HomeMy WebLinkAbout20062006.tiff HEARING CERTIFICATION DOCKET NO. 2006-48 RE: SITE SPECIFIC DEVELOPMENT PLAN AND USE BY SPECIAL REVIEW PERMIT#1557 FOR AN OIL AND GAS PRODUCTION FACILITY IN A PLANNED UNIT DEVELOPMENT WITH C-3 AND I-1 (COMMERCIAL AND INDUSTRIAL) ZONE DISTRICTS - ZEEK PARTNERSHIP, LTD., C/O KERR-MCGEE OIL AND GAS ONSHORE, LP A public hearing was conducted on July 26, 2006, at 10:00 a.m., with the following present: Commissioner M. J. Geile, Chair Commissioner David E. Long, Pro-Tem Commissioner William H. Jerke Commissioner Robert D. Masden Commissioner Glenn Vaad Also present: Acting Clerk to the Board, Jenny Luna Assistant County Attorney, Cyndy Giauque Planning Department representative, Jacqueline Hatch Health Department representative, Char Davis Public Works representative, Don Carroll The following business was transacted: I hereby certify that pursuant to a notice dated July 7,2006, and duly published July 12,2006, in the Fort Lupton Press, a public hearing was conducted to consider the request of Zeek Partnership, Ltd., do Kerr-McGee Oil and Gas OnShore, LP,for a Site Specific Development Plan and Use by Special Review Permit#1557 for an Oil and Gas Production Facility in a Planned Unit Development with C-3 and I-1 (Commercial and Industrial) Zone Districts. Cyndy Giauque, Assistant County Attorney, made this a matter of record. Jacqueline Hatch, Department of Planning Services, presented a brief summary of the proposal and entered the favorable recommendation of the Planning Commission into the record as written. She stated the site, consisting of five acres, is located one-half mile east of Interstate 25, and adjacent to Weld County Road 32. She stated the surrounding properties to the north and to the east are agricultural,and Rademacher Business Park is located south and west of the site. She further stated referrals were sent to ten agencies, and no response was received from the Oil and Gas Conservation Commission. Ms. Hatch stated the site is located within the three-mile referral area for the Towns of Mead and Firestone, and the City of Longmont, and the Town of Mead has requested that the Board of Commissioners require the applicant to petition for annexation. She stated a letter was received from a surrounding property owner, regarding concerns with negative impacts,adequate emergency services,access to the site for heavy equipment, restrictions of oil and mining operations within the covenants of the 1-25 Business Park, and the health, safety, and welfare of current and future residents. Ms. Hatch displayed photographs of the site and surrounding areas. In response to Chair Geile, Ms. Hatch stated staff believes the concerns raised in the letter from the surrounding property owner have been addressed through the Conditions of Approval and Development Standards. 2006-2006 PL1849 fie fw 71/4— G HEARING CERTIFICATION-ZEEK PARTNERSHIP, LTD., CIO KERR-MCGEE OIL AND GAS ONSHORE, LP (USR #1557) PAGE 2 Char Davis, Department of Public Health and Environment,stated the applicant will comply with the requirements of the Air Pollution Control Division,and the applicant shall provide bottled water and portable toilets during construction and drilling activities. Don Carroll, Department of Public Works, stated the site will be accessed from Weld County Road 32, which is maintained by the Town of Mead. He stated no internal access from Camelot Circle will be allowed. He further stated staff has been working with the applicant regarding drainage issues through the Site Plan Review for the placement of a cold storage facility located on Lots 5 and 6. Matt Miller, Kerr-McGee Oil and Gas OnShore, LP, represented the applicant and stated the company is no longer known as Kerr-McGee Rocky Mountain Corporation, LLC. He stated the applicant was granted an early release of permits, and the tank batteries are currently being constructed and are near completion. In response to Chair Geile, Mr. Miller stated the applicant is the mineral owner of the property, not the surface owner;therefore,a petition for annexation cannot be filed with the Town of Mead. Further responding to ChairGeile,Mr.Miller stated he has reviewed and concurs with the Conditions of Approval and Development Standards as proposed. In response to Commissioner Masden, Mr. Miller stated five wells will be placed within one pad site which encompasses the northwest quarter section, and the wells will be directionally drilled. He further stated a Surface Use Agreement has been obtained with Ken Williamson, the surface owner. No public testimony was offered concerning this matter. Commissioner Vaad moved to approve the request of Zeek Partnership, Ltd., c/o Kerr-McGee Oil and Gas OnShore, LP, for a Site Specific Development Plan and Use by Special Review Permit #1557 for an Oil and Gas Production Facility in a Planned Unit Development with C-3 and I-1 (Commercial and Industrial)Zone Districts, based on the recommendations of the Planning staff and the Planning Commission, with the Conditions of Approval and Development Standards as entered into the record. The motion was seconded by Commissioner Masden, and it carried unanimously.
