RE: APPROVE PARTIAL VACATION OF AMENDED USE BY SPECIAL REVIEW
PERMIT #1216 - LANCE MESSINGER
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, by Resolution dated January 28, 2004, the Board approved Amended Use by
Special Review Permit#1216 for Mineral Resource Development Facilities, Including Oil and Gas
Support and Service (storage and repair of downhole oil field tools) in the A (Agricultural) Zone
District for Lance Messinger, on the following described real estate, to-wit:
Lot B of Recorded Exemption #2235; being part of
the E1/2 of Section 31, Township 3 North, Range 66
West of the 6th P.M., Weld County, Colorado, and
WHEREAS,the Board has received a request from the property owner, Lance Messinger,
12160 Weld County Road 25.5, Fort Lupton, Colorado 80621, to vacate that portion of Amended
Use by Special Review Permit#1216, being described as follows:
Lot A of Recorded Exemption#4133, being a part of
the NE1/4 of Section 31, Township 3 North,
Range 66 West of the 6th P.M., Weld County,
Colorado, and
WHEREAS,the Board of County Commissioners heard all of the testimony and statements
of those present, studied the request of the applicant and the recommendations of the Department
of Planning Services staff and all of the exhibits and evidence presented in this matter and, having
been fully informed, deems it advisable to approve said partial vacation, conditional upon the
following:
1. Pursuant to Section 23-2-200.G.5 of the Weld County Code, the applicant shall
submit a revised Partial Vacation Use by Special Review Plat, conforming to
Section 23-2-260.D of the Weld County Code, with the removal of the Planning
Commission signature block.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that Amended Use by Special Review Permit#1216 be, and hereby is, partially
vacated, with the abovementioned condition.

SUBJECT: Partial Vacation of Amended Special Use Permit 1216
(AMUSR-1216)
Request: The applicant (Lance Messinger) is requesting a partial vacation of
Amended USR-1216(under 2nd AMUSR-1216). The applicant is dividing the
property through a recorded exemption and plans to sell Lot A to another
party. There is presently a Special Use Permit application in process for Lot
A under case # USR-1542.
USR Background: AMUSR 1216 was approved by the Board of County Commissioners on
January 28, 2004. The operation is located on Lot B of RE-2235 located in
Part of the NE4 of Section 31 T3N R66W. The operation was approved for
an oil and gas support facility(storage and repair of downhole oil field tools).
The Department of Planning Services is in support of this request.
The Department of Planning Services recommends the following amendments to the 2n°Amended
USR-1216 plat map:
1) Insert a vicinity map showing the boundaries of the USR site prior to this amendment.
2) Remove the Planning Commission signature block.

I hereby request that the area covered by USR 1216A be
amended to cover only Lot B of RE4133 once it is approved. A
new USR for the future owner of Lot A, of RE4133 has been
applied for and awaiting approval from Weld County.
