RESOLUTION RE : APPROVAL OF RECORDED EXEMPTION NO. 503 - JAMES VAWTER WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, it has been determined by the Board of County Commissioners of Weld County, Colorado, at a public meeting held on the 17th day of June, 1981 in the chambers of the Board of County Commissioners of Weld County, Colorado, that the division into two parcels of land, as shown on the plat known as Recorded Exemption No. 503 , being the property of James Vawter, described as part of the Southwest Quarter Section 2 , Township 1 North, Range 66 West of the 6th P .M. , Weld County, Colorado, being more particularly described as follows : The Southwest one-quarter of Section 2 , Township 1 North, Range 66 West of the 6th Principal Meridian, Weld County, Colorado. The parcel of land is described as the SW1/4, Section 2, T1N, R66W of the 6th P.M. , Weld County, Colorado. The property is located 11/4 miles east of Fort Lupton, on Colorado State Highway 52. The property is 144.5 acres of Class VI e, III e, IV e irrigated and nonirrigated soils. The request is to split the property into 140.5 acre and 4.0 acre parcels. The property is in an estate and the heirs wish to sell the improvements and retain the farm ground. Based upon the information submitted and the adopted policies in the County the Department of Planning Services Staff recommends the request be approved for the following reasons. 1. the request conforms to the intent clause of the Recorded Exemp- tion Procedure (Section 9-2 of the Weld County Subdivision Regula- tions) , the intent clause of the Agricultural Zone District (Section 3.3.A. of the Weld County Zoning Resolution) , and the Weld County Comprehensive Plan in that the uses will be compatible with the surrounding agricultural uses. The request will allow agricultural and related uses to be the predominant land uses. There will be no reduction in the amount of land currently being used for agricultural production. 2. This request complies with the provisions of Section 9-4 A. of the Weld County Subdivision Regulations. 3. The heirs, consisting of four persons, are desirous of selling off four acres with the existing house, well, garage and leaching field. None wish to sell the entire property at this time. We rented the house for a time, but this proved very impractical as we live south of Sedalia, quite a distance from Fort Lupton. So rather than try renting again - the house is now vacant - we would like to sell the house with four acres.
