It is good to work together. In connection with the above- referenced permit,we would like to satisfy the following conditions of approval prior to the Planning Commission hearing which will be held on Tuesday,July 18,2006. This letter formalizes our conversation this morning. Per your direction,we will request these conditions be removed or amended at the hearing. Remove Condition of Approval lA(Page 5). A photograph of the existing sign was provided to you this morning and is attached again herein. This sign is attached to the south side of the storage building. This is the only sign and is 8 x 4 feet in size. Move Condition of Approval 18(Page 5), The applicant is working toward completing this Condition. We request the Condition be placed at prior to recording the plat rather than prior to scheduling the Board hearing as follows: "The applicant shall provide evidence to the Department of Planning Services that an adequate attempt has been made to reach an agreement...." Remove Condition of Approval IC(Page 5). Donald Carroll has approved the updated drainage report. Move Condition of Approval and ID(Page 5)to prior to recording the plat. Should these plans meet with your approval, we request that you remove these requirements at the hearing. Dust Abatement—A 104.5 foot wide by 323 foot long area, covering the detention pond and leach field areas was seeded at the end of March,2006, with a dry land pasture mix to minimize the dust. This mix consisted of a smooth brome crested wheat grass,slender wheat grass,perennial rye grass,renegade orchard grass and intermediately wheat grass. The seed is watered as necessary to get it established and will be watered to maintain it. The area around the office building and the parking lot consists of crushed concrete and the rest of the yard area is made up of a road base material. All of these areas are watered down using KWS water trucks whenever necessary to minimize dust. As stated before,in concurrence with Weld County, on Thursday,July 12th, approximately$600 worth of Magnesium Chloride will be purchased and is scheduled to be applied on WCR 22 from WCR 19 past the KWS property line approximately 10 feet, and also on the ingress and egress areas of the yard. Waste Manaeeme*—The Field office waste currently consists of used motor oil and other used petroleum products which arc stored in a 500 gallon, double-lined,OSHA-approved container which sits in another galvanized container outside the shop. It is hauled away at least once a month by Safety-Kleen Systems, Inc.,4500 Legacy Drive, Plano,Texas 75024,BR Englewood Service Facility,303-7614614. Waste Management of Denver, P.O. Duet Abatement-The area around the helipad has been seeded and is watered on an on-going basis as necessary. In concurrence with Weld County,S500 worth of Magnesium Chloride has been purchased and will be spread on WCR 22 from WCR 19 past the KWS property line approximately 10 feet. praineee plan—Donald Carroll with Weld County Public Works approved the updated Drainage Report regarding the Detention Pond dated March 16,2006 as submitted with application materials. Waste Management—Safety-Kleen Systems,Inc.,4500 Legacy Drive,Plano,Texas 75024,BR Englewood Service Facility,303-761-8614, is the service used for hauling away waste.The waste at the Field office currently only consists of USED motor oil. Berm Size—The new fuel tank will be 4,000 gallons and located at the north end of the existing fuel berm. The size of the berm Is 2,444 cubic feet with a maximum of 18,282 gallons. There are currently three tanks with a total of 10,400 gallons in the berm. The additional 4,000 gallons bring the total to 14,400 gallons,falling 4,000 gallons under the berm capacity. Therefore,the volume retained by the spillage berm is greater than the volume of the largest tank Inside the berm. Seenri —Roy Teter met with a representative from the Weld County Sheriff's office on Thursday,July 6,2006, to assess the current security provisions at the Field office. The representative offered additional suggestions which we agreed will improve the current security measures. The proposed completion date to implement the additional security is August I". If you have any more questions regarding this referral, please call me at(970) 336-3002 EXHIBIT 1 6 -E. 07/13/2006 MEMORANDUM TO: Michelle Martin, Planning Services DATE: July 12, 2006 FROM: Donald Carroll, Engineering Administrator SUBJECT: 3rdAmUSR-894, Kauffman Land & Development LLC I have reviewed three additional documents since my previous memo of the advised plat drawing identifying additional parking spaces. The revised parking layout identifies 46 cars or small trucks and 15 truck parking spaces. The applicant is identifying approximately 82 full-time employees to use the site, 43 employees come to the field office for daily assignments at 6 a.m. and leave by 6:30 pm. 40-50 vehicles will be parked overnight. Planning Services should determine the number of parking spaces required for the use. The Public Works Department has addressed parking such as signing, wheel guards, truck and equipment parking and identification on the site, surface conditions, and circulation. Storm Water Drainage: In my previous memo, I asked for an updated drainage report from Alpha Engineering. I have received that document dated 3/16/2006. The calculations for sizing of the detention area has changed from the previous approved drainage plan of 4/9/1999. Our Drainage Division has reviewed this type of use `,ociated with oil and gas production and recommends that the applicant should obtain all federal and state r rmits associated with detention and release. The permits are mandated by the Oil and Gas Commission. The 25 x 25 foot elevated helicopter landing pad is elevated out of the detention pond and does not cause any conflict in the detention or release. In the Glovaloma Estates PUD, Drainage Report II Drainage Basin and Sub-basins "A. Major Drainage Basin Description. During minor storm events, this off-site discharge from these adjacent properties (Kauffman) will be captured by the relocated Stanley Ditch/Bull Canal located immediately north of WCR 22 and then conveyed west and then north to Lake Harrison." Gordon Allott, Jr. provided the follow-up letter dated July 10, 2006. In that letter, the applicant is committing to additional dust abatement and it is required to be applied to WCR 22 from WCR 19 past the KWS property line for approximately 10 feet. Rd. 24.5 Longmont, CO. 80504 RE: CASE #3RD AmUSR-894, KAUFFMAN LAND & DEVELOPMENT SITE SPECIFIC DEVELOPMENT PLAN AND SPECIAL REVIEW PERMIT. Dear Michelle: I will be entering an appearance in opposition to the above referenced case. As I recall, this case came before the Board of Adjustment at least once previously in Weld County. As an Agent for the Helen M. Parker Colorado Trust, I continue to object to K.P. Kauffman's intended change in use for their existing subdivision exemption where their oil and gas production facility is currently located. The greatest concerned is K.P. Kauffman's use of this site for helicopter landings and take-offs. The first objection is based upon the fact the proposed modification to use this facility as a helicopter landing and take off location, was clearly not the intent when the original subdivision exemption was granted. I represent the owners of an adjacent property which will be adversely affected by helicopter traffic over their property which my clients intend to develop. Potential development will certainly be adversely impacted by helicopter traffic crossing their property as part of the approach and takeoff path for the proposed Kauffman site. I served in a helicopter unit in the United States Army National Guard. I am very familiar with the helicopter traffic and know full well it represents noise, dust, as well as a safety issues for the surrounding area. The Second issue supporting our opposition, is the fact the applicant themselves presented evidence in the original hearing, that there are ten pages of locations in Weld County where helicopter landings and take offs are currently permitted. We renew our objection on the basis there are numerous established locations available to Kauffman for this use and it is clear K.P. Kauffman can find another location already permitted to utilize for their helicopter traffic. Clearly there is no need for helicopter flights in and out of the site K.P. Kauffman as proposed. This request does not represent a need, only a EXHIBIT 1 `N • desire for Kauffman to more conveniently conduct business, but it does represent a detriment to both the surrounding land owners and to the public. The third issue is, the public safety hazard this use represents. Clearly the proposed use will adversely affect surrounding property owners but it also represents a safety hazard to the public as well. This application has been turned down by other Weld County boards for this very issue alone. Clearly Kauffman continues to persist in efforts to change the use of this site from its original intended use. It appears Kauffman's strategy is to basically outlast the objectors. This is not going to happen in this case as we renew our strenuous objection to this applicant's proposed use of the property as a helicopter take off and landing location. This site currently has an industrial use as an oil and gas production facility creating additional traffic in the area of the intersection of Co. Rd. 19 & 22. The proposed helicopter traffic will add additional traffic distractions at a very unsafe intersection being Co. Rd. 19& 22. This fact alone is adverse to the surrounding areas as well as Weld County road traffic thus jeopardizing public safety. The fourth objection is based upon this site being in close proximity to established animal confinement faculties including turkey feeding operations as well as an equestrian operation. Prevailing winds require helicopter approaches and take offs, particurally in windy and adverse weather conditions, to traverse across the Parker property. We feel this is detrimental not only to our individual ownership but also to the public and the surrounding areas. We ask that the Board deny this application based on the facts that: 1. This is not the original untended use of the site. 2. Granting this permit will create not only public but private property hazards. 3. This use will have an adverse affect on surrounding, existing livestock operations. 4. O March, 2006 proposed drainage plans for the Kauffman property include a detention pond designed to collect the runoff from the developed site during the 100-year storm and release that runoff at the rate equal to the runoff from the 5-year storm falling on the undeveloped site. The Kauffman site drainage plan shows the detention pond outlet discharging to the west to the Gloraloma property. o The proposed Gloraloma PUD drainage and grading plans and report submitted to Weld County in March, 2006 by Pickett Engineering acknowledges current conditions and shows the historical and developed flows from the Kauffman property discharging at the southwest corner of the Kauffman property into the Bull ditch drainage easement on the Gloraloma property. The proposed Gloraloma PUD drainage and grading plans show proposed construction of 5-foot high berms along the • north and east property lines between the Gloraloma and Kauffman properties. These proposed berms would block the historical drainage patterns which is counter to Colorado drainage law. o The March, 2006 drainage plan for the Kauffman site shows the detention pond outlet discharging to the west to the Gloraloma property at a location that would be blocked by the Gloraloma proposed berm. o The proposed Gloraloma berms would direct flows from the Kauffman properties to the southwest corner of that property resulting in the flows crossing the Bull ditch drainage easement on the Gloraloma property. o The Gloraloma PUD drainage and grading plans show grading for a proposed drainage swale that directs drainage to the proposed Gloraloma detention pond A. As currently designed, that proposed swale collects runoff from Gloraloma Lot 4. That proposed swale could be extended southeast to collect runoff discharged from the southwest corner of the Kauffman property. o Detention of Kauffman runoff in their proposed detention pond substantially reduces the impacts of offsite stormwater flows onto the Gloraloma site and the size of the proposed Gloraloma drainage swale can be optimized. Recommendation Colorado drainage law requires provision for historical drainage pathways. The proposed Gloraloma berming blocks historical flow paths; however, the proposed drainage swale to Pond A can be extended & sized to accept the Kauffman property detention pond discharge to mitigate the diverted flows. The Kauffman detention pond outlet structure can be re- configured to discharge at the southwest property corner and tie into the proposed Gloraloma swale. Where it used to go out a pipe due west into where the Gloraloma people had planned a berm, it now drains due south across their (Kauffman) own property to the roadside ditch along their south property line. So the Kauffman pond does not discharge to private property, no easement is needed. Since the detention pond discharge will be at the 5-year undeveloped rate the impact on the adjacent properties and the roadside ditch is actually less than in the undeveloped case. You also approved our Dust Abatement Plan prior to the Planning Commission hearing, however you withdrew it during the hearing based upon a photo taken by Planning Staff of the helicopter pad instead of inspecting the field yourself. This letter serves as the Dust Abatement Plan and provides you with additional information to approve such plan. Dust Abatement—A 104.5 foot wide by 323 foot long area, covering the detention pond and leach field area was seeded at the end of March, 2006, with a dry land pasture mix. This mix consisted of a smooth brome crested wheat grass, slender wheat grass, perennial rye grass, renegade orchard grass and intermediately wheat grass. The seed has been watered as necessary to get it established and will continue to be watered for maintenance. The attached photograph dated July 7, 2006 illustrates the seeded rows and the germination that is occurring. If the seed does not continue to germinate and thrive, we will sod an area that extends a minimum of fifteen (15) feet out from the helicopter pad and water this sod as needed for establishment and maintenance. This procedure will be done in the Autumn depending on proper weather conditions. If the existing germination and growth does not continue due to the heat, the remainder of the area will be reseeded in Autumn or Spring, depending on weather conditions.. As discussed by phone, the above referenced applicant has satisfied condition 1.B by virtue of having a letter from the Operator(Kerr McGee Oil and Gas Onshore, LP)which indicates that Kerr McGee fully acknowledges and supports the proposed application and development. Additionally, as indicated by phone all mineral interests pursuant to the mineral owner affidavit provided with the application were provided note and no concerns were expressed by any of said other mineral interests. Finally, as we discussed by phone.the state regulated drilling window known as the"400' Window"under COGCC Rule 318Aa,(1)Is unaffected by the applicant's development proposal. I have enclosed with this letter a rough drawing that displays the 400' Window under Rule 318A in relation to the Kauffman Land and Development Parcel which la the subject of the above referenced application, Aa you can see, the Kauffman Land and Development Parcel is not located within the 400' Window.
