Weld County Public Works Department has reviewed this change of zone request. Comments made during this phase
of the subdivision process may not be all-inclusive, as other concerns or issues may arise during the remaining
application process.
Comments
❑ WCR 3 is classified by the County as a local gravel roadway and requires 60-feet of right-of-way. The applicant shall
verify the existing right-of-way and the documents creating the right-of-way shall be noted on the change of zone plat.
If the right-of-way cannot be verified, it will be dedicated on the final plat.
❑ The change-of-zone drawing does not meet the County standards. Section 27-9-20 of the County code details the
change-of-zone submittal drawing requirements. The applicant must resubmit the change-of-zone drawing to Public
Works prior to the planning commission hearing.
❑ No parking will be allowed in the right-of-way.
❑ No additional structures or accesses have been indicated as a result of the proposed change of zone. Drainage should,
therefore, not be affected by the proposed change of zone. Should any future construction be proposed, the applicant
will at that time be required to submit appropriate drainage and access information.
1 The applicant shall be required to submit a statement regarding the additional traffic to be introduced to the site by the
proposed uses; specifically the number of employees for the Turf Masters Lawn and Landscape business.
o If this traffic is considered by the Public Works Department to potentially impact the adjacent roadway
and/or surrounding property owners, the applicant may be required to submit a traffic impact study. The
applicant may be required to provide offsite improvements to County road 3 in proportion to the proposed
development.
o Public Works typically grants one access per legal parcel, and in this case the applicant is proposing two
access points to County road 3. The applicant must justify a second access.
❑ As there are to be no internal roadways associated with this change of zone, Public Works makes no comment
regarding internal roadways.
❑ Easements shall be shown in accordance with County standards and / or Utility Board recommendations, also
dimensioned on the change of zone plat.
Recommendation
❑ The Public Works Department recommends approval of the change of zone application based upon completion of the
above comments.
Issues must be resolved with Public Works prior to recording the change of zone plat

❑ In previous comments dated 16-January-2006, Public Works requested the change-of-zone drawing be resubmitted to
meet County standards. At this time Public Works has received a drawing titled: Change-of-zone, Lot A of Recorded
Exemption No. RE-3492, dated 06-02-05 from King Surveyors Inc. This drawing meets the County Standards for
change-of-zone submittal drawing.

Comments
The following comments are in response to the attached letter from Teresa Hellmer dated January 30, 2006.
❑ The applicant has provided a change-of-zone drawing meeting county standards.
❑ The applicant has addressed the parking spaces located within the right-of-way(see attached letter).
❑ The applicant indicates no increase in the level of traffic from the parcel. The existing business consists of 6 full time
employees and part-time seasonal employees. Turf Masters also currently owns 5 trucks. Based on the attached list of
company vehicles/employees and anticipated low transportation impact on the surrounding roads, a traffic study is
currently not required.
❑ Considering the size, location, and use for the parcel Public Works normally grants one (1) access per parcel. In this
case Public Works will allow the second access to remain as approved by the Board of County Commissioners.
Recommendation
❑ The Public Works Department recommends approval of the change of zone application based upon completion of the
above comments.
Issues must be resolved with Public Works prior to recording the change of zone plat

The Department has reviewed the new request to change from Residential (R-1) to Agricultural zone
(previously reviewed under Change of Zone-1100). This application does not differ substantially
from the previous application. However, the applicant has adequately elaborated on the landscaping
activities and the waste handling practices currently in use. The Department has not received any
further review of the septic system.
My comments have not changed from the previous review and are restated below:
There is an existing house on the property that is currently served by Longs Peak Water District and
an individual sewage disposal system. The system was evaluated in 2002 under permit SE-
0200111, a Statement of Existing. Because the system was evaluated only for the home use for a
Recorded Exemption, and the current use is a home and lawn/landscaping business, the system
needs to be evaluated by a Registered Professional Engineer for adequacy. I spoke to Ms. Hellmer
several months ago and explained this requirement.
The Department recommends approval of this application with the following conditions:
1. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and Facilities Act,
30-20-100.5, C.R.S., as amended) shall be stored and removed for final disposal in a manner
that protects against surface and groundwater contamination.
2. No permanent disposal of wastes shall be permitted at this site. This is not meant to include
those wastes specifically excluded from the definition of a solid waste in the Solid Wastes
Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended.
3. Waste materials shall be handled, stored, and disposed in a manner that controls fugitive
dust, blowing debris, and other potential nuisance conditions.
4. Fugitive dust shall be controlled on this site.
5. This facility shall adhere to the maximum permissible noise levels allowed in the Industrial
Zone as delineated in 25-12-103 C.R.S., as amended.
6. The septic system shall be reviewed by a Colorado Registered Professional Engineer. The
review shall consist of observation of the system and a technical review describing the
systems ability to handle the proposed hydraulic load. The review shall be submitted to the
Environmental Health Services Division of the Weld County Department of Public Health and
Environment. In the event the system is found to be inadequately sized or constructed the
system shall be brought into compliance with current Regulations.

Thank you for sending the referral concerning the change of zone for the Hellmer property. This
application is a change of zone for a parcel located along Weld County Road 3, south of State Highway
66, The parcel is approximately two and a half acres in size. The applicant is proposing a zone change
from the R1 (low density residential)zone district to the A(Agriculture)zone district.
Since this property is relatively close to Union Reservoir, the City has concerns with the change of zone
and its possible effects on water quality. Currently this property is zoned R1 which,according to the Weld
County Code, requires new development to be served by a public water and a public sewer system. The
Agricultural zones in the County do not have such a requirement. Although this property is already
developed, the City is concerned about the standards future development will have to meet. The City
would propose that, if a change of zone is approved, the public sewer requirement for new development
still be applied,

Dear Mr. Gathman:
I have reviewed the submitted material pertaining to the change of zone from R-1 Low Density to
PUD to allow for the storage of landscape material on the Hellmer Property, located at 13775
Weld County Road 3 (Case Number: CZ-1100). The Fire District does not object to the proposed
zone change provided there is no conflict with the requirements of the Fire District.
There is currently no water supply for fire protection along this portion of Weld County Road 3.
It appears that the accessory building is going to be leased out for a possible landscaping
business. If the building is used solely for the purposes of storage of equipment and materials
used for the landscaping business then water supply for fire protection would not be required. If
the building is used for any type of hazardous activity such as vehicle repair, storage or use of
flammable/combustible liquids. or hazardous materials including pesticides, herbicides, and
fertilizers, then water supply for fire protection requirements may apply as well as certain fire
code and building code requirements for the building itself.
The applicant has stated they do not dispose of motor oil or pesticides/herbicides on site. It is still
unclear from the application if repair of vehicles is being done at the site or if there is storage of
hazardous materials on site. It would be helpful for the applicant to provide the District with
detailed information regarding the use of the leased accessory building, including information
regarding types and quantities of any hazardous materials that will be used and stored within the
building.

Applicant: Charles and Teresa Hellmer
Site Specific Development Plan and a Special Review Permit for a change of use of a building
from U (utility), to S1 (moderate-hazard storage), for the purpose of employee parking, repair,
maintenance, service and storage of snow plow, lawn and landscape equipment and materials
used by Turf Masters Lawn and Landscape Inc.
Legal: Lot A of RE-3492; Pt E2NE4 of Section 30, T6N, R68W, of the 6th P.M., Weld
County, Colorado.

There is a previous permit on record for this parcel (BCS-040124). The permit was issued to
change the old boiler to a furnace and air conditioner unit, the permit has been finaled.
1. A building permit application must be completed, and two complete sets of plans must be
submitted for review. Plans must include; plot plan showing the location of all the structures on
the property with dimensions, floor plan for each building with dimensions, description of specific
uses of all existing areas, type of construction, heating, electrical information, exits, windows,
restrooms and details of parking, floors, walls and stairs.
2. A plan review must be approved and permit must be issued prior to the change of occupancy.
3. The change of occupancy shall conform to the requirements of the 2003 International
Building, Plumbing, Mechanical, and Fuel and Gas Codes, the 2002 National Electrical Code
and Chapter 29 of the Weld County Code.
4. Setback and offset distances shall be determined by the 2003 International Building Code
and Chapter 23 of the Weld County Code (Offset and setback distances are measured from the
farthest projection from the structure).
5. A Flood Hazard Development Plan is required for buildings within a 100-year flood plain.
