THOMAS FAMILY, INC.
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS,the Board of County Commissioners of Weld County, State of Colorado, at a
duly and lawfully called regular meeting held on the 14th day of August, 2006, at which meeting
there were present the following members: Chair M. J. Geile, and Commissioners
William H. Jerke, David E. Long, Robert D. Masden, and Glenn Vaad, and
WHEREAS,notice of such meeting and an opportunity to be present has been given to the
taxpayer and the Assessor of said County, and said Assessor, Stan Sessions, being represented
by Chris Woodruff, and taxpayer Ace Hardware - Thomas Family, Inc., not being present, and
WHEREAS, the Board of County Commissioners have carefully considered the attached
petition, and are fully advised in relation thereto.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the Board concurs with the recommendation of the assessor and the
petition be and hereby is, approved, and an abatement or refund be allowed as follows:

Petitioner states that the taxes assessed against the above property for property tax year 2005 is
incorrect for the following reasons: (Briefly describe the circumstances surrounding the incorrect value or tax.
(The petitioner's estimate of actual value must be included.) Attach additional sheets if necessary.
On our store's original Personal Property Declaration,Tim Seeder of the Weld County Assessor's Office,mistakenly
overstated the original cost of our security system by$51320. Our 2005 personal property tax was assessed and paid
based on that overstated value;consequently,we are due a refund of personal property tax. Enclosed is the spreadsheet
provided to Mr.Seeder,showing our personal property invoice by invoice. Also enclosed are the original invoices for our
security system which total$9438,the value that should have been listed on our personal property declaration in place of
Mr.Seeders$59758. We are also enclosing copies of correspondence between our accountant and Mr.Seeder.

I spoke with you last November regarding Ace Hardware of Greeley's Personal Property Listing.
On 11/15/05, I emailed you the attached list. It was my understanding at that time, that you were
clear on what property they had and the original cost of all.
In the process of preparing the corporation's personal property declaration schedule for 2006, it
has come to my attention that you have a very substantial error in their property listing for item
#0000014, Security Equipment. The original cost of this item is overstated by $51320.
Please review the attached listing previously sent to you. Highlighted in red, you will see that the
$59758 which you have attributed to the cost of the security equipment is, in fact, the sum of
"Total Machinery & Equipment". In addition, you can see that the $8438 highlighted in green, is
the sum of the four invoices listed to the left, which comprise entire cost of the security system.
Please forward a corrected personal property declaration to be completed by the 4/17 due date.
Also, please forward copies of any personal property invoices that the business has been sent or
has paid based on this very overstated valuation.

I did get your email. I do see the difference in value. With this, we will need to start the abatement process. Due
to the amount, I am unable to process this in house. At the end of this email, you will find a link to the website
where you can print out and return the abatement form to us, or you can call me and I can send you a copy.
As far as the 2006 Personal property declaration, the adjustment to that price can simply be made on the form
itself. I will adjust 2006 value in our system to reflect the proper amount. In the mean time, as the abatement is in
process, the taxes that were sent out at the beginning of the year will still have to be paid. This abatement will be
a reimbursement of the difference in taxes based on the tax roll correction for 2005.

This is to advise you that the Weld County Board of Commissioners will hear your petition for

County Centennial Center, 915 10th Street, Greeley, Colorado.
