RE: AUTHORIZATION FOR THE WELD COUNTY ATTORNEY TO PROCEED WITH LEGAL
ACTION AGAINST MENDELL MENG FOR VIOLATION OF THE WELD COUNTY CODE
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS,Mendell Meng,VI#0500015, is allegedly in violation of the Weld County Code,
and
WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has
not been corrected, and
WHEREAS, on the 12th day of September, 2006, a public hearing was held before the
Board of County Commissioners for the purpose of hearing testimony relating to said violation, and
WHEREAS, Kelly Helzer, tenant, was present at said hearing, and
WHEREAS,the Board of County Commissioners deems it advisable to refer said violation
to the Weld County Attorney's Office for legal action, with an instruction for delay of action upon
such referral until March 12, 2007, to allow adequate time for the tenant to restore, remove or
screen the noncommercial junkyard from all adjacent properties and public rights-of-way, and to
provide proof of permits being issued on the mobile home to bring the subject property into
compliance and for an inspection of the property by the Department of Planning Services staff.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that VI #0500015 be, and hereby is, referred to the Weld County Attorney's
Office for legal action against Mendell Meng to remedy the violation of the Weld County Code, and
any other persons occupying the properties, any persons claiming an interest in the properties, and
any persons acting in active concert with the identified parties,with an instruction for delay of action
upon such referral until March 12, 2007, to allow adequate time for the tenant to restore, remove
or screen the noncommercial junkyard from all adjacent properties and public rights-of-way, and
to provide proof of the mobile home being permitted to bring the subject property into compliance.

Dear Mr. & Mrs. Meng:
The property referenced above remains in violation of the Weld County Code. I have scheduled a
meeting with the Board of County Commissioners on September 12,2006 at 10:00 a.m., to consider
the violations occurring on the property. The above mentioned property remains in violation of the
following Section(s) of the Weld County Code:
Chapter 23, Article Ill, Div 1 "A(Agricultural) Zone District"
Section 23-3-20 "Uses allowed by right"
Section 23-3-20.8 "One (1) Single-Family Dwelling Unit and Auxiliary Quarters on a
parcel of land created under the provisions of Chapter 24, Article VIII of this Code."
Section 23-3-30 "Accessory Uses"
Section 23-3-30.1 "Noncommercial Junkyard"
To bring the property into compliance:
The"Noncommercial Junkyard"consisting of derelict vehicles and miscellaneous debris
shall be removed, restored or completely screened from all adjacent properties and all
public road rights-of-ways. The derelict mobile shall either be restored or removed from
the property.
If the property is currently in compliance please call and schedule an inspection with me
so that I may close this violation case; otherwise, should I not hear from you or the
property remains out of compliance then we will proceed with the violation hearings.
DERELICT MANUFACTURED(MOBILE)HOME: A Manufactured(Mobile)Home that
is partially or totally damaged by fire, earthquake,wind or other natural causes,or is in a
state of general dilapidation, deterioration or decay resulting from improper lack of
maintenance, vandalism or infestation with vermin or rodents. Any such Derelict
Manufactured (Mobile) Home shall be returned to and maintained in the condition as
originally established on site and as inspected by the Building Inspection Department,or
it shall be removed from site.
NONCOMMERCIAL J" WARD: An area where any waste, j or used or
secondhand materials a c.stored or handled, including but not limited to scrap iron and
other metals,paper, rags, rubber tires,building materials and bottles. A Noncommercial
Junkyard may also include the storage or keeping of DERELICT VEHICLES registered
last or currently registered under the property owner and/or tenant's name. This
definition does not include Commercial Vehicles. If the Zone district allows, the
Noncommercial Junkyard shall be totally enclosed within a building or structure or
visually screened from all adjacent properties and public rights-of-way.
DERELICT VEHICLE: A vehicle that is inoperable (unable to move under its own
power); is partially or totally dismantled; has all or portions of its body work missing or is
substantially damaged; is not registered with the State,as required by Section 42-3-103,
C.R.S., or by Section 42-3-138 or 42-12-102, C.R.S., and/or the number plate assigned
to it is not permanently attached to the vehicle, as required by Section 42-3-123,C.R.S.,
or is lacking proper equipment to the extent that it would be unsafe or illegal to use on
public road rights-of-way or otherwise not equipped with lamps and other equipment as
required in Sections 42-4-202 to 42-2-227, C.R.S. This definition shall not include
implements of husbandry, farm tractors or vehicles customarily operated in a farming
operation.
JUNK: Scrap brass, iron, lead, tin, zinc; all other scrap metals and alloys; bones;rags;
used cloth, rope, rubber, tinfoil, bottles, old or used machinery of any type; used tools;
used appliances; used lumber or crates; building materials; fabrication of any material;
used pipe or pipe fittings; used conduit or conduit fittings; used automobile parts;
DERELICT VEHICLES; used tires and other manufactured goods that are so worn,
deteriorated or obsolete as to make them unusable in their existing condition.
SCREENED: Construction and maintenance of fences, earth berms or the use of
landscaping materials or other materials used with the approval of the Department of
Planning Services to lessen the noise, light, heat or visual impacts of a use on
surrounding uses. A Screening Plan shall be submitted and approved by the
Department of Planning Services.
This hearing will take place in our Hearing Room, located at 918 10th Street, Greeley, Colorado. It is
recommended that you or a representative be in attendance to answer any questions the Board of
County Commissioners might have about the violations.
Please also be advised that I will be taking video and/or pictures from the road or adjacent properties
the business day before or as soon as possible to the above mentioned Violation Hearing date.
The Department of Planning Services' staff will be recommending that the Board of County

We are currently in the process of trying to close some of our older violation cases. In doing
so it was noted that the violation on the above mentioned property has not been closed. It
appears the violation was initiated because of the presence of a"Noncommercial Junkyard"
consisting of derelict vehicles and miscellaneous debris. It was also noted in the file that
there was a derelict mobile home on the property that either needed to be restored and
permitted or removed from the property.
If the property is currently in compliance please call and schedule an inspection with me so
that I may close this violation case. Otherwise, should I not hear from you or the violation has
not been taken care of, a violation hearing will be scheduled.

Bethany: I received a complaint about illegal burning on a property north of Galeton. This property is parcel #
071120000031. I was told that a lot of junk has accumulated on this property such as delapidated mobile homes,
cars/vehicles and "garbage."
I am heading out there maybe on Wednesday, as tomorrow is already full.
Do you wish to go with me, or do you want me to report back to you.
To give you an idea of where this is: It is directly north of the Galeton Dairy (Faulkner) and almost directly south
of a pork (pig)farm.
Maybe with the parcel #you can find this on the county map.

Ya can get to this place thusly:
Go to Galeton. Go north out of Galeton on WCR 51. Go north of the Gaeton Dairy.
On the east side of"51" you will see a sheep operation (lots of sheep and onions in a field to the east of 51). This
operation is 38204 WCR 51. (You'll see a blue colored "N" on one of the outbuildings).
Go north a short distance (maybe a tenth of a mile)from this ovine operation. You will see on the east side of the
road a "Holstein" mailbox that is supported by a "Holstein" milk can buried in the road-side. This is @ a driveway
that leads to the east. Bordering the driveway also is a white mailbox.
The property that is of interest is way back east from 51 (maybe 1/2 mile)where there is a red brick silo that you
can see from the road. This property is accessed from this rough driveway. You will know you are on the proper
driveway as up toward the top of the hill (0.2 miles or so is a bridge)that goes over an irrigation ditch that has a
wood deck but no protective side rails.
I am just now looking at my schedule tomorrow. I probably can not go with you on Wednesday. I have a meeting
in Loveland at 09:30 am and will not be back until noon or so. I then have a scheduled inspection at 1:00. I could
go with you early Thursday morning before I must go to Denver for a 1pm meeting Thursday afternoon.

Bethany: I received a complaint about illegal burning on a property north of Galeton. This property is parcel #
071120000031. I was told that a lot of junk has accumulated on this property such as delapidated mobile homes,
cars/vehicles and "garbage."
I am heading out there maybe on Wednesday, as tomorrow is already full.
Do you wish to go with me, or do you want me to report back to you.
To give you an idea of where this is: It is directly north of the Galeton Dairy (Faulkner) and almost directly south
of a pork (pig) farm.
Maybe with the parcel #you can find this on the county map.

I did a "drive through" visit this morning of property located out north of Galeton about which I
wrote to you last week. The property is parcel # 071120000031. It is located east of WCR 51
and must be accessed by a rough access driveway that has a rickety old bridge over an
irrigation ditch. The bridge has no side rails.
Any way, this property is owned by Meng, Mendell E. Jr. and Kelly L. 4300 Butte Road, Loveland, CO 80537.
I understand that a relative of the Meng's lives on this property. Their name maybe "Helzer."
I went there to investigate a neighborly concern about illegal burning of"garbage" after dark on weekends.
But there may be other problems:
1. There are at least two 5th-wheels on site that look to be primary residences for two different people/families;
2. There are many trashed out mobile homes, cars/vehicles, that are on property and just creating messes;
3. Just lots of junk.
Is this something that you would want to "jointly" investigate and address?
