All of the sections stated below come from the International Fire Code, 2003 edition. Where ever physical protection is required, Section 312 requirements are. 1. Guard posts shall be constructed of steel not less than 4 inches in diameter and concrete filled. 2. Spaced not more than 4 feet between posts on center. 3. Set not less than 3 feet deep in a concrete footing of not less than a 15- inch diameter. 4. Set with the top of the posts not less than 3 feet above ground. 5. Located not less then 3 feet from the protected object. Section 407.2 - MSDS for all hazardous materials shall be readily available on the premises. A copy of all MSDS shall be forwarded to the Platteville/Gilcrest Fire Protection District (PGFPD). Section 508 - A letter stating the gallons per minute each well is able to flow located on the Moser Farms property. Chapter 24 - Requirements for the membrane structure being built. 1. Copy of certificate for the flame resistant membrane shall be forwarded to the PGFPD. These requirements shall be in accordance with NFPA 701. 2. Membrane structure shall have a permanently affixed label bearing the identification of size and fabric or material type. 3. Smoking shall not be aloud within the structure. No smoking signs shall be posted in conspicuous places. 4. Fireworks shall not be used within 100 ft. of the structure. 5. Minimum 3 feet of clearance between the fabric and all contents located inside. 6. Two fire extinguishers need to be inside the structure. Fire extinguishers must have a minimum rating of 3-A:40-B:C. Fire extinguishers must be mounted onto the wall. All employees need to be trained to use fire extinguishers. 7. Flammable-liquid-fueled equipment shall not be used inside the structure. 8. Flammable & Combustible liquids shall be stored not less than 50 feet from the structure. 9. All combustible materials shall be at least 30 feet away from the structure. Chapter 25 - Requirements for the tire storage. 1. Open burning is prohibited in tire storage yard. 2. Cutting, welding, or heating devices shall not be operated in storage yards. 3. No smoking in storage yard, except for designated areas. In regards to the cryogenic fluids, I have enclosed the entire chapter that covers the requirements. In addition to these requirements, the plat scale shall be 1" = 200 feet, with a detailed Site Plat delineated at a scale of 1" = 50 feet. The Vicinity Map shall be delineated at a scale of 1" = 2000 feet. This application shall be in compliance with Section 23-3-350 A. and B and is address in the following comments. r Section 23-3-350 addresses the Design Standards applicable to this proposed facility. Section 23-3-350.A addresses storm water management. The Department of Public Works reviews this standard who will make recommendations on the handling of stormwater and release at a historic rate. Per Section 23-3-350.B,the applicant shall delineated sufficient screened off street parking areas. All parking and loading areas shall be screened from adjacent properties and road rights-of-way. Further,all areas associated with outdoor storage shall be screened from adjacent properties and public rights-of-way. The applicant shall delineate an opaque visual screen on all sides of the property to mitigate the potential negative impact and aesthetic concerns on surrounding properties. The application materials state that there will be 23 people, employees and truck drivers, utilizing the site. Appendix 23-B of the Weld County Code, addresses the number of off-street parking spaces required. For this situation, the office parking requirements are one space for every two employees plus one space per 500 square feet of office space; total parking required for the office component (4500 SF) is 9 plus 23 spaces for the employee count, minimum 32 parking spaces. The proposed facility building has been classified as "warehouse uses" with one space required for each 1000 SF of space; total parking required for the warehouse component is 14 parking spaces. To meet the parking requirement for this facility, there shall be 46 parking spaces, including accommodations to meet the requirements of the American with Disabilities Act. 3 Am USR 847 Landscape Referral, page 1 The applicant shall delineate curb stops for the parking spaces shown on the USR plat. One curb stop for each space is the standard. However, one curb stop centered over two parking spaces is acceptable. Contact this office with any questions. The applicant shall graphically delineate and provide written discussion describing the accommodations to meet the requirements of the American with Disabilities Act. There is presently no evidence that the non-ambulatory parking space has a safe and secure access to the administration-Office building. Section 23-3-350.C addresses Loading Areas. A designated loading area is not delineated on the plat. Visual interpretation of the submitted drawings identified a "Sorting-Processing Shredding area" however, no specifically delineated loading area was identified. Such an area shall be delineated on the plat. Section 23-3-350.D provides for adequate street access. The applicant shall demonstrate a safe and approved access. Points of ingress and egress to this parcel appear to be off of CR 41 right- of-way. Coordination with the Department of Public Works shall be on-going, specific to the results of the traffic study, if requested, for all improvements to the County road system. The internal circulation within the service yard and property is not delineated and therefore remains an outstanding issue. The facility sign is not located on any of the submitted drawings. The applicant shall provide further information on these issues prior to the Board of County Commissioners hearing. Section 23-3-350.E addresses acceleration and deceleration lanes. If required, the Department of Public Works shall address this issue. Section 23-3-350.F addresses the setback and offsets for structures from the future right-of-way line. For this case, the setback is twenty (20) feet from the County Road 41 and the offset is one foot for every three feet of building height or five feet whichever is greater. Section 23-3-350.G addresses the Required Landscape areas. Section 23-3-350.G.1 states "No more than eighty-five percent (85%) of the total area of a Lot shall be covered. Land shall not be deemed covered if it is used for growing grass, shrubs, trees, plants or flowers or if covered by decorative gravel or wood chips, or if it is otherwise suitably landscaped." Further, Section 23-3-350.G.1 states "That portion of a Lot which abuts a public or private street right-of-way shall be landscaped for a distance of ten (10)feet, measured at a right angle from the Lot line towards the interior of the Lot. Driveways may pass through the required landscaped areas." The USR Plat has not identified areas for landscape treatment. Staff requests,that at a minimum, the applicant submit evidence that delineates the proposed and existing condition for review and approval with the Landscape and Screening Plan prior to recording the USR Plat. Although the application states no landscape treatment will be added to the site, should living landscape materials exist, then they shall be maintained at all times. Dead or diseased plant materials shall be replaced with materials of similar quantity and quality at the earliest possible time. Further, the applicant shall provide evidence that a commercial well tap is able to provide irrigation water for this site. Evidence of such shall be submitted to this office prior to recording the USR plat. Section 23-3-350.H addresses the issue of trash collection areas. Areas used for storage or trash collection shall be screened from adjacent public rights-of-way and adjacent properties. These areas shall be designed and used in a manner that will prevent wind or animal scattered trash. The application materials have not delineated this structure on the preliminary USR Plat. Section 23-3-350 I and Section 23-3-350. J addresses the water and sewage disposal for the site. The application materials state water is to be provided by a commercial well and disposal of household wastes will be via an engineered ISDS system. There was no documents demonstrating compliance, specifically with the State Engineers Office and with Environmental Health for the septic system. The applicant shall provide evidence of water. The Department of Public Health and Environment will address additional requirements as warranted. Section 23-3-360 addresses operation standards. The applicant shall address the issue of noise, air quality, water quality, radiation and radioactive material, heat light, and property maintenance. Evidence of written approval, including copies of all state and local permits shall be submitted to the Department of Planning Services. Section 23-3-360.A addresses noise. The Department of Public Health and Environment will regulate the maximum permissible noise levels allowed for this facility. Further, the application materials propose that the hours of operation be twenty-four hours per day, seven days per week each calendar year. Section 23-3-360.F addresses the issue of on-site lighting, including security lighting if applicable, this section.states "any lighting ... shall be designed, located and operated in such a manner as to meet the following standards: sources of light shall be shielded so that beams or rays of light will not shine directly onto adjacent properties...." The application materials do not discuss the exterior lighting.. Staff shall require a Lighting Plan be submitted for review and approval prior to recording the USR Plat. Section 23-3-360.G addresses property maintenance. Should noxious weeds exist on the property or become established as a result of the proposed development the applicant/landowner shall be responsible for controlling the noxious weeds, pursuant to Chapter 15,Articles I and II of the Weld County Code. All other operation standards will be addressed by other referral agencies as warranted. The applicant has not delineated on-site signs. The signs shall adhere to Section 23-4-90.A and .B of the Weld County Code. Further, the location of the signs shall be delineated on the Landscape/Site Plat. All structures, including signs, on site must obtain the appropriate building permits. Visual inspection of the submitted drawings delineates an approximate location of the 100-year floodplain. All improvements in the floodplain shall require approval of a Flood Hazard Development Permit (FHDP) prior to construction. Our comments and requirements are as follows: COMMENTS: WCR 41 is a collector road and requires an 80-foot right-of-way at full build out. There is presently a 60-foot right- of-way. This road is maintained by Weld County. Pursuant to the definition of SETBACK in the Weld County Zoning Ordinance (23-1-90), the required setback is measured from the future right-of-way line. Access: There are three existing accesses to the facility. Utilize the main access point at the office in the operations area. _eking: Utilize the existing parking next to the office for customers and employees. REQUIREMENTS: Off-Street Parking/Unloading Area: The off-street parking including the access drives and fire lanes shall be surfaced with gravel or the equivalent and shall be graded to prevent drainage problems. The following shall be capable of handling the weight of any fire trucks/emergency vehicles. Storm Water Drainage: The historical flow patterns and run-off amounts will be maintained on site in such a manner that it will reasonably preserve the natural character of the area and prevent property damage of the type generally attributed to run-off rate and velocity increases, diversions, concentration and/or unplanned ponding of storm run-off. The applicant must take into consideration storm water capture/quantity and provide accordingly for best management practices. The State of Colorado, Department of Health and Environment, as a waste material and waste management division has in place a regulation for solid waste and disposal site and facilities. Therefore, pursuant to the State Engineer's March 4, 2005 memorandum to county planning directors, this office will only perform a cursory review of the referral information and provide comments. The comments do not address the adequacy of the water supply plan for this project or the ability of the water supply plan to satisfy any County regulations or requirements. In addition, the comments provided herein cannot be used to guarantee a viable water supply plan or infrastructure,the issuance of a well permit, or physical availability of water. The information provided with the referral information suggests that the water supply for the property will be provided by two wells, permit nos. 32004-F and 39679-F. Well no. 32004-F was permitted on July 14, 1987 for the withdrawal of up to 3 acre-feet of water annually for domestic, commercial, industrial and irrigation purposes. Well no. 39679-F was permitted on August 30, 1991 for the withdrawal of up to 4 acre-feet of water annually for domestic, commercial and industrial purposes. Therefore, as long as the conditions of the well permits are satisfied, these wells can be used to provide water to the site. According to the submitted information fire protection to the site will be provided by two irrigation wells pursuant to a lease agreement with B&M Land Company and Rick, Gale and Bruce Moser. The wells are permitted under well nos. 2117-F and 20370-RR. Upon review of the records in the State Engineer's Office it does not appear that the two wells are currently permitted or decreed for fire protection use.
