HomeMy WebLinkAbout20063134.tiff RESOLUTION RE: AUTHORIZATION FOR THE WELD COUNTY ATTORNEY TO PROCEED WITH LEGAL ACTION AGAINST JAMES AND BETTY HORN FOR VIOLATION OF THE WELD COUNTY CODE WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, James and Betty Horn, VI #0500353, are allegedly in violation of the Weld County Code, and WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has not been corrected, and WHEREAS, on the 14th day of November, 2006, a public hearing was held before the Board of County Commissioners for the purpose of hearing testimony relating to said violation, and WHEREAS, James Horn, property owner, was present at said hearing, and WHEREAS,the Board of County Commissioners deems it advisable to refer said violation to the Weld County Attorney's Office for legal action, with an instruction for delay of action upon such referral until January 14, 2007, to allow adequate time for the property owners to restore, remove or screen the noncommercial junkyard from all adjacent properties and public rights-of-way, and to reduce the commercial vehicles to one or submit the appropriate permits to bring the subject property into compliance and for an inspection of the property by the Department of Planning Services staff. Again, this will only allow you to permit 1 (one) Commercial Vehicle. For your convenience, I have enclosed this application. ► I did note the brown car(which appears to be in derelict condition), a green truck (which appeared to have flat tires,thus in derelict condition) and a pile of pallets. Please see enclosed picture. This hearing will take place in our Hearing Room, located at 918 10th Street, Greeley, Colorado.
