RE: APPROVE PUBLIC SERVICE COMPANY OF COLORADO EASEMENT FOR WELD
COUNTY BUSINESS PARK AND AUTHORIZE CHAIR TO SIGN
WHEREAS,the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS,the Board has been presented with a Public Service Company of Colorado
Easement between the County of Weld, State of Colorado, by and through the Board of County
Commissioners of Weld County, and Public Service Company of Colorado, 1225 17th Street,
Denver,Colorado,80202,commencing upon full execution,with further terms and conditions being
as stated in said easement, and
WHEREAS,after review,the Board deems it advisable to approve said easement, a copy
of which is attached hereto and incorporated herein by reference.
NOW,THEREFORE,BE IT RESOLVED by the Board of County Commissioners of Weld
County,Colorado,that the Public Service Company of Colorado Easement between the County of
Weld, State of Colorado, by and through the Board of County Commissioners of Weld County,and
the Public Service Company of Colorado be, and hereby is, approved.
BE IT FURTHER RESOLVED by the Board that the Chair be, and hereby is, authorized to
sign said easement.
The above and foregoing Resolution was,on motion duly made and seconded, adopted by
the following vote on the 8th day of Ma , A.D., 2006.

The undersigned Grantor hereby acknowledges receipt of good and valuable consideration from PUBLIC SERVICE COMPANY OF
COLORADO (Company), 1225-17'" Street, Denver, Colorado, 80202-5533, in consideration of which Grantor(s) hereby grants unto
said Company, its successors and assigns, a non-exclusive easement to construct, operate, maintain, repair, and replace utility lines
and all fixtures and devices, used or useful in the operation of said lines,through,over, under,across,and along a course as said lines
may be hereafter constructed in SUBDIVISION Weld County Business Park PUD Amendment 1, Annexation and Weld County
Business Park PUD, in Section 31,Township 6 North, Range 66 West of the 6th Principal Meridian in the City of Greeley County of
Weld, State of Colorado,the easement being described as follows:
See Exhibits A, B,C and D,attached hereto and made a part hereof.
The easement is XXX( feet in width. The side boundary lines of the easement shall be lengthened and shortened as necessary to
encompass a continuous strip of not less than the above width at all points on Grantor's property crossed by the above described
easement and extending to the boundaries of adjacent properties.
Together with the right to enter upon said premises,to survey,construct, maintain, operate, repair, replace,control, and use said utility
lines and related fixtures and devices, and to remove objects interfering therewith, including the trimming of trees and bushes, and
together with the right to use so much of the adjoining premises of Grantor during surveying, construction, maintenance, repair,
removal, or replacement of said utility lines and related fixtures and devices as may be required to permit the operation of standard
utility construction or repair machinery. The Grantor reserves the right to use and occupy the easement for any purpose consistent
with the rights and privileges above granted and which will not interfere with or endanger any of the said Company's facilities therein or
use thereof Such reservations by the Grantor shall in no event include the right to erect or cause to be erected any buildings or
structures upon the easement granted or to locate any mobile home or trailer units thereon. In case of the permanent abandonment of
the easement, all right, privilege,and interest granted shall terminate.
The work of installing and maintaining said lines and fixtures shall be done with care;the surface along the easement shall be restored
substantially to its original level and condition.

Re: Public Service Company(PSCo)easement:1399 and 1401 N 17th Street, Greeley—
Weld County Business Park
Dear Pat,
Enclosed for review and signature by the authorized representative of Weld County
(County) is the standard PSCo easement document and associated Exhibits for electrical
service to the Weld County building at 1401 N 17th Street.
The Exhibits were prepared by the County representative and reflect the access
requirements to provide electrical service to the new building. Exhibits C and D are
specific for the new service. Exhibits A and B were prepared by Drexel,Barrell and
Company to complete easements that were omitted form the original plats.
I have enclosed two copies of the easement document. Please have the original signed by
the authorized County representative,the signature notarized and the fully executed copy
returned to me in the enclosed, self addressed envelope. The second"COPY"is for
County records. Please note that the signature block is only Weld County and may need
additional language added.
