RE: ACTION OF THE BOARD OF COMMISSIONERS REGARDING VIOLATION VI#0600044
AGAINST ANNETTE HUNT FOR VIOLATION OF THE WELD COUNTY CODE
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS,Annette Hunt, VI#0600044, is allegedly in violation of the Weld County Code,
and
WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has
not been corrected, and
WHEREAS, on the 11th day of July, 2006, a public hearing was held before the Board of
County Commissioners for the purpose of hearing testimony relating to said violation, and
WHEREAS, Annette Hunt was not present or represented at said hearing, although all
parties were notified of said hearing by Department of Planning Services staff, and
WHEREAS, the Board deems it advisable to bring legal action against those individuals
named above to correct said violation, and to obtain a Temporary Injunction from the Courts to stop
all business operations on the property until a Use by Special Review Permit has been approved.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the Weld County Attorney be, and hereby is, authorized to proceed with
legal action against Annette Hunt to remedy the violation of the Weld County Code, and any other
persons occupying the properties, any persons claiming an interest in the properties, and any
persons acting in active concert with the identified parties, and to obtain a Temporary Injunction
from the Courts to stop all business operations on the property until a Use by Special Review
Permit has been approved.

REMEDY
To bring the property into compliance a Use by Special Review application shall be completed and
submitted to the Department of Planning Services or evidence shall be submitted proving that all
commercial Welding operations have been removed from this property.
RECOMMENDATION
The Department of Planning Services recommends that this case be referred to the County Attorney's
Office for immediate legal action.

Section 23-3-20 "Uses allowed by right."
Section 23-3-30 "Accessory uses."
Section 23-3-30.D "Home Occupations."
Section 23-3-40 "Uses by special review."
Section 23-3-40.R "Any use permitted as a Use by Right, an Accessory Use, or a Use by
Special Review in the Commercial or Industrial Zone Districts, provided that the property is
not a Lot in an approved or recorded subdivision plat or lots parts of a map or plan filed
prior to adoption of any regulations controlling subdivisions. PUD development proposals
shall not be permitted to use the special review permit process to develop."
To bring the property into compliance:
While I understand your attorney is in the process of completing and submitting a Use by
Special Review(USR)application, my records indicate that we are still not in receipt of the
application. Please keep in mind that if a complete USR application is submitted prior to
July 11'", the above referenced violation hearing will be cancelled. For questions regarding

an appointment, because individuals are seen on a sign in basis. Neither office will have a
planner available on Fridays for walk-ins. To better serve you, please bring this letter
with you.
This hearing will take place in our Hearing Room, located at 918 10th Street, Greeley, Colorado. It is
recommended that you or a representative be in attendance to answer any questions the Board of
County Commissioners might have about the violations.
Please also be advised that I will be taking video and/or pictures from the road or adjacent properties
the business day before or as soon as possible to the above mentioned Violation Hearing date.
The Department of Planning Services' staff will be recommending that the Board of County
Commissioners authorize the County Attorney to proceed with legal action to remedy the violation. Our

I have been retained by Mr. and Mrs. Hunt to prepare and file the Special Use Review
application for their property and business. Pursuant to our email exchanges of March 15, 2006, 1
would like to request an additional sixty(60)day extension to submit the application. Our intention

Dear Mr. Barker:
Thank you for speaking with me today. As I mentioned,I am attempting to revise the special
review use application materials I submitted on May 19,2006. Previously,I met with Kim Ogle on
Thursday, May 18, 2006 to review the application materials before duplicating and submitting the
application. At the conclusion of the meeting, the only missing document was the "certificate of
conveyances" which had been delivered to the incorrect title office. At the conclusion of'that
meeting,I was confident that the application was complete. Later, I learned that the size of the map
was not acceptable and that I would need to edit the map to show only my client's property. The
information was correct,but the presentation of the material was not what staff desired. I will edit
the map accordingly.
Other items requested were the"original"special review use application which inadvertently
remained in my folder and completed the loin with the responses to the flood plain,zone district,
total acreage,overlay district geologic hazard and airport notations. In addition,you requested that
my signature be notarized(I am a notary).
The one item that I am still trying to resolve is the letter from the State of Colorado stating
that the proposed accessory use can adequately be served by the existing water well. As I explained
and the application narrative describes,this is a business that performs work off-site. The existing
water system and septic system is more than adequate to serve the one or two employees who
occasionally need to use a restroom.There are only two adults and one child who live at the site.The
proposed use is not a use that generates high water or sewage demands. I spoke with the State of
Colorado Division of Water Resources who looked up the well permit number. The State asked if
the County had reviewed condition number 4. (Copy attached,listing previous owners). This is not
a commercial well and the proposed uses are not the type that would place a great demand on the
well.
Lastly,I mentioned that I will be traveling to Pennsylvania on July 4,2006 where my wife
and I will be settling some family estate property matters. I had hoped that this application would
be resubmitted by now, but the few questions that remain may make that difficult to complete the
application before I leave. In addition,I am not confident that I will be able to return in time for the
hearing on July I I,2006. I would request that this hearing be reset for August. I intend to finalize
the application before August. I am still hopeful that I will be able to speak with Michelle Martin
before I leave and resolve any loose ends. If you have y questions,please contact me. Thank you.

1) This well shall be used in such a way as to cause no material injury to existing water rights. The Issuance of the
permit does not assure the applicant that no injury will occur to another vested water right or preclude another
owner of a vested water right from seeking relief in a civil court action.

The use of ground water from this well is limited to ordinary household purposes inside one single family dwelling,
watering of bur(4) large domestic animals and the litigation of not more than 8,000 square feet of home gardens
and lawns, as recommended by the Division of Water Resources to the county commissioners. e
5) Production is limited to the Laramie-Fox Hills aquifer which corresponds to the interval between 725 feet and 975
feet below ground surface. Plain casing shall be installed and properly sealed to prevent production from other
zones.
6) The maximum pumping rate shall not exceed 15 GPM. •
7) The annual amount of ground water to be withdrawn shall not exceed 0.75 acre-feet.
8) This well shall be oonstnoted not more than 200 feet from the location specified on this permit. •
Note: To insure a maximum productive life of this well, perforated casing should be set through the entire
