in Weld County.
Examples to consider would be each department responsible for'their' collateral items, multi-year phasing
agreements for collateral, would one department wait for another department to complete construction to release
collateral???: public restrooms, landscaping, roadways, erosion control, Seasonal restrictions on construction,
etc. ....
Please set up a time to discuss this topic with our departments as you see best.
PW sees this as a very important item and welcomes further discussion -especially on tracking collateral items &
release dates.

Since this is just the 15% for the year for the road it is staff understanding that Public Works
does the final release of collateral.

Good Morning, Rob:
Thank you for your patience while we looked into your request.
From our records, it appears that Feb-2006 would be the Start of the Warranty Period for the infrastructure within
PF-1045 Highland Farms PUD.
I have enclosed an email discussing this item.
Prior to Feb-2007, Public Works will do an inspection of infrastructure before the Warranty Period is closed.
Based upon that assessment, remaining collateral monies (covering the warranty)would be released dependent
upon any need for repair(s).
You may request a Full Release of Collateral in Feb-2007, in writing, from our Department. There remain
approximately 3-months duration of the warranty,period as of today.
Please let me know if I have the facts correct and if you are in agreement. Thank you.
I will copy Public Works Field Inspection and the Planner with this email for their records.

This letter will save as our formal Request for final Release of Collateral per Section 6.3 of our
Improvements Agreement for Highland Farms PUD PF#1045,dated August 15,2005 and approved
by the Board of County Commissioners on August 19,2005.Per your memo of February 27,2006 to
Jacqueline Hatch at planning,Public Works requested retention of collateral in the amount of
S18,242.60 for street improvements and hairs.The time period far partial maintenance has expired
and all repairs have been completed.Kelly Jenkins with your department has reviewed the
improvements and repairs and I believe has recommended acceptance of the improvements.It is
requested that Public Works recommend acceptance ofihe improvements and release of the collateral
funds Once approval is received from Public Works,we request the Board of County Commissional
