HomeMy WebLinkAbout20063377 RESOLUTION RE: AUTHORIZATION FOR THE WELD COUNTY ATTORNEY TO PROCEED WITH LEGAL ACTION AGAINST CHARLES JOHNSON FOR VIOLATION OF THE WELD COUNTY CODE WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, Charles Johnson, VI #0600286, is allegedly in violation of the Weld County Code, and WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has not been corrected, and WHEREAS, on the 14th day of November, 2006, a public hearing was held before the Board of County Commissioners for the purpose of hearing testimony relating to said violation, at which time this matter was continued to December 12, 2006, to allow adequate time for the property owner to meet with the Department of Planning Services and review all issues needed to bring the property into compliance. WHEREAS, on the 12th day of December, 2006, a public hearing was held before the Board of County Commissioners for the purpose of hearing testimony relating to said violation,and WHEREAS, Charles Johnson, property owner, was present at said hearing, and WHEREAS,the Board of County Commissioners deems it advisable to refer said violation to the Weld County Attorney's Office for legal action, with an instruction for delay of action upon such referral until January 12, 2007, to allow adequate time for the property owner to restore, remove or screen the noncommercial junkyard from all adjacent properties and public rights-of-way, and to obtain current license plates for the remaining vehicles to bring the subject property into compliance and for an inspection of the property by the Department of Planning Services staff. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that VI #0600286 be, and hereby is, referred to the Weld County Attorney's Office for legal action against Charles Johnson to remedy the violation of the Weld County Code, and any other persons occupying the properties, any persons claiming an interest in the properties, and any persons acting in active concert with the identified parties, with an instruction for delay of action upon such referral until January 12, 2007, to allow adequate time for the property owner to restore, remove or screen the noncommercial junkyard from all adjacent properties and public 2006-3377 PL0824 VIOLATIONS - VI #0600286 - CHARLES JOHNSON PAGE 2 rights-of-way, and to obtain current license plates for the remaining vehicles to bring the subject property into compliance. October 13, 2006 Letter sent to property owner indicating that the violation case was scheduled before the Board of County Commissioners. October 24, 2006 Mr. Johnson left me a voice mail. October 25, 2006 I left a message for Mr. Johnson. Never heard back. November 14, 2006 At the Violation Hearing the Board of County Commissioners continued this Violation to the December 12, 2006 hearing. November 14, 2006 Mr. Johnson met with me to discuss how to bring his property into compliance.
