RE: APPROVE PARTIAL VACATION OF SECOND AMENDED USE BY SPECIAL REVIEW
PERMIT#488 - LAFARGE WEST, INC.
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS,by Resolution dated October 17,2001,the Board approved Amended Use by
Special Review Permit #488 for Mineral Resource Development Facility (open pit mining and
materials processing, along with an asphalt mixing plant) in the A(Agricultural)Zone District for
Mobile Premix Concrete, Inc., on the following described real estate, to-wit:
Part of the S1/2 of Section 16,and the Ni/2 of Section
21,all in Township 2 North,Range 68 West of the 6th
P.M., Weld County, Colorado, and
WHEREAS,on July 10,2006, the Board has received a request from the current property
owner, LaFarge West, Inc., 10170 Church Ranch Way, Westminster, Colorado 80021, to vacate
that portion of Second Amended Use by Special Review Permit#488, being described as follows:
Lot A of Recorded Exemption#4395; being a part of
the W1/2 SW1/4 of Section 16, Township 2 North,
Range 68 West of the 6th P.M., Weld County,
Colorado, and
WHEREAS,at said meeting the Board deemed it advisable to continue the matter to July 17,
2006, to receive testimony from a representative of LaFarge West, Inc., and
WHEREAS,on July 17,2006,the Board of County Commissioners heard all of the testimony
and statements of those present,studied the request of the applicant and the recommendations of
the Department of Planning Services staff and all of the exhibits and evidence presented in this
matter and, having been fully informed, deems it advisable to approve said partial vacation,
conditional upon the following:
1. Pursuant to Section 23-2-200.G.5 of the Weld County Code, the applicant shall
submit a revised Partial Vacation Use by Special Review Plat, conforming to
Section 23-2-260.D of the Weld County Code, with the removal of the Planning
Commission signature block.

NOW,THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that Second Amended Use by Special Review Permit#488 be, and hereby is,
partially vacated, with the abovementioned condition.
The above and foregoing Resolution was,on motion duly made and seconded,adopted by
the following vote on the 17th day of July, A.D., 2006.

SUBJECT: Partial Vacation of 2"d AMUSR-488
The Department of Planning Services has received the attached letter dated June 21, 2006 with
supporting documentation from Phillip Courtney with Lafarge West Inc. Lafarge is requesting
that 2nd AMUSR-488 for gravel mining be partially vacated. The acreage being vacated out of
2"d AMUSR-488 will be approximately 6.95 acres located on the western edge of the USR
boundary through the Recorded Exemption process (RE-4395)
Background information:
Legal Description: W2 SW4 of Section 16, T2N, R68W of the 6th P.M., Weld County, CO
Location: South of and adjacent to CR 20.5; and approximately 1 mile west of CR 7.
2nd AMUSR-488: 2nd AMUSR-488 was approved by the BOCC on October 17, 2001, for a
mineral resource development facility (open pit mining and materials
processing, along with an asphalt mixing plant) in the A (Agricultural)
Zone District.

Should the Board of County Commission choose to approve the request for a partial vacation of
2nd AMUSR-488, Planning Staff recommends that a revised Partial Vacation USR plat of 2nd
AMUSR-488 be submitted as required by Section 23-2-200.G.5.

Condition K- Recorded Exemption RE-4395
Dear Ms. Hatch,
As required in Condition K of Recorded Exemption RE-4395, Lafarge requests a partial vacation
of 2n° AMUSR-488. The area to be vacated includes 6.95 acres, more or less, and is described as
Lot A in RE-4395. No other changes are being requested to the USR at this time as this area was
not included in previously approved plans for the sand and gravel mining operation.

• Copy of Approved Plot Plan for Amended USR 488:82:3
• Copy of Recorded Exemption RE-4395, prepared by Robert Sayre—Includes description
of Lot A
