RE: APPROVE MEMORANDUM OF UNDERSTANDING FOR GREAT OUTDOORS
COLORADO TRUST FUND PROGRAM AND AUTHORIZE CHAIR TO SIGN - WELD
COUNTY SCHOOL DISTRICT RE-10J
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS,the Board has been presented with a Memorandum of Understanding forGreat
Outdoors Colorado Trust Fund Program between the County of Weld, State of Colorado, by and
through the Board of County Commissioners of Weld County, on behalf of the Department of
Finance and Administration, and Weld County School District RE-10J, commencing upon full
execution, with further terms and conditions being as stated in said memorandum, and
WHEREAS, after review, the Board deems it advisable to approve said memorandum, a
copy of which is attached hereto and incorporated herein by reference.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the Memorandum of Understanding for Great Outdoors Colorado Trust
Fund Program between the County of Weld, State of Colorado, by and through the Board of
County Commissioners of Weld County, on behalf of the Department of Finance and
Administration, and Weld County School District RE-10J be, and hereby is, approved.
BE IT FURTHER RESOLVED by the Board that the Chair be, and hereby is, authorized to
sign said memorandum.
The above and foregoing Resolution was,on motion duly made and seconded,adopted by
the following vote on the 31st day of July, A.D., 2006.

MEMORANDUM OF UNDERSTANDING
AGREEMENT:
sT
This Memorandum of Understanding ("MOU") is made this -1 day of-I- 1 2006, by
and between the County of Weld, State of Colorado, by and through its Board af,County
Commissioners,whose address is P.O. Box 758, 915 10th Street, Greeley, CO 80632, hereinafter
referred to as "County", and Weld School District Re-10J , whose address is 515 Leslie Street,
Briggsdale, CO 80611, hereinafter referred to as "School District."
FEDERAL FUNDING SOURCES:
County, through the Great Outdoors Colorado Trust Fund ("GOCO") Program, is providing to
School District the sum of$140,000 for a Community Sports Complex renovation and addition.
SCOPE OF WORK:
This project consists of the Community Sports Complex renovation and addition.
FINANCIAL ASSISTANCE:
School District, acting as a sub-recipient of the GOCO Program, will receive said funds from
County. Payment of said funds shall be made to School District as the project is completed and
GOCO funds received. The School District's bid process will be used to ensure compliance with
all required procurement rules and regulations. School District shall manage and supervise the
construction of the project, and be responsible for accepting its satisfactory completion.
CONDITIONS OF OWNERSHIP AND DELIVERY OF PROPERTY:
School District shall retain ownership of all improvements to School District property through this
project. School District shall execute the required GOCO restrictive covenant to said improved
property.
DISALLOWANCE OF FUNDS:
If reimbursement of the funds from the GOCO Program for this project are disallowed for any
reason, School District shall immediately reimburse County for the disallowed amount.
ACCOUNTING:
County shall establish and maintain a separate set of accounts for the project to assure that the
program funds are expended and accounted for in a manner consistent with this MOU and the laws
of the state of Colorado and GOCO requirements.
NO WARRANTY:
Through this MOU, county does not provide or promise to School District any warranty with respect
to the labor and materials used in the Project, and/or the fitness and suitability of the project
construction for the purpose for which it is being used.
