Lot 7 is Troy Hefner's (jeeps unlimited) - by the aerial photo only Lot 6 looks to be vacant
(Coronet Investment). Do you mean lot 6?
The case with the water was Fusaro on Lot 4 and Michelle worked on it. They needed to get a
water tap through Central Weld Water the State came back saying something along the lines
that the well wasn't adequate.

Answer 1 to the Cluster PUD question
I have spoken with Bruce and he says that an 80 acre agricultural outlot does need to be included when doing a
Cluster PUD on wells. So that really hinders your applicant from doing a Cluster PUD.
Answer 2 to Althen Boyer
Technically Jeeps Unlimited should of been permitted as a USR since it is a "commercial junkyard or salvage
yard" but it was processed as a SPR. So what that means since the uses proposed (vehicle service/repair facility)
is a use by right in the C-3 zoning an amendment to the SPR will be required. Please keep in mind that when a
different lot came through the process they were required to tie into the public water supply so I would expect that
Troy will have to do connect in also.

Question about the intent of the Cluster PUD in the Code
I have a property owner who owns 80 acres and wants to do a Cluster PUD on it with wells.
Section 27-2-210 states
A PUD Zone District shall be serviced by an adequate water supply. All PUDs shall be served by a public water system
as defined in this Chapter. An..excepti.on may be_grante.d for nine._(2)lots or less_residentially clustered PUDs when
public water is not available and the residential PUD results in an intensity of development that preserves and enhances
agricultural lands and production. A PUD applying for an exception to the public water requirement must be considered
a nonurban scale development as defined in this Chapter. A PUD not served by_public water shall preserve a minimum
eighty-acre agricultural outlot. The Department of Planning Services and the Department of Public Health and
Environment shall review any PUD applying for an exception to public water to determine if the application meets the
intent of the PUD regulations and state water requirements. (Weld County Code Ordinance 2001-1)
Through the Cluster PUD process on 80 acres he can have 4 lots but does he also need to have the 80 acre agricultural
outlot as stated above?

County Water District for this site. According to the response letter, water can be made
available to the property after paying for the tap. The applicants have provided a receipt
for $17,500.00 to Central Weld County Water District for the tap.
With this new information, I am requesting that Development Standard #10 from my
Referral Memo dated 1/3/2006 be changed to the following:
1. The facility shall utilize the existing public water supply. (Central Weld County
Water District)
In addition, the note at the end of my referral regarding well water testing can be
removed, as it is no longer relevant.

Environmental Health Services has reviewed this proposal for a commercial junkyard or
salvage yard, the leasing and sales of vehicles and equipment and vehicle
service/repair. We have no objections to the proposal, however, we do recommend that
the following conditions be part of any approval:
We recommend that the following requirements be met prior to allowing the plat to be
recorded:
1. In the event, the applicant intends to wash vehicles or equipment on site the
following shall apply:
The applicant shall provide evidence that the washing area will be designed
and constructed to capture all effluent and prevent any discharges from the
washing of vehicles or equipment in accordance with the Rules and
Regulations of the Water Quality Control Commission and the Environmental
Protection Agency.
2. A septic system repair application (No.G-890279) was found during a file search
by Environmental Health Services. However, according to the information found,
the septic system was never adequately finaled. It is unknown at this time where
the septic system is located or if it was ever installed. Therefore, the septic
system shall be reviewed by a Colorado Registered Professional Engineer. The
review shall consist of observation of the system and a technical review
describing the systems ability to handle the proposed hydraulic load. The review
shall be submitted to the Environmental Health Services Division of the Weld
County Department of Public Health and Environment. In the event the system is
found to be inadequately sized or constructed the system shall be brought into
compliance with current Regulations.
3. The applicant shall submit a waste handling plan, for approval, to the
Environmental Health Services Division of the Weld County Department of Public
Health & Environment. The plan shall include at a minimum, the following:
1) A list of wastes which are expected to be generated on site (this should
include expected volumes and types of waste generated).
2) A list of the type and volume of chemicals expected to be stored on site.
3) The waste handler and facility where the waste will be disposed (including
the facility name, address, and phone number).
We recommend that the following requirements be incorporated into the permit as
development standards:
1. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and
Facilities Act, 30-20-100.5, C.R.S., as amended) shall be stored and removed for
final disposal in a manner that protects against surface and groundwater
contamination.
2. No permanent disposal of wastes shall be permitted at this site. This is not
meant to include those wastes specifically excluded from the definition of a solid
waste in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S.,
as amended.
3. Waste materials shall be handled, stored, and disposed in a manner that controls
fugitive dust, fugitive particulate emissions, blowing debris, and other potential
nuisance conditions.
4. The applicant shall operate in accordance with the approved "waste handling
plan".
5. Any vehicle washing area(s) shall capture all effluent and prevent discharges in
accordance with the Rules and Regulations of the Water Quality Control
Commission, and the Environmental Protection Agency.
6. Fugitive dust and fugitive particulate emissions shall be controlled on this site.
7. This facility shall adhere to the maximum permissible noise levels allowed in the
Commercial Zone as delineated in 25-12-103 C.R.S., as amended.
8. Adequate handwashing and toilet facilities shall be provided for employees and
patrons of the facility.

9. Any septic system located on the property must comply with all provisions of the
Weld County Code, pertaining to Individual Sewage Disposal Systems.
10.A permanent, adequate water supply shall be provided for drinking and sanitary
purposes. This application is proposing a well (permit #015774-F)as its source of
water. The applicant should be made aware that groundwater may not meet all
drinking water standards as defined by the Colorado Department of Public Health
and Environment. We strongly encourage the applicant to test their drinking
water prior to consumption and periodically test it over time.
11.All potentially hazardous chemicals must be stored and handled in a safe manner
in accordance with product labeling and in a manner that minimizes the release
of hazardous air pollutants (HAP's) and volatile organic compounds (VOC's).
12.The operation shall comply with all applicable rules and regulations of the State
and Federal agencies and the Weld County Code.
Additionally, please note the following:
1 . This application is proposing a well(s) as its source of water. The applicant
should be made aware that groundwater may not meet all drinking water
standards as defined by the Colorado Department of Public Health and
Environment. We strongly encourage the applicant to test their drinking water

Dear Ms.Hatch:
I have reviewed the submitted material pertaining to the Site Specific Development Plan and Special
Review Permit for a proposed vehicle sales, repair and salvage yard located at 2114 1-25 Frontage Road
(Case Number: AmUSR-1476, Case Name: Fusaro). The Fire District does not object to the request
provided the requirements of the Fire District can be met. Based on my review, 1 have the following
comments regarding the project:
• Fire apparatus access is not adequate to the storage area. Fire apparatus access roads shall be a
minimum of 20 feet in width. Access drives through out this area are shown as 16 feet in width only.
Apparatus access roads shall be designed and maintained to support the imposed loads of fire
apparatus(75,000 pounds). The minimum turning radii for all turns shall be thirty-five (35)feet inside
turning radius and forty-eight (48) feet outside turning radius. If the gate is to be locked, a fire
department key box must be provided.
• There is no water supply for fire protection to the site, but the building is existing. Because additional
square footage is not being added to the building or the site,and the building is not being used for a more
hazardous activity than previously existed, water supply for fire protection is not being required at this
time.
• If the building is going to be remodeled, plans for the remodel must be submitted to the Fire District
for review and approval before building permits are issued.
• A final inspection of the occupancy will be required by a member of the Firc District before a
Certificate of Occupancy is issued from Weld County.
The Fire District reserves the right to make further comments as the project proceeds. Nothing in this
review is intended to authorize or approve of any aspect of this project that does not comply with all
applicable codes and standards. We appreciate being involved in the planning process. Should you have

The Weld County Public Works Department has reviewed this proposal; this project falls primarily under the purview of the
Use by Special Review Standards, Weld County Code, Chapter 23, Article II, Division 4, Section 23. Our comments and
requirements are as follows:
COMMENTS:
Access: The accesses are from the 1-25 East Front Road. The Colorado Department of Transportation (CDOT) has
jurisdiction over all accesses to state highways. Please contact Gloria Hess-Idler at the Greeley office to verify the access
permit or for any additional requirements that might be necessary to obtain or upgrade the permit. (1-25 East Frontage Road).
In utilizing the County aerial, portions of the frontage road have been annexed by the City of Broomfield.
The internal loop road that accesses lots 1 through 5 off the Frontage Road associated with the Althen Boyer Subdivision still
appears to be within the County.
REQUIREMENTS:
'—fless: Utilize the internal loop road access to serve Lots 1 through 5 including the proposed USR Lot 4.
Parking: Utilize adjacent parking in the front and the proposed parking area south of the existing building. The off-street
parking spaces including the access drive shall be surfaced with gravel, asphalt, concrete or the equivalent and shall be
graded to prevent drainage problems.
Each parking space shall be equipped with wheel guards or curb blocks when necessary to prevent vehicles from extending
beyond the boundary of the space and from coming into contact with other vehicles, walls, fences or planting.
Outdoor Storage: The applicant is identifying several locations of outdoor storage with 16-foot access driveways.
The access width requirements for emergency equipment (fire department) are a minimum of 20 feet. The applicant
indicated that it has been cleared with the fire department and emergency services that the width of the access and lane shall
be adequate for emergency purposes. The applicant shall provide documentation to that effect.
Storm Water Drainage: The applicant is utilizing the existing 20-foot utility and drainage easement for outdoor storage on
the south and east property lines. Be selective on what you store in these locations as not to block any historical drainage
that may utilize these corridors.
The historical flow patterns and run-off amounts will be maintained on site in such a manner that it will reasonably preserve
the natural character of the area and prevent property damage of the type generally attributed to run-off rate and velocity
increases, diversions, concentration and/or unplanned ponding of storm run-off.
The applicant must take into consideration storm water capture/quantity and provide accordingly for best management
practices.
The Althen Boyer Subdivision has a storm water storage area directly east of the proposed USR site. All drainage should be
cted towards the drainage and utility easement and the existing storm water storage area.

Dear Michelle:
The City of Dacono has reviewed the Site Specific Development Plan and Special
Review Permit on Lot 4 of Althen Boyer Subdivision. This site is in the City of Dacono
Planning Area. The request is for a junk yard and vehicle sales and repair. It seems that
this is the type of application where the Baseline Standards are important, particularly
with regard to screening these activities from the adjacent streets and highways. Section
3.0 Landscaping is particularly applicable to this application.
The City of Dacono does not oppose this application as long as the site conforms to the
Baseline Standards with regard to landscaping and screening. If Weld County approves
this application the City of Dacono requests that the approval be subject to the following
conditions.
1. Prior to installing these uses the applicant shall meet the landscaping
standards and requirements of Sections 3.3.2, 3.4.1, 3.4.2 and 3.4.3 on Lot
4 of Althen Boyer Subdivision.

A Site Specific Development Plan and special Review Permit for a business (Commercial junkyard or salvage

1. Building permit BCS-060015 has been applied for. This permit is for interior remodel to meet the requirements
for AmUSR-1476.
2. A plan review is required for each building for which a building permit is required. Plans shall include a floor
plan. Plans shall bear the wet stamp of a Colorado registered architect or engineer. Two complete sets of plans
required when applying for each permit. Building plans shall also be submitted to Ivbuntain View Fire
itection District for their approval.
3. Buildings shall conform to the requirements of the various codes adopted at the time of permit application.
Currently the following has been adopted by Weld County: 2003 International Building Code; 2003 International
Mechanical Code; 2003 International Plumbing Code; 2003 International Fuel Gas Code; and the 2002 National
Electrical Code and Chapter 29 of the Weld County Code.
4. The structures will probably be classified as a mixed use, B (offices) and S-1 (Storage) occupancies. Fire
resistance of walls and openings, construction requirements, maximum building height and allowable areas will
be reviewed at the plan review. Setback and offset distances shall be determined by the Zoning Ordinance.
6. Building height shall be measured in accordance with the 2003 International Building Code for the purpose of
determining the maximum building size and height for various uses and types of construction and to determine
compliance with the Bulk Requirements from Chapter 27 of the Weld County Code. Building height shall be
measured in accordance with Chapter 23 of the Weld County Code in order to determine compliance with offset
and setback requirements. Offset and setback requirements are measured to the farthest projection from the
building.

Amendment to a Site Specific Development Plan and Special Review Permit for a business
(commercial junkyard or salvage yard, the leasing and sales of vehicles and equipment, and
vehicle service/repair) in the C-3 (Commercial) Zone District.
The Department of Planning Services reviewed the above referenced Amended Site Specific
Development Plan and Special Use Permit documentation and drawings and offers the
following comments:
The Use by Special Review Plat shall be prepared in accordance with Section 23-2-260.D of
the Weld County Code.
This application shall be in compliance with Section 23-3-250 A. and B and is address in the
following comments.
Section 23-3-250.A.1
Stormwater Management. All users of land in Commercial Zone Districts shall provide and
maintain stormwater retention facilities designed to retain the stormwater runoff in excess of
historic flow from the undeveloped site. The stormwater retention facility on a developed site
shall be designed for a one-hundred-year storm. The stormwater retention facility shall be
designed and operated to release the retained water at a quantity and rate not to exceed the
quantity and rate of a five-year storm falling on the undeveloped site.
The application materials state that the storm water will be retained on the property. There was
no supporting documentation stating how this is accomplished. The applicant shall contact the
Weld County Department of Public Works to further discuss this issue, and resolve per the
County's storm water criteria.
Section 23-3-250.A.2
Parking. Sufficient screened, off-street, paved parking areas shall be provided in the
Commercial Zone Districts to meet the requirements of employees, company vehicles, visitors
and customers of the Uses Allowed by Right and Accessory Uses. Appendix 23-A describes
the design requirements for parking spaces and Appendix 23-B delineates the number of
parking spaces required by use for this property.

The proposed facility has Office and Retail - Sales uses. The parking requirement for Office
uses are one space for every two employees plus one space per 500 SF. The office area is not
delineated on the drawings submitted, however, written documentation provided via the
application states there will be 4-10 full-time employees on premises, therefore ten (10) parking
spaces are required for the office area. The Retail Sales and Vehicle Service and Repir area
requires one parking space per each 200 SF of area, therefore eighty-eight (88) spaces are
required. Total parking required for this facility is ninety-eight (98) spaces of which one must
meet the requirements of the Americans with Disabilities Act.
Section 23-3-250.A.3
Street Access. Lots in commercial zone districts shall have safe access to an approved public
or private street. The design designation of any street or highway as to type shall be in
conformance with that shown on the county thoroughfare plan and/or the master plan of the
affected municipality. The applicant shall contact the Colorado Department of Transportation
concerning access to the recently realigned Frontage Road at this location. The applicant shall
also contact the City and County of Broomfield concerning access to the Frontage Road.
Written evidence of an approved access permit shall be provided to the Department of Planning
Services.
Section 23-3-250.A.4
Required Yards - Setback
No use or accessory use may be located closer than twenty-five (25) feet to the existing or
proposed (whichever represents the greater right-of-way width) highway or street right-of-way.
Off-street parking areas may be permitted in the required setback area when the area is
screened from direct view of persons on the public rights-of-way. Fences over six (6) feet in
height are not required to comply with the minimum setback and may be located on the
property line. Fences located on corner lots abutting public right-of-way shall not obstruct the
view of vehicular traffic at an intersection. There was not an elevational drawing of the structure
included in the application materials, therefore, prior to the release of building permits, the set
back shall be verified given the realignment and redesign of the 1-25 Frontage Road. Written
evidence of compliance shall be submitted to the Department of Planning Services.
The utility and drainage easement located adjacent to the easternmost property line shall
remain clear of all encumbrances.
Section 23-3-250.A.4
Required Yards - Offset
No use or accessory use may be located closer than ten (10) feet to its lot line. Off-street
parking areas may be permitted in the required offset area when the area is screened from
adjacent lots zoned R-1, R-2, R-3, R-4 or R-5. Fences over six (6) feet in height are not
required to comply with the minimum OFFSET and may be located on the property line. The
plans submitted with the application materials have delineated the offset as 22 feet five inches.
(22'-5"). There was not an elevational drawing of the structure included in the application
materials, therefore, prior to the release of building permits, the offset shall be verified.
The utility and drainage easement located adjacent to the south property line shall remain clear
of all encumbrances.
Section 23-3-250.A.5.A
Required Landscaped Areas
No more than eighty-five percent (85%) of the total area of a lot in any Commercial Zone

District shall be covered. Land shall not be deemed covered if it is used for growing grass,
shrubs, trees, plants or flowers or if covered by decorative gravel or wood chips, or if it is
otherwise suitably Landscaped. There was not a Landscape and Screening Plan submitted
with the application materials. Additional information is required prior to accepting the plat for
recording.
Section 23-3-250.A.5.B
That portion of a lot in any Commercial Zone District which abuts a public or private street right-
of-way shall be landscaped for a distance of ten (10) feet, measured at a right angle from the
lot line towards the interior of the lot. Sidewalks and driveways may pass through the required
landscaped areas. There was not a Landscape and Screening Plan submitted with the
application materials. Additional information is required prior to accepting the plat for recording.
Section 23-3-250.A.6
Areas used for trash collection shall be screened from public rights-of-way and all adjacent
properties. These areas shall be designed and used in a manner that will prevent wind- or
animal-scattered trash. The application materials state the dumpster is to be located on site,
however, there is not one delineated on the plat. Future submittals shall delineate the screened
enclosure as outlined in this Section of the Code.
Section 23-3-250.A.7
Water Supply. Uses located in the Commercial Zone Districts shall have an adequate source
of potable water. The application materials state that water is provided by Commercial Well
Permit number 015774-F in a letter dated April 30, 1974. The letter further states that 1000
gallons per day is allowed per each parcel. The applicant shall provide written evidence that
this commercial facility is within this standard. Further, the applicant shall meet all requirements
of the Weld County Department of Public Health and Environment, specific to water.
Section 23-3-250.A.8
Sewage Disposal. Uses located in Commercial Zone Districts shall have adequate sewage
disposal facilities. The application materials state that an existing ISDS system permitted under
G-890279 will handle the effluent flow. Further, the applicant shall meet all requirements of the
Weld County Department of Public Health and Environment, specific to sewage disposal.
Section 23-3-250.A.9
Outside Storage. Uses in Commercial Zone Districts involving outdoor storage of vehicles,
equipment or materials when permitted shall be screened from public rights-of-way and all
adjacent properties. The application materials and supporting drawings indicate that a fence is
located at the perimeter of the property, however, there is no indication that the fence is of an
opaque material. Future submittals shall delineate the screened fenced enclosure as outlined
in this Section of the Code.
Section 23-3-350.B.
Operation Standards. Uses in Commercial Zone Districts shall demonstrate conformance with
the following operation standards to the extent that they are affected by location, layout and
design prior to construction and operation. Once operational, the operation of the uses
permitted shall conform to these standards.

Noise. Uses and structures in Commercial Zone Districts shall be located, designed and
operated in accordance with the noise standards as established in Section 25-12-101 C.R.S.

The applicant shall meet the established standards set by the Weld County Department of
Public Health and Environment.
Section 23-3-250.6-2
Air Quality. Uses in the Commercial Zone Districts shall be located, designed and operated in
accordance with the air quality standards established by the Colorado Air Pollution Control
Commission. The applicant shall meet the established standards set by the Weld County
Department of Public Health and Environment.
Section 23-2-250.B.3
Water Quality. Uses in the Commercial Zone Districts shall be located, designed and operated
in accordance with the water quality control standards established by the Colorado Water
Quality Control Commission. If applicable, the applicant shall provide additional information
regarding the commerncial well if required through the Weld County Department of Public
Health and Environment referral.
The drawings delineate a wash bay located at the eastern wall of the existing structure. The
applicant has provided no documentation on this on-site feature. Additional documentation is
required, including at a minimum, compliance with the Class V Injection Well requirements and
all applicable water quality issues associated with this said use. The applicant shall provide
written evidence of compliance with all County, State and Federal regulations prior to Recording
the plat.
Section 23-2-250.B.4
Radiation and Radioactive Materials. The handling, use, storage and processing of radioactive
materials shall be in accordance with the applicable regulations of the State and the United
States government The application materials do not indicate this is applicable, should this not
be the case, the applicant shall provide additional information to the Weld County Department
of Public Health and Environment.
Section 23-2-250.6.5
Heat. Uses located within Commercial Zone Districts shall not emit heat in such an amount
sufficient to raise the temperature of the air or of materials at or beyond the Lot line more than
five (5) degrees Fahrenheit. The application materials do not indicate this is applicable, should
this not be the case, the applicant shall provide additional information to the Weld County
Department of Public Health and Environment and the Department of Building Inspection.
Further, the applicant shall obtain a written approval from the Mountain View Fire Protection
District stating that the facility is in compliance with the Fire Code.
Section 23-2-250.6.6
Light. Any lighting, including light from high temperature processes such as welding or
combustion, shall be designed, located and operated in such as manner as to meet the
following standards: sources of light shall be shielded so that beams or rays of light will not
shine directly onto adjacent properties; neither the direct nor reflected light from any light
source may create a traffic hazard to operators of motor vehicles on public or private streets;
and no colored lights may be used which may be confused with or construed as traffic control
devices. The application materials did not include a Lighting Plan. Should exterior lighting be a
part of this facility, all light standards shall be delineated on the Site Plan Review Plat.
Section 23-2-250.B.7
Property Maintenance. Property located within Commercial Zone Districts shall be maintained

in such a manner that grasses and weeds are not permitted to grow taller than twelve (12)
inches. In no event shall the property owners allow the growth of noxious weeds. The
application materials do not address property maintenance. Future correspondence shall
identify how the property will be in compliance with this Section of the County Code.
Section 23-4-50.
Off Street Loading. The applicant shall delineate on the USR plat the location of the loading
zone that is in compliance with Section of the Code.
Section 23-4-100
Signs in the Commercial Zone District. The application materials do not address this issue.
Section 23-4-100.D addresses attached signs. The applicant shall provide written evidence the
sign is in compliance with this section of the Code.
Further, the property shall maintain compliance with Title 23, Chapter 1, Part 750 of the
Highway Beautification Act. The excerpt is as follows:
Section 750.101 Purpose.
Section 750.101(a) In section 12 of the Federal-Aid Highway Act of 1958, Pub. L. 85-381, 72
Stat. 95, hereinafter called the act, the Congress declared that:
Section 750.101(1)(a) To promote the safety, convenience, and enjoyment of public travel and
the free flow of interstate commerce and to protect the public investment in the National System
of Interstate and Defense Highways, hereinafter called the Interstate System, it is in the public
interest to encourage and assist the States to control the use of and to improve areas adjacent
to such system by controlling the erection and maintenance of outdoor advertising signs,
displays, and devices adjacent to that system.
Section 750.101(2) It is a national policy that the erection and maintenance of outdoor
advertising signs, displays, or devices within 660 feet of the edge of the right-of-way and visible
from the main-traveled way of all portions of the Interstate System constructed upon any part of
right-of-way, the entire width of which is acquired subsequent to July 1, 1956, should be
regulated, consistent with national standards to be prepared and promulgated by the Secretary
of Transportation.
The applicant shall enter into an Improvements Agreement according to policy regarding
collateral for improvements and post adequate collateral for all transportation (access drive,
parking areas, etcetera) and non-transportation (plant materials, fencing, screening, etcetera).
The agreement and form of collateral shall be reviewed by County Staff and accepted by the
Board of County Commissioners prior to recording the Site Plan Review plat.
General Comment:
The Amendment to a Site Specific Development Plan and Special Review Permit for a business
(commercial junkyard or salvage yard, the leasing and sales of vehicles and equipment, and
vehicle service/repair) in the C-3 (Commercial) Zone District plat has been prepared for this
application prior to the establishment of the Development Standards, thus all Development
Standards depicted on this plat shall be considered null and void.

Dear Ms. Martin:
This referral does not appear to qualify as a "subdivision" as defined in Section 30-
28-101(10)(a), C.R.S. Therefore, pursuant to the State Engineer's March 4, 2005
memorandum to county planning directors, this office will only perform a cursory review of
the referral information and provide comments. The comments do not address the
adequacy of the water supply plan for this project or the ability of the water supply plan to
satisfy any County regulations or requirements. In addition, the comments provided
herein cannot be used to guarantee a viable water supply plan or infrastructure, the
issuance of a well permit, or physical availability of water.
According to the submitted information the property is served by well no. 15774-F,
which withdraws water that is tributary to the South Platte river system. Diversion of water
from the subject well will cause depletions to the South Platte River System at times when
the river is overappropriated. Rule 2(b)(1) of the South Platte River Rules and Regulations
requires the well to operate pursuant to a decreed plan of augmentation or substitute water
supply plan approved by the State Engineers office. The records available in the State
Engineer's Office did not indicate that a court approved plan for augmentation or substitute
water supply plan has been approved for the existing well. Therefore, well no. 15774-F cannot
be operated to serve the proposed operation.
In previous comments to the Weld County Planning Department the State Engineer's
Office commented that the wells use could be curtailed. Please see the attached letters dated
July 7, 1992 and December 1, 1993. Until the owner of well no. 15774-F obtains a Water
Court decreed plan for augmentation or substitute water supply plan the wells use is
subject to curtailment.

We have reviewed the above referenced proposal to add a 4,000 square foot metal building
