HomeMy WebLinkAbout20062683 RESOLUTION RE: APPROVE MEMORANDUM OF UNDERSTANDING AND AUTHORIZE CHAIR TO SIGN- WELD COUNTY JUVENILE ASSESSMENT CENTER WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS,the Board has been presented with a Memorandum of Understanding between the County of Weld, State of Colorado, by and through the Board of County Commissioners of Weld County, on behalf of the Department of Social Services, and the Weld County Juvenile Assessment Center,commencing upon full execution,and ending one yearfrom date of execution, with further terms and conditions being as stated in said Memorandum of Understanding, and WHEREAS, after review, the Board deems it advisable to approve said memorandum, a copy of which is attached hereto and incorporated herein by reference. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, ex-officio Board of Social Services, that the Memorandum of Understanding between the County of Weld, State of Colorado, by and through the Board of County Commissioners of Weld County, on behalf of the Department of Social Services, and the Weld County Juvenile Assessment Center be, and hereby is, approved. BE IT FURTHER RESOLVED by the Board that the Chair be, and hereby is, authorized to sign said Memorandum of Understanding. Griego, Director, Social Services C� RE: Memorandum of Understanding Concernin the Weld County Juvenile Assessment Center Enclosed for Board approval is a Memorandum of Understanding Concerning the Weld County Juvenile Assessment Center. This Memorandum of Understanding was reviewed at the Board's Work Session held on August 28, 2006. The purpose of the Memorandum of Understanding is to outline agreements between the Juvenile Assessment Center and the Weld County Department of Social Services regarding the use of the Department's FTE at the JAC. The term of the Memorandum of Understanding is from the date signed by representatives of both participating agencies and will renew automatically each year, unless either party provides written notification to terminate the agreement. If you have any questions, please telephone me at extension 6510. 2006-2683 • MEMORANDUM OF UNDERSTANDING CONCERNING THE WELD COUNTY JUVENILE ASSESSMENT CENTER The Weld County Juvenile Assessment Center(JAC) and the Weld County Department of Social Services(DSS) hereby enter into this Memorandum of Understanding and agree as follows: 1. The JAC is a collaborative, multi-agency, single entry site which contributes to the safety of youth, families and the community through prevention, intervention, comprehensive assessments and improved access to services. 2. The Department of Social Services is a partner agency with the JAC in this community-wide endeavor, and as such, has agreed to provide staffing support for the JAC facility equivalent to one full time employee (FTE, 40 hours per work week) as a maximum hourly FTE commitment and adjusted according to community usage. Community usage is defined by the caseload average served by the FTE. The FTE will be the employee of DSS. DSS will be responsible for it's employees pay, benefits and other compensation and any specialized equipment or resources to access DSS related data base/case management systems, as necessary. 3. The JAC will provide DSS personnel assigned to the JAC: a safe work site, a suitable work station area, general office supplies, access to general office equipment, to include a computer with Internet access, telephone, fax machine and photo copier; training and use of JAC protocols for the assessment, referral and case management of persons receiving services through the JAC and; daily work assignments and functional supervision. 4. The Department of Social Services will provide the JAC: A. In-Kind personnel to conduct assessment, referral and case management services required by JAC protocol; and B. A DSS supervisor who will provide the direct supervision of DSS personnel and liaison to the JAC fro purposes of communication, problem solving and coordination. 5. The JAC will provide work schedules for DSS personnel assigned to the JAC which will be agreed upon jointly by the DSS supervisor and the JAC director, subject to change by mutual agreement and based on the needs of both organizations. Current work shifts are Monday through Friday, 10:00 am to 6:00 pm. 6. The JAC will provide and be responsible fro the cost of any translation services necessary for non-English speaking clients. 7. Policy/Protocol Conflicts- In the event DSS personnel assigned to the JAC encounter a policy or protocol that conflicts with DSS policy, the DSS employee will report the conflict to the JAC director and his or her DSS supervisor. The JAC director and DSS supervisor will review the issue and resolve it in a mutually agreeable manner. dace-a68.3 8. Confidentiality- Information sharing is a key component to the success of evaluating the needs of JAC clients, delivering integrated services and reducing the duplication of services by partner agencies. To further this endeavor, DSS and JAC will share information on JAC clients contained in their respective data base systems, as allowed by law and with a written Release of Information form authorized by the Interagency Oversite Group(IOG) under HB04-1451 and signed by a parent/legal guardian of the juvenile client. All information obtained through this manner is confidential and may not be disseminated to the public or released outside the JAC, unless such further release is authorized by written consent of the juvenile client's parent/legal guardian. 9 Liability- The DSS and JAC acknowledge that applicable Colorado state laws govern liability for negligent or wrongful acts or omissions committed by its employees while participating in activities under this MOU. Liability for negligent or willful acts of personnel from either DSS or JAC, undertaken outside the terms of this agreement, will be the sole responsibility of the respective employee and their agency. 10. Duration- The term of this MOU is for one year from the date signed by representatives of both participating agencies and will renew automatically each year, unless either party submits written notification to the other party to terminate this agreement. The written notice to terminate this agreement must be submitted at least 30 days prior to the termination date. 11. Modification- This MOU may be modified at any time by mutual consent of both participating agencies. Modifications to this MOU shall have no force or effect until such modifications are in writing and signed by authorized representatives of each participating agency. 12. Participating Agency Signatures- By signing this Memorandum of Understanding each agency agrees to the conditions set forth herein.
