First, I must apologize for an error in the Division Order. The property description is incorrectly stated as the N/2 of Section 17 on the face page of the Division Order. The working interest in the "J" Sand Formation in the NE/4 SE/4 was segregated several years ago from the remainder of the S/2 by an agreement between Machii-Ross and EnCana. See Correction Assignment and Conveyance dated May 22, 2002 and recorded under Reception No. 2956581. 2 At November 5, 2005, record title to Leases 1-8, at least insofar as the leases cover the Codell and "J" Sand formations in the NE/4 SE/4, stood solely in Machii-Ross Petroleum Co. We understand that an assignment dated February 1, 2006 may later have been recorded to place record title as to these lands and formations in KAR Petroleum Company (50%) and TSK Enterprises (USA), Inc. (50%). The ownership shown here, however, is based on entitlements to production (not responsibility for costs)as established by an unrecorded Participation Agreement dated February 1, 2006.
