WELD COUNTY COUNCIL
January 16, 2006

The Weld County Council met in regular session in full conformity with the Weld County
Home Rule Charter, Monday, January 16, 2006, 6:30 p.m., at Weld County Centennial
Center, 915 10th Street, Greeley, CO.
ROLL CALL: The meeting was called to order by President Chip Marks. Vice President
Dwaine Kurtz, Councilwoman Ginny Buczek, and Councilman Tom Pettit, were present
constituting a quorum of the members. Councilman Gene Stille was excused. Also
present: Commissioner Bill Jerke, Harry Heath, Sylvia Martinez, John Noerenberg, Doug
and Sadie Rademacher, Ben Ready, Scott Rudd, and Bev Thomas, council secretary.
ELECTION OF 2006 COUNCIL OFFICERS:
Election of 2006 Council President
Councilman Tom Pettit nominated Councilman Gene Stille for 2006 Council President.
Councilman Chip Marks nominated Councilman Tom Pettit. Councilman Dwaine Kurtz
made a motion to close the nominations for council president. The motion was seconded
and carried. Councilman Tom Pettit withdrew his name from the nomination pool.
Councilwoman Ginny Buczek made a motion Councilman Gene Stille be the 2006
Council President. The motion was seconded and with a roll call vote Councilman Gene
Stille was unanimously elected 2006 Council President.
Election of 2006 Council Vice President
Councilman Dwaine Kurtz made a motion Councilman Tom Pettit be the 2006 Council
Vice President. The motion was seconded and with a roll call vote Councilman Tom Pettit
was unanimously elected 2006 Council Vice President.
REVIEW PROGRAM: Commissioner Bill Jerke gave an overview of 2005
achievements of Weld County including: Construction started on new Weld
Administration Building in Ft. Lupton and north Greeley Administration Building for
for ACS and Elections; Study amendments to MUD in SW Weld County for August,
2006 completion; Planning for Phase III jail expansion for construction completion in
2007; 800 MHZ radio system operational with nearly all public safety agencies
converted and county helped purchase 500 radios for town and fire departments with
Energy Impact Grant; Voting Centers used for the November election; Construction
underway for strategic WCR 13 between WCR 2 and 8 for early 2006 completion; Weld
County computer network security now state of the art; Metro district creation policies
developed to help manage growth; Capital improvements of roads, water and sewer (in
conjunction with the Town of Windsor) completed to accommodate the O-I glass plant;

Public Works created storm water engineering unit to deal with the impact of growth on
storm water to be paid for by a new development storm water impact fee; County
cooperated in creation of Juvenile Assessment Center; County dispatching City of Fort
Lupton and Fort Lupton Fire as of January, 2005; Three new courtrooms opened
accommodating two additional judges and growth in court activity; mill levy lowered five
times in the last five years due to oil and gas revenues; Commissioners working with
other counties to use 1041 regulations to give county as much jurisdiction as possible
over proposed Super Slab; Commissioners very active in water issues.
PUBLIC COMMENT: Latinos Unidos spokesperson Sylvia Martinez presented a letter to
council members and asked why the Board of County Commissioners has not answered
the questions of Latinos Unidos. Sylvia also expressed her concern that the
Commissioners have passed a resolution without any written data presented by the
proposing party. Commissioner Jerke said the county attorney speaks for the
Commissioners at their request and communication from Latinos Unidos indicated the
Commissioners had responded to Latinos Unidos.
Harry Heath stated his concern about the threat of eminent domain to Weld County
property owners and requested the county do everything possible to stand against the
power of eminent domain. Commissioner Jerke reiterated the Commissioners'
commitment to pursuing 1041 regulations to impact eminent domain, and stated anything
the county can do to protect property owners is important to the Commissioners.
John Noerenberg stated his concerns about the lack of potable water in Greeley and
Weld County. Commissioner Jerke referred Mr. Noerenberg to Public Health Director
Mark Wallace. The lack of licenses required by Weld County landscape, fence, and
concrete contractors was also addressed by Mr. Noerenberg.
APPROVAL OF DOCUMENTATION:
December 20, 2005 Council Minutes
Vice President Dwaine Kurtz made a motion to approve the December 20, 2005 council
minutes amended to state Mead will be billed for its share of work on a road adjacent to
Mead. Councilman Marks seconded the motion and it carried.
2005 Fourth Quarter Report to the People
Councilman Dwaine Kurtz made a motion to accept the 2005 fourth quarter Report to the
People amended to state Mead will be billed for its share of work on a road adjacent to
Mead. Councilman Marks seconded the motion and it carried.
Council Resolution 151
Councilman Chip Marks made a motion to adopt Resolution 151 setting the dates for
2006 Weld County Council meetings. The motion was seconded and carried.

UNFINISHED BUSINESS:
Review of the Council's Worksheet RE: Home Rule Charter Change
Councilwoman Ginny Buczek and Councilman Dwaine Kurtz will take the council's
proposed Weld County Home Rule Charter change worksheet to Weld County Attorney
Bruce Barker. Council members will request a document from Mr. Barker to present to
the Board of County Commissioners asking for a charter change on the 2006 Weld
County election ballot. The proposed charter amendment would be to change the
number of signatures required to petition to run for election to the Weld County Council
from 200 to 35.
NEW BUSINESS:
Appointments and Announcements
There will be no Elected Officials meetings until March 2006. Councilman Gene Stille
plans to attend the January 28, 2006 CDOT Elected Officials Meeting.
2006 Council Meeting Locations
The council will meet at the Weld County Centennial Center, 915 10th Street, Greeley,
CO, for its monthly meetings at 6:30 p.m. the third Monday of each month in 2006 with
the following exceptions. The February meeting will be at Centennial Center on February
13, the second Monday of February. The council's April meeting will be at Weld County's
Southwest Administration Complex, 4209 WCR 24 '/, Longmont, CO. The location of the
council's August meeting will either be at the Southwest Administration Complex or in Ft
Lupton, CO.
2006 Coordinator and Elected Official Assignments
Councilwoman Ginny Buczek made a motion Council President Gene Stille assign 2006
coordinator and elected officials assignments to council members. The motion was
seconded and carried.
2006 Council Review Programs
Council members discussed the review program schedule for 2006 council meetings.
The following decisions were made:
February: Councilman Dwaine Kurtz will ask Weld County's Emergency Preparedness
Officer to give a review program at the February council meeting.
August: Council will discuss salary setting for
Board of County Commissioners for the years 2009 & 2010
Assessor & Clerk/Recorder for the years 2007, 2008, 2009, 2010
Sheriff for the years 2007, 2008, 2009, 2010.
September Salaries resolution preparation.

The Council instructed Bev Thomas to request from Personnel Director Pat Persichino
the benefit packages of elected officials for whom the council will be setting salaries.
Correspondence
The council received copies of the 2006 County Electronic Election Filing Calendar and
the January 11, 2006 Report of the County Elected Officials' Salary Commission.
Coordinator Reports
Councilman Dwaine Kurtz reported on the well-attended, January 11, 2006, Weld County-
hosted meeting with county municipalities about metropolitan districts and special
districts.
Payment of the Bills
Councilman Chip Marks made a motion to pay the bills as listed:
Mileage for Councilwoman Ginny Buczek $27.20
Mileage for Councilman Chip Marks $35.70
Mileage for Councilman Tom Pettit $ 8.50
The motion was seconded and carried.
