USR-1570 1. A building permit shall be obtained prior to the construction of buildings or structures including the office building. 2. A plan review is required for each building for which a building permit is required. Plans shall bear the wet stamp of a Colorado registered architect or engineer.Two complete sets of plans are required when applying for each permit. 3. Buildings shall conform to the requirements of the various codes adopted at the time of permit application. Currently the following has been adopted by Weld County: 2003 International Building Code; 2003 International Mechanical Code; 2003 International Plumbing Code; 2003 International Fuel Gas Code; and the 2005 National Electrical Code and Chapter 29 of the Weld County Code. 4. The office will require an engineered foundation based on a site-specific geotechnical report or an open hole inspection performed by a Colorado registered engineer. Engineered foundations shall be designed by a Colorado registered engineer. 5. The structure will probably be classified as B (Office) occupancy. Fire resistance of walls and openings, construction requirements, maximum building height and allowable areas will be reviewed at the plan review. Setback and offset distances shall be determined by the Zoning Ordinance. 6. Building height shall be measured in accordance with the 2003 International Building Code for the purpose of determining the maximum building size and height for various uses and types of construction and to determine compliance with the Bulk Requirements from Chapter 23 of the Weld County Code. Building height shall be measured in accordance with Chapter 23 of the Weld County Code in order to determine compliance with offset and setback requirements. When measuring buildings to determine offset and setback requirements,buildings are measured to the farthest projection from the building. Property lines shall be clearly identified and all property pins shall be staked prior to the first site inspection. 7. Photos are attached and in a folder on the M drive\Planning and Development Review folder\subfolder for the USRs \USR-Petro. Observations during the site visit are that PetroCanada include heavy equipment actively grading and working the bare soil areas — grading and turning what we were told are contaminated soils. As can be seen in the photographs, the area of active soil workings are fenced off by a chain link fence. No temporary erosion or sediment controls such as bales or silt fencing are visible. No permanent erosion or sediment controls are visible either—there is no diking or sediment pond on the downslope side of the active soil evaporation pad areas. There were no erosion or sediment controls around the high soil stockpile either. The active soil evaporation pad area exceeds 10 acres of disturbed bare soil surface. This surface, on the existing 4% slopes are highly likely to erode under even moderate rainfall. As can be seen on the photographs and on the County's GIS topographic maps and on the display provided by PetroCananda's engineer/Surveyor (King) the site drains to the west towards the Bohlender Lateral Ditch and across the ditch to WCR 49. No man-made drainage features were seen at the site. The runoff from the active soil evaporation pad areas will flow downslope toward the Bohlender Lateral Ditch and across the ditch to WCR 49. The water running off the oilfield waste soils on PetroCanada's property make pick up metals, hydrocarbons, and other contaminants. Water flowing in the Bohlender Lateral Ditch would convey this contaminated runoff to other properties. The drainage across the Bohlender ditch would flow to WCR 49 and release the contaminated runoff to land to the west. 7/31/2006 Page 2 of 2 PetroCanada has hopefully complied with Colorado Department of Public Health and Environment and Colorado Oil and Gas Commission requirements (see attached). The Stormwater Management Plan for the site should be reviewed for compliance with surface water quality protections as part of Weld County's evaluation of this USR application. Temporary erosion or sediment controls should be installed immediately. Permanent erosion or sediment controls, such as a downslope detention and water quality pond should be required before granting any new USR requests. David Bauer, P.E. We have no objections to the proposal, however, we do recommend that the following conditions be part of any approval: We recommend that the following requirements be met prior to allowing the plat to be recorded: 1. The applicant shall submit a dust abatement plan for review and approval, to the Environmental Health Services, Weld County Department of Public Health & Environment. We recommend that the following requirements be incorporated into the permit as conditions that must be met one month prior to construction activities: 1. A stormwater discharge permit may be required for a development/redevelopment /construction site where a contiguous or non- contiguous land disturbance is greater than or equal to one acre in area. Contact the Water Quality Control Division of the Colorado Department of Public Health and the Environment at www.cdphe.state.co.us/wq/PermitsUnit for more information. We recommend that the following requirements be incorporated into the permit as conditions that must be met prior to the issuance of the Certificate of Occupancy: 1. An individual sewage disposal system is required for the proposed pre- manufactured office building(s) and shall be installed according to the Weld County Individual Sewage Disposal Regulations. 2. The septic system is required to be designed by a Colorado Registered Professional Engineer according to the Weld County Individual Sewage Disposal Regulations. We recommend that the following requirements be incorporated into the permit as development standards: 1. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended) shall be stored and removed for final disposal in a manner that protects against surface and groundwater contamination. 2. No permanent disposal of wastes shall be permitted at this site. This is not meant to include those wastes specifically excluded from the definition of a solid waste in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended. 3. Waste materials shall be handled, stored, and disposed in a manner that controls fugitive dust, fugitive particulate emissions, blowing debris, and other potential nuisance conditions. 4. Fugitive dust and fugitive particulate emissions shall be controlled on this site. The facility shall be operated in accordance with the approved dust abatement plan at all times. 5. This facility shall adhere to the maximum permissible noise levels allowed in the Industrial Zone as delineated in 25-12-103 C.R.S., as amended. 6. Sewage disposal for the facility shall be by septic system. Any septic system located on the property must comply with all provisions of the Weld County Code, pertaining to Individual Sewage Disposal Systems. 7. Adequate handwashing and toilet facilities shall be provided for employees and visitors of the facility. 8. The facility shall utilize the existing public water supply. (Central Weld County Water District) 9. The Weld County Public Works Department has reviewed this proposal. This project falls primarily under the purview of the Use by Special Review Standards, Weld County Code, Chapter 23, Article II, Division 4, Section 23. Our comments and requirements are as follows: COMMENTS: I have been to the site on a previous (USR-1517) dealing with the contaminated soil stockpile area. At that time, I was aware that the original office facility would be relocating to a different location on the site. WCR 36 is a local gravel road and requires a 60-foot right-of-way at full build out. There is presently a 60-foot right-of-way. This road is maintained by Weld County. Pursuant to the definition of SETBACK in the Weld County Zoning Ordinance (23- 1-90), the required setback is measured from the future right-of-way line. The average daily traffic count for WCR 46 reflects 143 vehicles between WCR 49 and WCR 59. This count was taken 6114/2006. Directly east on WCR 46 between WCR 51 and WCR 53, the ADT counts 139 vehicles. ntQUIREMENTS: Access: The applicant is proposing a new access at the top of the hill directly east of the existing tank battery location. The access shall be placed in such a location to have adequate sight distance in both directions and not below the crest of a hill or where physical obstructions are present. Off-street parking spaces including the access drive shall be surfaced with gravel, asphalt, concrete or the equivalent and shall be graded to prevent drainage problems. - Each parking space shall be equipped with wheel guards or curb blocks when necessary to prevent vehicles from extending beyond the boundary of the space and from coming into contact with other vehicles, walls, fences or planting. Dust Suppressant: With relocating the office, the number of vehicles that come to this site and leave in company trucks in return and leave again in personal vehicles generate approximately 80 additional vehicle trips. With the existing background traffic, this and the existing background traffic pushes the number over the 200 ADT count, which requires dust abatement. The applicant shall be required to provide adequate dust suppressant chemical (calcium chloride or magnesium chloride) for approximately 300 feet at any residence on WCR 46 between WCR 49 and the entrance no less than twice a year or more often as determined by the Department of Public Works (Motor Grader Supervisor). Storm Water Drainage: The applicant shall contact Dave Bauer, Weld County Public Works Storm Water Division, to verify any drainage requirements associated with the site. Please find the attached memo. Therefore, pursuant to the State Engineer's March 4, 2005 memorandum to county planning directors, this office will only perform a cursory review of the referral information and provide comments. The comments do not address the adequacy of the water supply plan for this project or the ability of the water supply plan to -- satisfy any County regulations or requirements. In addition, the comments provided herein cannot be used to guarantee a viable water supply plan or infrastructure, the issuance of a well permit, or physical availability of water. According to the submitted information the site will be served by a proposed Laramie-Fox Hills aquifer well. The Laramie-Fox Hills aquifer is nontributary at the proposed location. The applicant can apply for a well permit for the proposed uses and will be limited to the quantity of water determined to be available underlying the land owned by the applicant or underlying land owned by another who has consented in writing to the applicant's withdrawal.
