FREDERICK BOARD OF TRUSTEES
SPINDLE HILL ANNEXATIONS NO. 1 and NO. 2
NOTICE IS HEREBY GIVEN that the Board of Trustees of the Town of Frederick
has adopted Resolutions of Sufficiency initiating annexation proceedings for the Spindle
Hill Annexations No. 1 and No.1 in series, being more particularly described in the
following Resolution Nos. 06R014 and 06R015.
The Board of Trustees of the Town of Frederick will hold a Public Hearing
commencing at 7:00 o'clock P.M., Thursday May 11th, 2006, at the Frederick Town Hall,
401 Locust St. Frederick CO 80530, for the purpose of determining whether the
property proposed to be annexed in series meets the applicable requirements of the
statutes of the State of Colorado and is eligible for annexation to the Town of Frederick,
and to establish the appropriate land uses for the property, if requested.
Any person may appear at the Public Hearing and be heard regarding the
matters under consideration.
Copies of the petitions and supporting material submitted to the Town are on file
and available for public inspection in the Office of the Town Clerk, at the Frederick
Town Hall, 401 Locust St. Frederick, Colorado 80530.

PETITION FOR ANNEXATION TO THE TOWN OF FREDERICK
Date: February 6, 2006
TO: THE BOARD OF TRUSTEES OF THE TOWN OF FREDERICK, COLORADO
We, Susan J. Troudt, the Personal Representative of Marian J. Botinelli, Deceased
and Carla Johnson Hobbs, the undersigned land owners, in accordance with Colorado law
hereby petition the Town of Frederick and its Board of Trustees for annexation to the
Town of Frederick of the following described unincorporated territory in the County of
Weld and the State of Colorado, to-wit:
A portion of the southeast quarter of section 32.the southwest quarter of section 33.Township 2 North.
Range 67 West of the 6th PM and the northwest quarter of section 4.the northeast quarter of section 5.
Township 1 North,Range 67 west of the 6th PM County of Weld. State of Colorado.
as more fully described on Exhibit A attached hereto and incorporated herein.
As part of this petition, your petitioners further state to the Board of Trustees of
Frederick, Colorado that:
1. It is desirable and necessary that the territory described in Exhibit A be annexed
to the Town of Frederick.
2. The requirements of C.R.S. sections 31-12-104 and 31-12-1051 as amended, exist
or have been met in that:
a. Not less than one-sixth of the perimeter of the area proposed to be annexed is contiguous
with the Town of Frederick or will be contiguous with the Town of Frederick within
such a time as required by 31-12-104.
b. A community of interest exists between that area proposed to be annexed and the Town
of Frederick.
c. The area proposed to be annexed is urban or will be urbanized in the near future
d. The area proposed to be annexed is integrated with or is capable of being integrated with
the Town of Fredenck.
e. No land within the boundary of the territory proposed to be annexed which is held in
identical ownership, whether consisting of one tract or parcel of real estate. has been
divided into separate parts or parcels without the written consent of the landowner or
landowners thereof. unless such tracts or parcels were separated by dedicated street.
road,or public way.
f. No land within the boundary of the area proposed to be annexed which is held in
identical ownership. comprises twenty acres or more, and which. together with the
buildings and improvements situated thereon has an assessed value in excess of two
hundred thousand dollars($200.000.00) for ad valorem tax purposes for the next year
preceding the annexation. has been included within the area to be annexed without the
written consent of the landowner or landowners.
g. No annexation proceedings have been commenced for any portion of the territory
proposed to be annexed for the annexation of such territory-to another municipality.
h. The annexation of the territory proposed to be annexed will not result in the detachment
of area from any school district.
i. The annexation of the territory proposed to be annexed will not have the effect of
extending the boundary of the Town of Frederick more than three miles in any direction
from any point of the boundary of the Town of Frederick in any one year.
j. Prior to completion of the annexation of the territory proposed to be annexed, the Town
of Frederick. will have in place a plan for that area, which generally describes the
proposed: Location, character, and extent of street, subways_ bridges, waterways,
waterfronts. parkways, playgrounds, squares, parks, aviation fields, other public ways,
grounds. open spaces, public utilities, and terminals for water, light, sanitation,
transportation, and power to be provided by the Town of Frederick; and the proposed
land uses for the area;such plan to be updated at least once annually.
k. In establishing that boundary of the territory proposed to be annexed. if a portion of a
platted street or alley is to be annexed, the entire width of the street or alley has been
included within the territory to be annexed. The Town of Frederick will not deny any
reasonable access to any landowners, owners of any easement. or the owners of any
franchise adjoining any platted street or alley which is to be annexed to the Town of
Frederick but is not bounded on both sides by the Town of Frederick.
3. The owners of more than fifty percent of the area proposed to he annexed
exclusive of dedicated streets and alleys, have signed this petition and hereby
petition for annexation of such territory.
4. Accompanying this petition are four copies of an annexation map containing the
following information:
a. A written legal description of the boundaries of the area proposed to be annexed:
b. A map showing the boundary of the area proposed to be annexed,said map prepared and
containing the seal of a registered engineer;
c. Within the annexation boundary map.a showing of the location of each ownership tract
in unplatted land and. if part or all of the area is planed the boundaries and the plat
numbers of plots or of lots and blocks:
d. Next to the boundary of the area proposed to be annexed. a drawing of the contiguous
boundary of the Town of Frederick and the contiguous boundary of any other
municipality abutting the area proposed to be annexed.and a showing of the dimensions
of such contiguous boundaries.
5. Upon the Annexation Ordinance becoming effective, all lands within the area
proposed to be annexed will become subject to all ordinances, rules and
regulations to the Town of Frederick which shall become effective as the January
1 next ensuing.
6. The zoning classification requested for the area proposed to be annexed is
agricultural.
7, The area proposed to be annexed is presently included in Town services and
water conservancy districts, or the petitioners consent to the inclusion of the area
proposed to be annexed in Town services and water conservancy districts the
Northern Colorado Water Conservancy District, Carbon Valley Recreation
District, Frederick Fire Protection District and Tri-Area Sanitation District.
8. Petitioners waive the right to election to the Town of Frederick.
9. Petitioners agree to pay all due and unpaid taxes, if any.

ANNEXATION TO BE KNOWN AS THE"SPINDLE HILL ANNEXATION NO.
1."
WHEREAS,petitions for annexation of certain properties have been filed with the Board of
Trustees of the Town of Frederick by Johnson Farms, LLP, 14491 Weld County Rd. 5,Longmont, CO
80504; and
WHEREAS,the Board of Trustees has reviewed the petitions; and
WHEREAS,the Board of Trustees wishes to permit simultaneous consideration of subject
property for annexation and zoning, if requested in the petition;and
WHEREAS,the Board of Trustees has reviewed the petitions'and desires to adopt by Resolution
its findings in regard to the petitions;
BE IT RESOLVED BY THE BOARD OF TRUSTEES OF THE TOWN OF FREDERICK,
COLORADO,AS FOLLOWS:
Section I. The petition,whose legal description is attached hereto as Exhibit A and
incorporated by reference herein,is in substantial compliance with the applicable laws of the State of
Colorado.
Section 2. No election is required under C.R.S. §31-12-107(2).
Section 3. No additional terms and conditions are to be imposed except those provided for
in the petitions.
Section 4. The Board of Trustees will hold a public hearing for the purpose of determining
if the proposed annexation complies with C.R.S. §31-12-104,and with C.R.S. §31-12-105, and will hold
a public hearing to determine the appropriate zoning of the subject properties if requested in the petition,
at the Frederick Town Hall,401 Locust,Frederick,Colorado 80516,at the following time and date:
May 11th,2006, 7:00 P.M.
Section 5. Any person may appear at such hearing and present evidence relative to the
proposed annexation or the proposed zoning.
Section 6. Upon completion of the hearing,the Board of Trustees shall set forth,by
resolution,its findings and conclusions with reference to the eligibility of the proposed annexation,and
whether the statutory requirements for the proposed annexation have been met, and further,will
determine the appropriate zoning of the subject property if requested in the petition.
Section 7. If the Board of Trustees concludes,by resolution,that all statutory requirements
have been met and that the proposed annexation is proper under the laws of the State of Colorado,the
Board of Trustees shall pass one or more ordinances annexing the subject property to the Town of

Forward:
This "annexation impact report"has been prepared pursuant to Section 31-12-108.5
Colorado Revised Statues, 1986 Repl. Vol. Contained in Exhibit"A" is a map depicting
the proposed annexation,the existing and proposed public services to the property and
the existing and proposed land use for the property.
I. Project Description:
The property proposed for annexation consists of two parcels including some of Highway
52, WCR 14 and WCR 17 containing approximately 475 acres and is in two pieces
Annexation I is located East of the Savannah Subdivision,North of Highway 52 and
WCR 14, West of WCR 17 or the Southeast quarter of Section 32, Township 2, Range
67. The annexation is contiguous to the Town of Frederick, the line of contiguity runs
along the south eastern boundary of the Town, where the Savannah Subdivision ends and
along Highway 52 and WCR 14, this satisfies the 1/6 contiguity with the Town
boundaries required by the statute.
The land proposed to be annexed is owned by Susan Troudt, Carla Hobbs and the
Personal Representative of Marin Botinelli (Deceased). 14491 Weld County Road 5,
Longmont, CO 80504
This site will be divided into two Annexations: Annexation I and Annexation II to create
1/6 contiguity with the Town. Annexation I will be one parcel and will contain
aproximatley167 acres, including WCR 14 and WCR 17. This parcel will not be
developed at this time, the owners may request future development to occur. This
property should be annexed to the Town because it will extend the Town's area of
influence without the necessity of providing any infrastructure to the property and it also
extends the Town's boundary along Highway 52 and along WCR 14. This area would
also fit into the Comprehensive Plan for the Town of Frederick by creating buffer and
allowing for future development along Highway 52. The land is currently zoned
Agriculture in Weld County. In conjunction with the proposed annexation the zoning will
remain Agriculture in conformance with the Town's Zoning Code. Adjacent land uses
include Agriculture and Residential.
II. Municipal Services:
Municipal services for the Spindle Hill Energy Center Annexation will be provided the
following manner.
Electricity There will be no need for electrical services for this property due to
the fact that there are no dwellings on the property or need for
them on agricultural land.
Telephone There will be no need for telephone service on this property due to
no dwelling or need for them on agricultural land.
Water This property is not currently served with water and until it is
developed it will not need water service.
Sanitary Sewer This property will not need sanitary sewer because it is
Agricultural land and has no dwellings upon it. Although if it is
developed in the future it may need sewer service.
Fire This property will be protected by the Frederick Firestone Fire
District upon annexation. This property will be included into the
district upon annexation.
Police The Town of Frederick
Maintenance Maintenance of roadways within the annexation will be provided
by the Town after construction in accordance with the Town
specifications and acceptance by the Board of Trustees.
Financing the municipal services within the area to be annexed will be addressed, in an
annexation agreement between the applicant and the Town of Frederick. The annexation
agreement is currently under negotiation and is not available at this time.
III. Special Districts:
The area to be annexed is included within the following special districts:
St. Vrain Valley School District, R-1J (Excluded)
Frederick Firestone Fire District(Included)
Northern Colorado Water Conservancy District(Included)
Tri- Area Sanitation District(Included)
Central Weld Water District(Included)
Weld County Library District (Included)
Carbon Valley Recreation District(Included)
IV. School District Impact:
It is anticipated that the annexation will bring a benefit of the St. Vrain Valley School
District R-1J due to the increase in valuation, and will contribute 0 K-12 students to the
school system. Spindle Hill Energy Center, LLC will contribute$50,000 per year for the
life of the power purchase agreement to the St. Vrain School District R-1J to fund a
teacher in the Frederick feeder school system.

Forward:
This "annexation impact report"has been prepared pursuant to Section 31-12-108.5
Colorado Revised Statues, 1986 Repl. Vol. Contained in Exhibit"A" is a map depicting
the proposed annexation, the existing and proposed public services to the property and
the existing and proposed land use for the property.
I. Project Description:
The property proposed for annexation consists of two parcels including some of WCR 14
and WCR 17 containing approximately 475 acres and is in two pieces Annexation II is
located East of WCR 17,North of WCR 14, West of WCR 17 or the South half of
Section 33, Township 2, Range 67. The annexation is contiguous to the Town of
Frederick,the line of contiguity runs along the south eastern boundary of the Town,
where the Johnson Farms/Spindle Hill Energy Center Annexation I ends and along WCR
14, this satisfies the 1/6 contiguity with the Town boundaries required by the statute.
The land proposed to be annexed is owned by Susan Troudt, Carla Hobbs and the
Personal Representative of Mann Botinelli (Deceased). 14491 Weld County Road 5,
Longmont, CO 80504.
This site will be divided into two Annexations: Annexation I described in a separate
Annexation Impact Report and Annexation II, to create 1/6 contiguity with the Town.
Annexation I will be one parcel and will contain approximately 305 acres, including
WCR 14. 308 acres Spindle Hill Energy, LLC, a wholly owned subsidiary of Invenergy,
LLC, will be purchasing approximately 100 acres of which approximately 35 acres will
be zoned industrial and 65 acres will be zoned agricultural and will be placed under a
conservation easement. The remaining 205 aces will be undeveloped at this time and
remain zoned agricultural, but may be changed in the future. This property should be
annexed to the Town because it will extend the Town's area of influence. It also extends
the Town's boundary along Highway 52 and along WCR 14. This area also fits into the
Comprehensive Plan for the Town of Frederick by creating buffer with approximately
75%of the 100 acres purchased becoming open space. It will also bring ongoing tax
revenue, $150,000 for ball fields to the Carbon Valley Rec. District, $10,000 for a
playground, and water rights to the Town of Frederick. The land is currently zoned
Agriculture in Weld County. In conjunction with the proposed annexation the zoning 35
acres will change to be zoned Industrial and the remaining 270 acres will remain zoned
Agriculture in conformance with the Town's Zoning Code. Of this 270, 65 acres will be
put under a conservation easement. Adjacent land uses include Agriculture, Commercial
and Industrial.
II. Municipal Services:
Municipal services for the Spindle Hill Energy Center/Johnson Farms Annexation II will
be provided the following manner.
Electricity Will be provided by United Power.
Telephone Qwest Communications
Water Town of Frederick—in negotiations. It is anticipated that
Invenergy will build a 12" line water to the power plant. Water
will be provided by the Town.
Sanitary Sewer Tri- Area Sanitation will provide primary service by an individual
septic system specific to our site. The property will be required to
connect to the St. Vrain Sanitation District's sewer system when it
becomes available.
Fire This property will be protected by the Frederick Firestone Fire
District upon annexation. This property will be included into the
district upon annexation.
Police The Town of Frederick
Maintenance Maintenance of roadways within the annexation will be provided
by the Town after construction in accordance with the Town
specifications and acceptance by the Board of Trustees.
Financing the municipal services within the area to be annexed is to be addressed in an
annexation agreement between the applicant and the Town of Frederick. The annexation
agreement is currently under negotiation and is not available at this time.
III. Special Districts:
The area to be annexed is included within the following special districts:
St. Vrain Valley School District, R-1J (Excluded)
Frederick Firestone Fire District(Included)
Northern Colorado Water Conservancy District (Included)
Tri- Area Sanitation District(Included)
Central Weld Water District(Included)
Weld County Library District(Included)
Carbon Valley Recreation District(Included)
IV. School District Impact:
It is anticipated that the annexation will bring a benefit of the St. Vrain Valley School
District R-1J due to the increase in valuation, and will contribute 0 K-12 students to the
school system. Spindle Hill Energy Center, LLC will contribute $50,000 per year for the
life of the power purchase agreement. to the St. Vrain School District R-1J to fund a
teacher in the Frederick feeder school system. '
