I have this day planted a Monument to mark the corner of Sections 10, 11, 14 and 15, T. 7 N. R.65 W. of the 6th, P.M. Said Monument being a Warry 'stane 18'x 5'x 5', set 14' in the ground, and was set in the exact location of morner fence post,described in report 016 survey, dated Dec. 24th, 1891. as marking the corner of the above named sections. Said Monument was set in the presence of D. Hodgson and Geo. Ito Williams. Respectfully submitted. Gentlemen: I am in receipt of your favor of the 5th. inst. ordering me to set those corners at, once and thus save trouble. Perhaps a word in explanation would be very proper just here. In accordance with your desire, I loaded some stones into a buggy and went up into that country with the intention of setting them. I called on Frank Doke, to let him know what I was going to do, He was absent from home. I next called on Mr. Wyatt to get him to go with me to set the stones. He was just about, to start out after some cattle, so could not go with me . While talking with Mr. Wyatt, Mr. James Russell, passed I told him what I was going to do, and wished him to be present when the stones were set. He was on his way to town, and could not possibly be there. Ithen went to see Mr. Ca1.;Thomas, to get him to assist me a :nd to be a witness of my work. He was in Greeley. Under the circumstances I deemed it inadvisable to set any stones that day, as I had either seen or called at the residence of each of the interested parties, and was unable to get any one to go with me and witness the work. I ha e^the subject of resurveys some thought, and to that particular case I have given a good deal of study, and I fail to see where the matter, from the Countys standpoint, would be strenghtened by my setting stones in places already marked, in two instances by stones„ and the third by a corner brace post of a fence, AS I view the matter, it would take a / 0r/ c'/ lawsuit to force any one to adopt a corner or line which they did not wish to recognise as their boundary. If the County is forced into a suit in this matter, it would be more difficult to explain, under cross examination, the reason for setting new corners in the place of the old, than it would to explain why those corners were held to be the true corners of the sections in questions You would have to prove by testimony that the new corners were placed in presisely the same location as the old, you would then still have to prove that the old corners were in the exact location s the government corners, You have thus weakened your case by adding; an unnecessary link to your chain of evidence. Please lay this matter of my report of the survey, and this letter before Mn Haynes for an opinion before doing any: thing further. Stanry�l3rd, Esq. , County Surveyor, Greeley, Col . Dear Sir: Your favor of the 15th of December reached me a few days since. I have never set any corners in Township 8, Range 65 or in Township 7, Range 65. In 1879 I resurveyed nearly all of the land lying under and adjoining the line of the Larimer and Weld ca- nal , from the line between the counties of Larimer and Weld to the line between Range 64 and g5. I found some very bad work in Town 7 -65, in fact there was not any interior corners in this Township that were anywhere near the position as described in the field notes of that Township. Some of them were over 800 ft. from where they should be, and a large number of them were not to be found at all . The exterior corners were all generally well established in their true position. I did not think there was any land taken up in this Township when I made the survey, and upon consulting with Gov. Ea- ton, J. D. Buckley and others, I concluded to make an entirely new survey of the Township, which I did by running straight lines across the Township North and South and East and West, starting from the oo u Jay D. Standard-2 exterior corner and close on the same corresponding corners on the • oposite side. I set the interior corners at the intersection of these lines. I think all of these lines were marked by a plough furrow. We did not pay any attention whatever to the few old cor- ners that were to be found. It would have been almost impossible to have set in the missing corners; as I have said there was no regularity. Some of them on the South side of the Township-were out abort ten chains; some of then being a mile and ten chains and others ten chains less than a mile apart. The surveys which I made were at that time and some time after recognized as the only surveys in the Township, but later some par- r ties found it would be to their advantage to claim their, own lines, as running from some of the old corners for-one side of their land and were willing to take my corners for the proper corners for the other side, whenever by doing so they would get more then their al- lotted number of acres. Of course the new survey , could only stand by common consent. I have good reason to think, Mr. Buckley and others did their best to have the people respect the new sur- vey, and this is what all should have done. It seemed at the time to be the only thing to do and the easiest and most practical way to avoid trouble, if all had agreed to stand by the Nettleton sur- vey, which would have given each man, very near his proper number of acres, and at the save time made straight lines and a public Ioo/may road through that beautiful valley. Standard-3 I have been in hopes all surveyors especially Oqunty survey- ors would see their way clear to pass some technical questions and contend for an equitable parceling of -the land in this Township.
