RE: GRANT CHANGE OF ZONE FROM A-AGRICULTURAL TO C-3-COMMERCIAL FOR
GREELEY SUBARU, 6005 W. 10th STREET, GREELEY, COLORADO 80631
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the

affairs of Weld County, Colorado, and
WHEREAS, a public hearing was held on the 7th day of October,
,, 1981 at 2: 00 o' clock p.m. for the purpose of hearing the application
of Greeley Subaru, 6005 W. 10th Street, Greeley, Colorado 80631,
requesting a change of zone from A-Agricultural District to C-3-
Commercial District for the following described parcel of land,
to-wit:
Attached exhibit "A" is incorporated herein
by reference.
WHEREAS, Section 21. 6. 2 of the Weld County Zoning Ordinance
provides standards for review of such a Change of Zone, and
WHEREAS, the Board of County Commissioners heard all the testimony
and statements of those present, has studied the request of the
applicant and the recommendations of the Weld County Planning
Commission, and having been fully informed finds as follows:
1. That the proposed request is consistent with the Weld
County Comprehensive Plan. Said plan states: "In order
to minimize conflicting land uses and minimize the cost of new
facilities and services to the taxpayer, industrial, commercial
business and residental development will be encouraged to locate
adjacent to the existing 27 incorporated towns and in accordance
with the Comprehensive plans and stated wishes of each community. "
The City of Greeley Planning Commission recommended no objection
to the request.
2. It is the opinion of the County Commissioners that the request
will be compatible with the surrounding land uses and will have
adequate water and sewer service to serve the permitted uses
within the proposed zone district.
3. The property does not appear to have sand, gravel, or other
mineral resources on or under the subject property, is not located
within a Geologic Hazard area or a Flood Hazard area, and soil
conditions do not present moderate or severe limitations to
development.
4. This determination is based, in part, upon a review of the
information regarding the request and responses of the referral
entities which have reviewed this request.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners
of Weld County, Colorado that the application of Greeley Subaru, for
a change of zone from A-Agricultural District to C-3-Commercial District
on the above referenced tract of land be, and hereby is, granted.

I hereby certify that pursuant to a notice dated August 31, 1981 and
duly published September 3 & 24 in the Johnstown Breeze a public hearing
was held on the request of GREELEY SUBARU for a COZ from A to C-3.
The County Attorney reviewed the portion of the Zoning Ordinance that
refers to COZ, s.
Tom Honn reveiwed the Planning Commission' s reasons for favorable
recommendation.
Tom Houtchens, attorney for the applicant, was present and reviewed
the request.
There was no one present in opposition the said request.
Commissioner Steinmark made a motion to approve the COZ & stated that
is appears that conditions have changed in the area anda C-3 zoning
now appears more consistent with the neighborhood. Commissioner
Martin seconded the motion and it carried unanimously

Dear Mr. Honn:
SUBJECT: GREELEY SUBARU, INC. , PROJECT NO. 81148.00
The request for rezoning from Argricultural to Commercial is consistent
with the policies of Weld County and the City of Greeley Comprehensive Plan
acrd the surrounding area. The Lity of Greeley Comprehensive Plan designates
this area -as communnity commercial area. The surrounding area on both
sides of West 10th Street from 59th Avenue to Sheep's Draw is spotted with
commercial zoning. The Brighi property just west of this area has recently
been zoned Commercial P.U.D.
The site presently has no water or sewer service and no plans Nava .been
formulated for obtaining water or sanitary facilities. The Owner plans to
use the area for storage and if water is needed he will use his present
source of water on the lots that the building proper are located. In the
event the Owner plans to develop the site for a building, he will -apply for
water and sanitary sewer services.
As previously stated the Dwner plans to use the facility for storage and no
plans for expansion have been formulated. I discussed the access to West
10th Street from the property with Wally Jacobsen of the State Highway
Department. He felt as long as 61st Avenue was a platted right-of-way, he
couldn 't see any problems with this area.
Our Client feels that this parcel of land meets his needs for future
expansion of his facilities, and that additional access from U.S. Highway
34 is not required due to the platted 61st Avenue adjacent to his present
property, Lots 3 and 4 of Western Hills, and abutting the proposed rezoned

The following information was extrapolated from the United States
Department ]pf Agriculture 's Soils Conservation Service soil survey
of Weld County, Colorado. The site under study is located in the
Southeast Quarter (SEl/-4) of the Southeast Quarter (SEl/4) of Section
4 , Township 5 North , Range 66 West of the 6th P.M. , Weld County,
Colorado.
The entire site is made up of Otero sandy loam 5 to 9 percent slopes.
It is 'Formed in mixed outwash and eolian deposits. Included are small
areas of soils that have sandstone and shale within a depth of 60
inches. This soil has excellent potential for urban and recreational
development. The primary limiting factor is the moderately rapid
permeability in the substratum, which causes a hazard of ground water
contamination . Erosion control is strongly stressed with _gradual
slopes required in grading and landscaping.
The south end of the site has been used for a landfill with a large
amount of concrete debris being deposite-d into the low areas. An
extensive soils 'investigation will have to be con-ducted in order to
delineate the filled area.
