Dear Commissioners:
Kerr-McGee Oil & Gas Onshore LP is the owner of valid oil and gas leases
underlying all or part of Section 35 and 36, Township 3 North, Range 68 West, for which
Carma Bayshore, LLC ("Carma"), is seeking approval. KMG and Carma have been
negotiating a Surface Use Agreement, the terms of which will govern the parties'
simultaneous use of the subject property. KMG does not object to the Site Specific
Development Plan and PUD Final Plan approval for which Carma is applying. However,
the parties have not yet concluded an agreement, and KMG therefore requests that the
Weld County Board of County Commissioners withhold final approval until the parties
execute and record a surface use agreement.

PETITION FOR INCLUSION OF LAND
TO: SOUTHWESTERN WELD COUNTY LAW ENFORCEMENT AUTHORITY
WELD COUNTY, COLORADO
The undersigned, Carma Bayshore LLC, Robert I. and Winifred J. Siegrist, Construction
Leasing Investment Co., Construction Leasing Invest Co. and Robert L. Siegrist (collectively,
"Petitioner"), hereby respectfully petitions the Southwestern Weld County Law Enforcement
Authority (the "Authority"), acting by and through its Board of Directors, for inclusion of real
property further described in Exhibit A, attached hereto and incorporated herein(the"Property").
The Petitioner represents that it is the owner of the Property and represents one hundred
percent (100%) of the real property capable of being served with the facilities and services of the
Authority. The Petitioner also represents that no other person, persons, entity or entities own an
interest therein except as beneficial holders of encumbrances.
In accordance with §30-11-411, C.R.S., the undersigned hereby consents that the Property be
included in the Authority. The Petitioner acknowledges that the Property shall be liable for taxes,
assessments or other obligations of the Authority.
WHEREFORE, the Petitioner hereby requests that the Board of Directors pursuant to §30-
11-411, C.R.S. grant this Petition for the inclusion of the Property within the Authority.
