Andrew Silva, Technical Sales Engineer of Excell Services, Inc., and Kenneth Shannon, President of KS Enterprises, were interviewed at the time of qualification. 2 - Recommendation No violations. No further action. No referrals. 3 -Action/Results On 7/5/06, Investigator Mitchem was notified that Weld County Zoning Officials had recently contacted ATF in regards to Excel] Services, Inc. seeking a site for explosives storage within the county. Excel] Services, Inc. (Federal Explosives License# 5CO075339B00544) is a blasting company that is based out of Centennial, CO and has primary operations and explosives storage in Sterling, CO and Ft. Morgan, CO. The proposed Weld County storage site is located at 1760 Weld County Road 27, Brighton, CO and is owned by KS Enterprises. Excell Services, Inc. has leased property from KS Enterprises and wishes to place magazines on the site for High Explosives storage. The President of KS Enterprises, Kenneth Shannon, has given Excell Services, Inc. permission to store explosives on his property. Andrew Silva, Technical Sales Engineer for Excell Services, Inc., was seeking local and county permission to store explosives at the site before moving a magazine from the Ft. Morgan operation to Brighton. He was then going to officially license the premises through ATF. Silva stated that he did not want to invest financially in the move if the local zoning officials were not going to allow him to conduct business. Weld County Zoning Officials contacted ATF to ensure that the proposed site would adhere to the federal regulations. A zoning hearing is scheduled to take place on August 30, 2006 to rule on whether the local zoning board will permit Excell Services, Inc. to store explosives at the proposed site. Excell Services, Inc. is waiting for the results of the board hearing to move a magazine to their new business premise. Investigator Mitchem met with Andrew Silva on 7/6/06 to see the proposed place of the storage magazine. Silva said that he was going to move an 8'X 8'X 8' magazine from Ft. Morgan, CO to Brighton, CO to use as the storage magazine. Silva stated that he planned on keeping less than 600 lbs. of explosives in the Page 1 of 3 • EXPLOSIVES SPECIAL INSPECTION REPORT Name: Excell Services, Inc. Silva also stated that he hoped to have two small indoor magazines inside a business premise warehouse where he would keep additional Det. Cord and Blasting Caps not totaling over 50 lbs. in explosive materials. Silva also stated that in addition to the two indoor magazines, he would keep a Day-Box in the warehouse. Silva gave Investigator Mitchem a Plot Plan Diagram with measured distances to all nearby landmarks (Ref. to Exhibit#1) and pictures of his proposed magazines that were currently not at the proposed site (Ref. to Exhibit #2). Silva said that his outdoor Type 2 magazine would be barricaded and that it met ATF Table of Distance Requirements. The proposed outdoor magazine is a Type-2 magazine made by Bradley Metals in Canon City, CO. It measures 8'X 8' X 8'. It is made of 3/8" iron plates and lined with 3" of oak. It has two hooded locks and is vented. The licensee stated that the particular brand of magazine is used by the U.S. Forest Service and the Bureau of Alcohol, Tobacco, Firearms, and Explosives. Investigator Mitchem verified the distances from the site of proposed storage (GPS N40.02727, W 104.80886) on the Plot Plan by using a Range Finder. The following results were noted: The nearest inhabited building is a house (GPS N40.02724, W104.81012) located 300 ft. from the proposed site of outdoor explosives storage. There is a public railway located 201 ft. from the site of proposed storage. Also, there is a warehouse building that will continue to be used by KS Enterprises (GPS N40.02621, W104.80905) in daily business operations. The KS Enterprises warehouse was measured as being 333 ft. from the proposed storage location. Silva stated that if his explosives quantity is limited by Table of Distance requirements, he would look into installing a second Type-2 outdoor magazine with additional high explosives outside of the necessary regulated storage distances. Based on the Table of Distance requirements, the proposed storage location would be in compliance with Federal Regulations if the licensee did not store more than 300 lbs. of high explosives. According to 27 CFR 555.218, the licensee may not store more than 300 lbs. of high explosives because it would pose a violation of the allowable distance to a public railway, which is 201 ft. Furthermore, if the licensee decided to get a second, Type-02 outdoor magazine, based on the quantity of the first magazine, the licensee would have to have 24 ft. of separation (barricaded)between the magazines. The quantity of explosives to be stored in the second magazine would also determine its acceptability and placement at the site based on 27 CFR 555.218. r Page 2 of 3 • EXPLOSIVES SPECIAL INSPECTION REPORT Name: Excell Services, Inc. We have no objections to the proposal, however, we do recommend that the following conditions be part of any approval: We recommend that the following requirements be incorporated into the permit as development standards: 1. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended) shall be stored and removed for final disposal in a manner that protects against surface and groundwater contamination. 2. No permanent disposal of wastes shall be permitted at this site. This is not meant to include those wastes specifically excluded from the definition of a solid waste in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended. 3. Waste materials shall be handled, stored, and disposed in a manner that controls fugitive dust, fugitive particulate emissions, blowing debris, and other potential nuisance conditions. 4. The applicant shall operate in accordance with the approved "waste handling plan". 5. The applicant shall comply with all provisions of the Underground and Above Ground Storage Tank Regulations (7 CCR 1101-14). 6. Fugitive dust and fugitive particulate emissions shall be controlled on this site. The facility shall be operated in accordance with the approved dust abatement plan at all times. 7. This facility shall adhere to the maximum permissible noise levels allowed in the Industrial Zone as delineated in 25-12-103 C.R.S., as amended. 8. Adequate handwashing and toilet facilities shall be provided for employees and patrons of the facility. 9. Sewage disposal for the facility shall be by septic system. Therefore, pursuant to the State Engineer's March 4, 2005 memorandum to county planning directors, this office will only perform a cursory review of the referral information and provide comments. The comments do not address the adequacy of the water supply plan for this project or the ability of the water supply plan to satisfy any County regulations or requirements. In addition, the comments provided herein cannot be used to guarantee a viable water supply plan or infrastructure, the issuance of a well permit, or physical availability of water. According to the submitted information the site will be served by an existing well currently permitted under well no. 261608. The well is currently permitted for drinking and sanitary purposes for a commercial business and cannot be used for lawn or landscape irrigation or for any other purpose outside the business building structure. In addition the well is limited to a maximum pumping rate of 15 GPM and an annual withdrawal of 1/3 acre-foot (108,600 gallons). Therefore, the well can be used for the commercial operation as long as the well is operated in accordance with the conditions of the well permit.
