RE: DENY PETITION FOR ABATEMENT OR REFUND OF TAXES- WINDSOR SHORES,
INC.
WHEREAS,the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS,the Board of County Commissioners of Weld County, State of Colorado, at a
duly and lawfully called regular meeting held on the 17th day of April,2006,at which meeting there
were present the following members: Chair M. J. Geile, and Commissioners William H. Jerke,
David E. Long, Robert D. Masden, and Glenn Vaad, and
WHEREAS,notice of such meeting and an opportunity to be present has been given to the
taxpayer and the Assessor of said County,and said Assessor, Stan Sessions, being represented
by Mike Sampson, and taxpayer Windsor Shores, Inc., being present, and
WHEREAS,the Board of County Commissioners have carefully considered the attached
petition, and are fully advised in relation thereto, and
WHEREAS,pursuant to the Weld County Home Rule Charter,Article 3, Section 3-13, the
concurrence of three members of the Board is required to approve a Resolution, and
WHEREAS,the motion to approve said abatement received only two votes and therefore
failed; the effect of the failure to obtain a majority vote is a denial of the motion.
NOW,THEREFORE,BE IT RESOLVED by the Board of County Commissioners of Weld
County,Colorado,that the Board concurs with the recommendation of the assessor and the petition
be and hereby is, deemed denied, and an abatement or refund be allowed as follows:

Hi Mike,
I received a message today from Larry Eckel of Windsor Shores, Inc. He is scheduled to come before on the
Board on February 27, 2006, for parcel number 070534000019. He informed me that he will be in California until
the second week of April, completing a construction job. He requested a continuance for his petition, as he
would like to be here in person to present his case. I spoke with him this afternoon, and we have agreed to
continue his petition to April 17, 2006, at 9:00 a.m. Since the notice is dated for February 27, 2006, we will still
call up it on the agenda, and at that time request a continuance to April 17, 2006, due to the fact that the
petioner is out of town. You do not need to be in attendance at the Board meeting for this petition until April 17,
2006, at 9:00 a.m.

Dear Mr. Eckel:
As per our telephone conversations, enclosed is a form Petition for Abatement or Refund of
Taxes which I respectfully ask you to complete and file on behalf of Windsor Shores, Inc., for an
abatement of the 2003, 2004, and 2005 taxes for the possessory interest assessment for the
Windsor Reservoir lease to Windsor Shores, Inc. (Parcel No. 070534000019). The abatement
will be the proper mechanism to discuss your concerns regarding the method in which the
assessment was calculated. It also is a means by which the Board of County Commissioners may
consider your claims that possessory interests of similar reservoirs in neighboring counties are
not assessed. Please note that for you to succeed in the abatement, you will need to provide
evidence to back up your arguments.
If no Petition for Abatement or Refund of Taxes is file by you for this property on or before
November 10, 2005, I will proceed with legal action to collect the sum which is due, now over
$16,000.
