CENTER
WHEREAS,the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS,on October 15,2003,the Board of County Commissioners approved a Use by
Special Review Permit#1429, for David and Annita Alvarez, dba Bethel Family Praise Center,
820 Ponderosa Place, Eaton,Colorado 80615,for a Church,Child Care Center and Private School
on the following described real estate, to-wit:
Lot A of Recorded Exemption#3025; being part of the
NE1/4 of the NE1/4 of Section 29,Township 7 North,
Range 65 West of 6th P.M., Weld County, Colorado
WHEREAS,pursuant to certain Conditions of Approval,the Board has been presented with
a Road Maintenance and Improvements Agreement,and an Improvements Agreement According
to Policy Regarding Collateral for Improvements(Private Road Maintenance)between the County
of Weld, State of Colorado, by and through the Board of County Commissioners of Weld County,
and David and Annita Alvarez, dba Bethel Family Praise Center,with terms and conditions being
as stated in said agreement, and
WHEREAS,the Board has been presented with Check No.2108 from Bethel Family Praise
Center, P.O. Box 178, Eaton, Colorado 80615, in the amount of$3,300.00, and
WHEREAS,after review, the Board deems it advisable to approve said agreements and
accept said check as stated above, copies of which are attached hereto and incorporated herein
by reference.
NOW,THEREFORE,BE IT RESOLVED by the Board of County Commissioners of Weld
County,Colorado,that the Road Maintenance and Improvements Agreement,and the Improvements
Agreement According to Policy Regarding Collateral for Improvements(Private Road Maintenance)
between the County of Weld, State of Colorado, by and through the Board of County
Commissioners of Weld County,and David and Annita Alvarez,dba Bethel Family Praise Center,
be, and hereby is, approved.

I have reviewed both documents that you faxed to me.
The first document is the Road Maintenance and Improvements Agreement associated with dust suppressant to
be placed at various locations on WCRs 78 and 41. David Alvarez has signed this document. The Clerk to the
Board requires the original signature prior to scheduling BOCC review.
The second document is the Improvements Agreement According Policies Regarding Collateral for Improvements
(private road maintenance). This document includes, under the Exhibit A portion, handicap parking spaces to be
upgraded to the ADA Standards. The numbers look reasonable for the installation of the six spaces. Once again,
David Alvarez has signed this document.
If you have both documents with original signatures, please schedule these items and I will attend with you the
9:00 a. m. BOCC hearing.

ROAD MAINTENANCE AND IMPROVEMENTS AGREEMENT
THIS AGREEMENT, made and entered into this /0 day of Iv(`J , 2006, by and
between the COUNTY of WELD, STATE OF COLORADO, hereinafter called Cdunty.and David and
Annita Alvarez (Bethel Family Praise Center, USR-1429) hereinafter called ALVAREZ, and
WHEREAS, Alvarez has been granted a Weld County site specific development and a special
review permit for a church, childcare center, and private school in Section 29, Township 7 North,
Range 65 West of the 6th P.M.
WHEREAS, the USR generates an increase in vehicle traffic, and
WHEREAS, the existing County roads that serve the USR will require increased maintenance
and improvement due to the increase in vehicle traffic, and
WHEREAS, the County and Alvarez have reviewed maintenance and improvements proposals
put forth by Alvarez, and both parties agree that such maintenance and improvements will enhance
the accessibility and safety of the roads that serve said USR.
NOW, THEREFORE, in consideration of the mutual covenants and conditions hereinafter set
forth, the County and Alvarez agree as follows:
1. Term: The term of this agreement shall be from the date first written above to and until
Weld County Road 78 is paved.
2. Location: The county roads that serve said USR are WCR 78 and WCR 41.
3. Improvement and Maintenance to WCR 78:
A. The County shall be responsible for general maintenance, including grading and
snow removal.
B. Alvarez shall apply dust suppression chemicals on said roads, as needed, as
determined by the Department of Public Works, twice a year. Apply
approximately 300 feet in front of three existing homes along WCR 78 between
WCR 39 and WCR 41, in front of the adjacent home across from the east
entrance on WCR 41, and at both access points to the USR. The first application
will be after issuance of the certificate of occupancy.
4. No Third Party Beneficiary Enforcement: It is expressly understood and agreed that
enforcement of the terms and conditions of this Agreement, and all rights of action
relating to such enforcement, shall be strictly reserved to the undersigned parties, and
nothing contained in this Agreement shall give or allow any claim or right of actions
whatsoever by any other person not included in this Agreement. It is the express
intention of the undersigned parties that any entity other than the undersigned parties
receiving services or benefits under this Agreement shall be deemed an incidental
beneficiary only.

5. Indemnification: To the extent authorized by law, Alvarez agrees to indemnify, save,
defend, and hold harmless County from any and all liability incurred as a result of acts,
omissions, or failures to act by Alvarez in her performance of the duties set forth in this
Agreement on those portions of said roads described in this Agreement. The term
liability includes, but is not limited to, any and all claims, damages, and court awards,
including costs, expenses, and attorneys' fees, incurred as a result of any act or
omission by Alvarez and its employees.
6. Modifications and Breach: This Agreement contains the entire agreement and
understanding between the parties to this Agreement and supersedes any other
agreements concerning the subject matter of this transaction, whether oral or written.
No modifications, amendment, novation, renewal, or other alteration of or to this
Agreement shall be deemed valid or any force or effect whatsoever, unless mutually
agreed upon in writing by the undersigned parties. No breach of any term, provision, or
clause of this Agreement shall be deemed, waived, or excused, unless such waiver or
consent shall be in writing or signed by the party claimed to have waived or consented.
Any consent by any party hereto, or waiver of, a breach by any other party, whether
expressed or implied, shall not constitute a consent to, waiver of, or excuse for any
different or subsequent breach.
7. Non-Assignment: This Agreement shall not be assignable without prior written consent
of County or Alvarez, whichever is the non-assigning party.
IN WITNESS WHEREOF, the parties hereto have duly executed the Agreement the day and
year first above written.

POLICY REGARDING COLLATERAL FOR IMPROVEMENTS
(PRIVATE ROAD MAINTENANCE)
THIS AGREEMENT,made and entered into this_7th day of June ,2006 ,by and
between the County of Weld, State of Colorado, acting through its Board of County Commissioners,
hereinafter called "County," and David&Annita Alvarez hereinafter called "Applicant."

WITNESSETH:
WHEREAS, Applicant is the owner of, or has a controlling interest in the following described
property in the
County of Weld, Colorado:
Lot A,Recorded Exemption No. 0709-29-1 RE-3025,
being located within Northeast One-Quarter Section 29,
Township 7 North, Range 65 West of the Sixth Principal
Meridian, County of Weld, State of Colorado.
WHEREAS, a Final Subdivision/Planned Unit Development(PUD)plat of said property, to be
known as Bethel Family Praise Center _has been submitted to the
County for approval, and
WHEREAS, relevant Sections of the Weld County Code provide that no Subdivision Final Plat,
Planned Unit Development Final Plat, or Site Plan shall be approved by the County until the Applicant
has submitted a Subdivision Improvement Agreement guaranteeing the construction of the public
improvements shown on plans, plats and supporting documents of the Subdivision Final Plat, Planned
Unit Development Final Plat, or Site Plan, which improvements, along with a time schedule for
completion, are listed in Exhibits "A" and "B" o f this Agreement.
NOW,THEREFORE,IN CONSIDERATION OF the foregoing and of the acceptance and
approval of said Final Plat, the parties hereto promise, covenant and agree as follows:
1.0 Engineering Services: Applicant shall furnish, at its own expense, all engineering services in
connection with the design and construction of the Subdivision or Planned Unit Development
improvements listed on Exhibit "A," which is attached hereto and incorporated herein by reference.
1.1 The required engineering services shall be performed by a Professional
Engineer and Land Surveyor registered in the State of Colorado, and shall
conform to the standards an d criteria established by the County for public
improvements.

SUBJECT: USR-1429
The Department of Planning Services received a personal check for the Private Improvements
Agreement for USR-1429 (A Site Specific Development Plan and a Special Review Permit for a
Church Childcare Center and Private School in the A(Agricultural)Zone District. ).
The collateral for the Improvements Agreement is in the amount of three thousand three
hundred dollars ($3,300.00) for on-site improvements.
After review of the collateral by the Weld County Attorney, the Department of Public Works and
Department of Planning Services, it has been determined that the amount of the agreement will
be sufficient to complete the on-site improvements required for USR-1429.
