RE: AUTHORIZATION FOR THE WELD COUNTY ATTORNEY TO PROCEED WITH LEGAL
ACTION AGAINST GIAVONNI PALOMBO FOR VIOLATION OF THE WELD COUNTY
CODE
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, Giavonni Palombo, VI #0500414, is allegedly in violation of the Weld County
Code, and
WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has
not been corrected, and
WHEREAS, on the 14th day of February, 2006, a public hearing was held before the Board
of County Commissioners for the purpose of hearing testimony relating to said violation, and
WHEREAS, Giavonni Palombo, property owner, was present at said hearing, and
WHEREAS,the Board of County Commissioners deems it advisable to refer said violation
to the Weld County Attorney's Office for legal action, with an instruction for delay of action upon
such referral until April 14, 2006, to allow adequate time for the property owner to complete all
inspections and have a final approval to bring the subject property into compliance.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that VI #0500414 be, and hereby is, referred to the Weld County Attorney's
Office for legal action against Giavonni Palombo to remedy the violation of the Weld County Code,
and any other persons occupying the properties, any persons claiming an interest in the properties,
and any persons acting in active concert with the identified parties, with an instruction for delay of
action upon such referral until April 14, 2006, to allow adequate time for the property owner to
complete all inspections and have a final approval to bring the subject property into compliance.

To bring the property into compliance, the permit for the office trailer shall have all inspections completed and
a final approval.
RECOMMENDATION
The Department of Planning Services recommends that this case be referred to the County Attorney for
immediate action as the permit expired on January 3, 2006, and there have been no inspections since
December 16, 2005.
CASE HISTORY
June 23, 2005 Letter to pick up permit and pay fees, trailer already on the property.
December 15, 2005 Phone call from Mr. Palombo requesting extension. I explained we cannot extend
mobile home permits and will schedule with the Board of County Commissioners.
December 15, 2005 Certified letter mailed indicating the violation case is scheduled before the Board of
County Commissioners.

The property referenced above remains in violation of the Weld County Code. I have scheduled a meeting
with the Board of County Commissioners on February 14, 2006, at 10:00 a.m., to consider the violations.
The property is in violation of the following Section(s) of the Weld County Code:
Chapter 29,Article VII "Mobile, Manufactured or Factory-Built Home Permits"
Section 29-7-120 "Required inspections."
Section 29-7-130 "Certificate of occupancy."

All inspections shall be completed and the permit for the office trailer shall have final
approval.
This meeting will take place at the Weld County Planning Department Office, 918 10th Street, Greeley,
Colorado. It is recommended that you or a representative be in attendance at this meeting to answer any
questions the Board of County Commissioners might have regarding the violation.
The Department of Building Inspection will be recommending that the Board of County Commissioners
authorize the County Attorney to proceed with legal action to remedy the violation. Our records indicate that
you were made aware of the nature of the violation,the action necessary to correct the violation,and that you

Section 29-7-130 of the Weld County Code states:
"The certificate of occupancy shall be obtained no later than one hundred
eighty(180) days after the permit is issued. Failure to obtain the certificate of
occupancy within the one-hundred-eighty-day period will be sufficient reason
to consider the mobile, manufactured or factory-built home in violation of this
Building Code."

Dear Mr. Palombo:
I have previously contacted you regarding electrical permit number ELN-041190 which was submitted for
service to an electric fence. On December 9,2004,the inspector noted the service was also for the shop and
barn buildings. We have no record of permits for these buildings.
Permit number PRN-053014 for a 12 X 40 office trailer was submitted on February 14,2005. You have been
notified this permit has been processed and is ready to be issued. As of today the permit has not been issued
and the balance of$149.00 has not been paid but the trailer is on the property.
Within 10 days from the date of this letter permit application(s)shall be submitted for any other building(s)on
the property that have not been permitted and the permit for the office trailer shall be obtained and the balance
of the permit fees paid. The electrical permit shall also have all inspections completed and a final approval
issued.
