Department of Public ' COLORADO Health and Environment }C� CASE NO.: CZ-1104 NAME: Jay& Sherrie Woods The Department has reviewed the request to change from Low Density Residential to Agricultural. There is an existing house and 2 out buildings on the property. The house is currently served by the City of Greeley for water service and an individual sewage disposal system. The se tic system is undocumented. The department understands that this property will possibly be reviewed again for a Use by Special Review application for a landscaping business. Any commercial/industrial development must comply with all applicable Weld County Department of Public Health and Environment, Colorado Department of Public Health and Environment, EPA and/or Oil and Gas regulations. Site-specific comments will be made at that time. The Department recommends approval of this application with the following conditions: 1. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended)shall be stored and removed for final disposal in a manner that protects against surface and groundwater contamination. 2. No permanent disposal of wastes shall be permitted at this site. This is not meant to include those wastes specifically excluded from the definition of a solid waste in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended. 3. Waste materials shall be handled, stored, and disposed in a manner that controls fugitive dust, blowing debris, and other potential nuisance conditions. 4. Fugitive dust shall be controlled on this site. 5. The Environmental Health Division of the Weld County Department of Public Health & Environment was unable to locate a septicpermit for the septic sy tem locatet1on the parcel. Any existing septic system(s)which is not currently permitted through the Weld County Department of Public Health & Environment will require an I.S.D.S. Evaluation prior to the issuance of the required septic permit(s). In the event the system(s) is found to be inadequate, the system(s) must be brought into compliance with current I.S.D.S. regulations. If this property will be reviewed for a Use by Special Review (USR) permit the existing septic system must be evaluated by a Registered Professional Engineer for the commercial and/or residential uses. The applicant may want to have the system reviewed for the proposed commercial/residential uses of the USR at this time also. Please feel free to contact this office for further direction and clarification to meet both requirements. The applicant shall verify the existing right of way and the documents creating it on the plat. Drainage: ❑ The applicant has stated in their application materials that their property"...is not in a flood hazard overlay district." o The property is shown on the Change of Zone plan drawings and on our County reference system to be within FEMA floodhazard zone `B' on the FIRM(panel 628 of 1075E ❑ The applicant has not proposed any additional structures, or modification to the existing grading and/or drainage condition at this time. o Should the applicant modify the character of their property such that the overall imperviousness may be considered to be increased,a drainage report will be submitted to address the changes to the existing conditions. o Should the applicant propose additional structures on the property, they shall be required to submit an FHDP application. Recommendation ❑ The Public Works Department recommends approval of this change of zone. The applicant shall address the comments listed above at the specific step of the review process stated. A separate building permit shall be obtained prior to the construction of any building or change of use of any of the existing buildings. 2. A plan review is required for each building for which a building permit is required. Plans shall include a floor plan.Commercial building plans shall bear the wet stamp of a Colorado registered architect or engineer.Two complete sets of plans are required when applying for each permit. 3. Buildings shall conform to the requirements of the codes adopted by Weld County at the time of permit application. Current adopted codes include the 2003 International Building Code; 2003 International Mechanical Code; 2003 International Plumbing Code; 2003 International Fuel Gas Code; 2002 National Electrical Code and Chapter 29 of the Weld County Code. 4. Each building will require an engineered foundation based on a site-specific geotechnical report or an open hole inspection performed by a Colorado registered engineer. Engineered foundations shall be designed by a Colorado registered engineer. 5. Inspections and approval must be must be obtained from Union Colony Fire District for any new buildings or for change of use of any of the existing buildings. 6. Fire resistance of walls and openings, construction requirements, maximum building height and allowable areas will be reviewed at the plan review. Setback and offset distances shall be determined by the Zoning Ordinance. 7. Building height shall be measured in accordance with the 2003 International Building Code for the purpose of determining the maximum building size and height for various uses and types of construction and to determine compliance with the Bulk Requirements from Chapter 23 of the Weld County Code. Building height shall be measured in accordance with Chapter 23 of the Weld County Code in order to determine compliance with offset and setback requirements. When measuring buildings to determine offset and setback requirements, buildings are measured to the farthest projection from the building. Property lines shall be clearly identified and all property pins shall be staked prior to the first site inspection.
