Dear Ms. Hatch,
Thank you for the referral regarding the proposed Deemer Site Specific Development Plan and
Special Use Review located in the southwest corner of section 32, T2N, R68W. It is
understood that the proposal includes the development of a professional office with some
parking and the storage of landscape materials and equipment on 3.46 acres.
The site is within the Town's Planning Area and Annexation will be required upon contiguity.
The Town's Comprehensive Plan has designated this parcel as Mixed Use Highway 52
Commercial. In accordance with the Land Use Code, the proposed use could be permitted in
certain zoning districts. As such, the proposed development could be consistent with the intent
of the Comprehensive Plan and the Land Use Code under certain conditions and
performances.
In lieu of annexation at this time, the Town will require the development to comply with the
Town's development standards, including but not limited to our 20% open space requirements,
lighting, landscaping, screening, architectural and bulk standards (including an articulated
cornice or parapet and four sided architecture for any new structures, additions, and exterior
modifications), signage, as well as our fence and wall requirements as detailed in sections 2

and 3 of the Town of Frederick's Land Use Code . Note that the use of chain link fencing is
permitted only in Industrial zone. Therefore, the Town requests that landscape buffering and
screening be implemented and alternative fencing material be used. If an alternative fence is
not installed, please apply a plastic coating to soften the visual impact of the fencing and install
enhanced landscaping for visual mitigation, particularly around the perimeter of the storage
and parking areas. Furthermore, there are specific provisions for outdoor storage in our code
that should be applied (see article 3 of the Land Use Code). In addition, the Frederick
Firestone Fire Protection District has adopted the 2003 International Fire Code (IFC) for its
standard. Therefore, the development must comply with the requirements of Appendix D of
the 2003 IFC (see attached). Lastly, the development must also comply with the Towns
parking lot requirements which require a nine foot wide by 19 foot long parking stalls and other
requirements such as screening, parking space calculations, and service vehicle / delivery
requirements as detailed in Section 2 of the Frederick Land Use Code (see link below).

The subject application appears to have a minor error in the map depicted on
Appendix B. Weld County Road 3 1 is shown as running East/West to the North of the
subject property. In fact it runs North/South to the West of the subject property. The
irrigation ditch owned by the New Consolidated Lower Boulder Reservoir and Ditch
Company comprises the Northeasterly boundary of the subject property. The landscaping
plan included in the application appears to show at least one tree, which, according to the
scale of the plan, is less than 20 feet from the centerline of our ditch. This would be
within our easement and would cause potential interference with ditch operation and
maintenance. We request that you not approve any plan that incorporates trees or shrubs
within 40 feet of the centerline of the ditch.

Dear Ms. Hatch:
I have reviewed the submitted material pertaining to the Site Specific Development Plan and a Special
Review Permit for the Deemer property, located at 1503 Highway 52 (Case Number: USR-1576). The
Fire District does not object to the use of the buildings provided the requirements of the Fire District can be
met. The Fire District has the following comments with regard to the submittal:
• It appears that the buildings are existing and will be used for office/storage uses for a landscape
design business. If the buildings are used solely for the purposes of office and storage of non-
hazardous materials then water supply for fire protection would not be required. If the buildings
are used for any type of hazardous activity such as vehicle repair, storage or use of
flammable/combustible liquids,or hazardous materials;or, if any new structures are proposed then
water supply for fire protection requirements apply.
• Fire apparatus access is not adequate as shown on the plans. Apparatus access roads must be a
minimum of 20-feet in width. Apparatus access roads shall be maintained to support the imposed
loads of fire apparatus(75,000 pounds).
• A final inspection of the occupancy will be required by a member of the Fire District before any
Certificate of Occupancy is issued from Weld County.
Nothing in this review is intended to authorize or approve of any aspect of this project that does not comply

The Weld County Public Works Department has reviewed this proposal. This project falls primarily under the
purview of the Use by Special Review Standards, Weld County Code 23, Article II, Division 4, Section 23. Our
comments and requirements are as follows:
COMMENTS:
The Colorado Department of Transportation (CDOT) has jurisdiction over all accesses to the state highways.
Please contact Gloria Hice-Idler at the Greeley office to verify the access permit or for any additional
requirements that may be needed to obtain or upgrade the permit. (State Highway 52)
REQUIREMENTS:
—Access: It appears from the plat drawing that the access is a shared access between both parcels, as the
iroposed driveway does encroach upon the adjacent owner. Verify with CDOT any improvements that may be
necessary to obtain or upgrade the access permit.
Plat Drawing: The applicant needs to place on the plat drawing additional equipment, vehicle parking, storage
area for bulk delivery.
Off-street parking spaces including the access drive shall be surfaced with gravel, asphalt, concrete or the
equivalent and shall be graded to prevent drainage problems.
Each parking space shall be equipped with wheel guards or curb blocks when necessary to prevent vehicles
from extending beyond the boundary of the space and from coming into contact with other vehicles, walls,
fences or planting.
Storm Water Drainage:
a. The historical flow patterns and run-off amounts will be maintained on site in such a manner that
it will reasonably preserve the natural character of the area and prevent property damage of the
type generally attributed to run-off rate and velocity increases, diversions, concentration and/or
unplanned ponding of storm run-off.
b. The applicant must take into consideration storm water capture/quantity and provide accordingly
for best management practices.

Environmental Health Services has reviewed this proposal for an office and storage of
landscape materials. We have no objections to the proposal, however, we do
recommend that the following conditions be part of any approval:
We recommend that the following requirements be met prior to allowing the plat to be
recorded:
1. The applicant shall submit a dust abatement plan for review and approval, to the
Environmental Health Services, Weld County Department of Public Health &
-- Environment.
2. The septic system serving the home shall be reviewed by a Colorado Registered
Professional Engineer. The review shall consist of observation of the system and
a technical review describing the systems ability to handle the proposed
hydraulic load (commercial office). The review shall be submitted to the
Environmental Health Services Division of the Weld County Department of Public
Health and Environment. In the event the system is found to be inadequately
sized or constructed the system shall be brought into compliance with current
Regulations.
We recommend that the following requirements be incorporated into the permit as
conditions that must be met one month prior to construction activities:
1. A stormwater discharge permit may be required for a
development/redevelopment /construction site where a contiguous or non-
contiguous land disturbance is greater than or equal to one acre in area. Contact
the Water Quality Control Division of the Colorado Department of Public Health
and the Environment at www.cdphe.state.co.us/wq/PermitsUnit for more
information.
We recommend that the following requirements be incorporated into the permit as
development standards:
1. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and
Facilities Act, 30-20-100.5, C.R.S., as amended) shall be stored and removed for
final disposal in a manner that protects against surface and groundwater
contamination.
2. No permanent disposal of wastes shall be permitted at this site. This is not
meant to include those wastes specifically excluded from the definition of a solid
waste in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S.,
as amended.
3. Waste materials shall be handled, stored, and disposed in a manner that controls
fugitive dust, fugitive particulate emissions, blowing debris, and other potential
nuisance conditions.
4. The applicant shall operate in accordance with the submitted "waste handling
plan".
5. Fugitive dust and fugitive particulate emissions shall be controlled on this site.
The facility shall be operated in accordance with the approved dust abatement
plan at all times.
6. This facility shall adhere to the maximum permissible noise levels allowed in the
Commercial Zone as delineated in 25-12-103 C.R.S., as amended.
7. Adequate handwashing and toilet facilities shall be provided for employees and
patrons of the facility.
8. Sewage disposal for the facility shall be by septic system. Any septic system
located on the property must comply with all provisions of the Weld County Code,
pertaining to Individual Sewage Disposal Systems.
9. The facility shall utilize the existing public water supply.( Left Hand Water District)
10.All potentially hazardous chemicals must be stored and handled in a safe manner
in accordance with product labeling and in a manner that minimizes the release
of hazardous air pollutants (HAP's) and volatile organic compounds (VOC's).
11.If applicable, the applicant shall obtain a stormwater discharge permit from the
Colorado Department of Public Health & Environment, Water Quality Control
Division.

12.The operation shall comply with all applicable rules and regulations of the State
and Federal agencies and the Weld County Code.

1. A change of use building permit will be required to convert the existing residence into an office. If the
existing garage use changes to other than what it was originally permitted for, a separate permit will be
required for it also.
2. A plan review is required for each building. Plans may require the wet stamp of a Colorado registered
architect or engineer.
3. Buildings shall conform to the requirements of the codes adopted by Weld County at the time of permit
application. The office building will be most likely be classified as a B occupancy based on the USR
questionnaire submitted to the planning department.
4. Fire resistance of walls and openings, construction requirements,maximum building height and allowable
areas will be reviewed at the plan review
5. Provide letter of approval from Mountain View Fire Protection District prior to applying for the change of
use permit.
6. Building records do not show any outstanding permits on site.
