Environmental Health Services has reviewed this proposal for storage of oilfield
equipment. We have no objections to the proposal, however, this property is going
through the Recorded Exemption process to split the property. At this time, the existing
well is being utilized by both lots A & B. After the site is split the existing well will be for
use only to lot B, lot A will not have a water source. The applicants have applied for a
commercial well for lot A but cannot go forward until the recorded exemption is
completed.
We recommend that the following requirements be met prior to allowing the plat to be
r-- recorded:
1. The applicant shall provide current evidence that the facility has an adequate
water supply (i.e., well or community water system).
2. The applicant shall submit a waste handling plan, for approval, to the
Environmental Health Services Division of the Weld County Department of
Public Health & Environment. The plan shall include at a minimum, the
following:
1) A list of wastes which are expected to be generated on site (this should
include expected volumes and types of waste generated).
2) A list of the type and volume of chemicals expected to be stored on site.
3) The waste handler and facility where the waste will be disposed (including
the facility name, address, and phone number).

We recommend that the following requirements be incorporated into the permit as
development standards:
1. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and
Facilities Act, 30-20-100.5, C.R.S., as amended) shall be stored and removed for
final disposal in a manner that protects against surface and groundwater
contamination.
2. No permanent disposal of wastes shall be permitted at this site. This is not
meant to include those wastes specifically excluded from the definition of a solid
waste in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S.,
as amended.
3. Waste materials shall be handled, stored, and disposed in a manner that controls
fugitive dust, fugitive particulate emissions, blowing debris, and other potential
nuisance conditions.
4. The applicant shall operate in accordance with the approved "waste handling
plan".
5. Fugitive dust and fugitive particulate emissions shall be controlled on this site.
6. This facility shall adhere to the maximum permissible noise levels allowed in the
Commercial Zone as delineated in 25-12-103 C.R.S., as amended.
7. Adequate handwashing and toilet facilities shall be provided for employees and
patrons of the facility.
8. Any septic system located on the property must comply with all provisions of the
Weld County Code, pertaining to Individual Sewage Disposal Systems.
9. A permanent, adequate water supply shall be provided for drinking and sanitary
purposes.
10.All potentially hazardous chemicals must be stored and handled in a safe
manner in accordance with product labeling and in a manner that minimizes the
release of hazardous air pollutants (HAP's) and volatile organic compounds
(VOC's).
11.The operation shall comply with all applicable rules and regulations of the State
and Federal agencies and the Weld County Code.

The Weld County Public Works Department has reviewed this proposal; this project falls primarily under the
purview of the Use by Special Review, Weld County Code, Chapter 23, Article II, Division 4, Section 23. Our
comments and requirements are as follows:
COMMENTS:
WCR 25.5 is a local gravel road and has 60 feet of right-of-way from Book 48, Page 326 dated 3/3/1890. This 60-
foot right-of-way is located east of a half section line, which is shown on the plat drawing. I have pulled a Road
Viewers' Report and have verified the right-of-way width with Leon Sievers, our Surveyor/Right-of-Way Agent. An
additional right-of-way may be available on the west side through deeds and documents associated with adjacent
property owners.
" .3 existing improvements, such as the office/warehouse parking and landscaping are in place through USR-
16 of 1999. There has been a recorded exemption submitted for Lots A and B for RE-4133 splitting the existing
parcel.
REQUIREMENTS:
Access: Utilize the existing paved access points to the existing facility.
Right-of-Way: The plat drawing identified 60 feet of right-of-way east of the half section line only. Improvements
have been placed within this right-of-way. On the plat drawing, the applicant identified removal of location of
improvements under the note section.
The Weld County Public Works Department recommends replacing that paragraph on the plat drawing with this
new paragraph: Weld County reserves the right, in the future, to request the owner to remove the existing
improvements presently located within the right-of-way or the County to shall seek a license agreement with the
owner for those improvements within the right-of-way.
Storm Water Drainage: Utilize the existing retention pond located in the southwest corner of the property as
noted from the previous USR application.

SUBJECT: USR-1542: Landscape Referral

Project:
Site Specific Development Plan and Special Review Permit for mineral resource development
facilities including oil & gas support and service facility (storage of oilfield equipment) in the A
(Agricultural) Zone District.
The Department of Planning Services reviewed the above referenced Site Specific
Development Plan and Special Use Permit documentation and drawings and offers the
following comments:
The Use by Special Review Plat shall be prepared in accordance with Section 23-2-260.D of
the Weld County Code, with the exception, that the scale of the USR Plat for this facility be
increased to one inch equals twenty feet. (1" = 20 feet)
This application shall be in compliance with Section 23-3-350 A. and B and is address in the
following comments.
Section 23-3-350.A addresses storm water management. The Department of Public Works
reviews this standard who will make recommendations on the handling of stormwater and
release at a historic rate.
Per Section 23-3-350.B, the applicant shall delineated sufficient screened off street parking
areas. All parking and loading areas shall be screened from adjacent properties and road
rights-of-way. Further, all areas associated with outdoor storage shall be screened from
adjacent properties and public rights-of-way. The applicant shall delineate an opaque visual
screen on all sides of the property to mitigate the potential negative impact and aesthetic
concerns on surrounding properties.
The application materials state that there will be 8 people, employees and truck drivers, utilizing
the site. Appendix 23-B of the Weld County Code, addresses the number of off-street parking
spaces required. For this situation, the office parking requirements are one space for every two
employees plus one space per 500 square feet of office space; total parking required for the
office component (4500 SF) is 1 space, for the employee count, minimum 9 parking spaces.
The proposed facility building has been classified as "warehouse uses" with one space required
for each 1000 SF of space; total parking required for the warehouse component is 12 parking
spaces. To meet the parking requirement for this facility, there shall be 21 parking spaces,
including accommodations to meet the requirements of the American with Disabilities Act.
The applicant shall delineate curb stops for the parking spaces shown on the USR plat. One

curb stop for each space is the standard. However, one curb stop centered over two parking
spaces is acceptable. Contact this office with any questions.
The applicant shall graphically delineate and provide written discussion describing the
accommodations to meet the requirements of the American with Disabilities Act. There is
presently no evidence that the non-ambulatory parking space has a safe and secure access to
the Warehouse - Office building.
Section 23-3-350.C addresses Loading Areas. A designated loading area is not delineated on
the plat. Visual interpretation of the submitted drawings identified a "Sorting-Processing
Shredding area" however, no specifically delineated loading area was identified. Such an area
shall be delineated on the plat.
Section 23-3-350.D provides for adequate street access. The applicant shall demonstrate a
safe and approved access. Points of ingress and egress to this parcel appear to be off of CR
25.5 right-of-way. Coordination with the Department of Public Works shall be on-going,
specific to the results of the traffic study, if requested, for all improvements to the County road
system.
The internal circulation within the service yard and property is not delineated and therefore
remains an outstanding issue. It is unclear how access is gained to the screened service yard
as there are no gates delineated on the plat. Further, the applicant shall justify the need for two
points of ingress and egress. The facility sign is not located on any of the submitted drawings.
The applicant shall provide further information on these issues prior to the Board of County
Commissioners hearing.
Section 23-3-350.E addresses acceleration and deceleration lanes. If required, the Department
of Public Works shall address this issue.
Section 23-3-350.F addresses the setback and offsets for structures from the future right-of-
way line. For this case, the setback is twenty (20)feet from the County Road 25.5 and the
offset is one foot for every three feet of building height or five feet whichever is greater.
Section 23-3-350.G addresses the Required Landscape areas. Section 23-3-350.G.1 states
"No more than eighty-five percent (85%) of the total area of a Lot shall be covered. Land shall
not be deemed covered if it is used for growing grass, shrubs, trees, plants or flowers or if
covered by decorative gravel or wood chips, or if it is otherwise suitably landscaped."
Further, Section 23-3-350.G.1 states "That portion of a Lot which abuts a public or private street
right-of-way shall be landscaped for a distance of ten (10) feet, measured at a right angle from
the Lot line towards the interior of the Lot. Driveways may pass through the required
landscaped areas."
The USR Plat has identified areas for landscape treatment. Although the application states no
landscape treatment will be added to the site, should living landscape materials exist, then they
shall be maintained at all times. Dead or diseased plant materials shall be replaced with
materials of similar quantity and quality at the earliest possible time.
Should living landscape materials exist the applicant shall demonstrate how the proposed plant
material will be watered, thus ensuring adequate growth and established of the feeder root
system. Further, the applicant shall provide evidence that a commercial well tap is able to
provide irrigation water for this site. Evidence of such shall be submitted to this office prior to

recording the USR plat.
Section 23-3-350.H addresses the issue of trash collection areas. Areas used for storage or
trash collection shall be screened from adjacent public rights-of-way and adjacent properties.
These areas shall be designed and used in a manner that will prevent wind or animal
scattered trash. The application materials have not delineated this structure on the preliminary
USR Plat.
Section 23-3-350 I and Section 23-3-350. J addresses the water and sewage disposal for the
site. The application materials state water is to be provided by a domestic well and disposal of
household wastes will be via an engineered ISDS system. There was no documents
demonstrating compliance, specifically with the State Engineers Office and with Environmental
Health for the septic system. The applicant shall provide evidence of water, typical for a
commercial business a commercial well is required. The Department of Public Health and
Environment will address additional requirements as warranted.
Section 23-3-360 addresses operation standards. The applicant shall address the issue of
noise, air quality, water quality, radiation and radioactive material, heat light, and property
maintenance. Evidence of written approval, including copies of all state and local permits shall
be submitted to the Department of Planning Services.
Section 23-3-360.A addresses noise. The Department of Public Health and Environment will
regulate the maximum permissible noise levels allowed for this facility. Further, the application
materials propose that the hours of operation are 7AM to 5 PM Monday through Friday of each
week, with no activity on site Saturday or Sunday, of each calendar year.
Section 23-3-360.F addresses the issue of on-site lighting, including security lighting if
applicable, this section.states "any lighting ... shall be designed, located and operated in such a
manner as to meet the following standards: sources of light shall be shielded so that beams or
rays of light will not shine directly onto adjacent properties...." The application materials do not
discuss the exterior lighting.. Staff shall require a Lighting Plan be submitted for review and
approval prior to recording the USR Plat.
Section 23-3-360.G addresses property maintenance. Should noxious weeds exist on the
property or become established as a result of the proposed development the applicant/
landowner shall be responsible for controlling the noxious weeds, pursuant to Chapter 15,
Articles I and II of the Weld County Code.
All other operation standards will be addressed by other referral agencies as warranted.
The applicant has not delineated on-site signs. The signs shall adhere to Section 23-4-90.A
and .B of the Weld County Code. Further, the location of the signs shall be delineated on the
Landscape / Site Plat. All structures, including signs, on site must obtain the appropriate
building permits.

Dear Ms. Martin:
This referral does not appear to qualify as a "subdivision"as defined in Section 30-28-
101(10)(a), C.R.S. Therefore, pursuant to the State Engineer's March 4, 2005 memorandum to county
planning directors, this office will only perform a cursory review of the referral information and provide
comments. The comments will not address the adequacy of the water supply plan for this project or the
ability of the water supply plan to satisfy any County regulations or requirements. In addition, the
comments provided herein cannot be used to guarantee a viable water supply plan or infrastructure, the
issuance of a well permit, or physical availability of water.
The referral information states that the commercial facility will be served by a domestic well.
Prior to using the well at the facility it must be permitted for commercial use.
