HomeMy WebLinkAbout20063170.tiff HEARING CERTIFICATION DOCKET NO. 2006-75 RE: SITE SPECIFIC DEVELOPMENT PLAN AND AMENDED MAJOR SUBDIVISION FINAL PLAT,AMMJF#1119, AMENDING LOTLINES FOR LOTS 9 THROUGH 11, BLOCK 1, HILL-N-PARK SUBDIVISION, FILING 1, LOCATED WITHIN THE R-5 (MOBILE HOME RESIDENTIAL) ZONE DISTRICT - CHARLES AND PHYLLIS NELSON / GARY WEIDEMAN A public hearing was conducted on November 15, 2006, at 10:00 a.m.,with the following present: Commissioner M. J. Geile, Chair Commissioner David E. Long, Pro-Tem - EXCUSED Commissioner William H. Jerke Commissioner Robert D. Masden Commissioner Glenn Vaad Also present: Acting Clerk to the Board, Jenny Luna Assistant County Attorney, Cyndy Giauque Planning Department representative, Brad Mueller Health Department representative, Pam Smith Public Works representative, Peter Schei The following business was transacted: I hereby certify that pursuant to a notice dated October 27, 2006, and duly published November 1, 2006, in the Fort Lupton Press, a public hearing was conducted to consider the request of Charles and Phyllis Nelson and Gary Weideman for a Site Specific Development Plan and Amended Major Subdivision Final Plat,AmMJF#1119,amending lotlines for Lots 9 through 11, Block 1, Hill-N-Park Subdivision, Filing 1, located within the R-5 (Mobile Home Residential) Zone District. Cyndy Giauque, Assistant County Attorney, made this a matter of record, and advised the applicant, Charles Nelson,that he has the option of continuing this matter to a date when the full Board will be present. However, if he decides to proceed today, it will require three affirmative votes, or in the case of a tie vote, Commissioner Long will listen to the record and make the determining vote. Mr. Nelson indicated he would like to proceed today. Brad Mueller, Department of Planning Services, presented a brief summary of the proposal and entered the favorable recommendation of the Planning Commission into the record as written. He stated the request will allow the reconfiguration of the shape of three lots within the Hill-N-Park Subdivision. He stated the lots are located just inside the entrance to the subdivision,and adjacent to a large open space. Mr.Mueller displayed a map depicting the current lot lines and the proposed lot lines,and displayed photographs of the site. He stated the application meets all required criteria, and adjustment of the lot lines will not produce changes to the service level of the subdivision. Pam Smith, Department of Public Health and Environment,stated the subdivision is served by the City of Evans Water and Sewer Departments. 2006-3170 SUBD Hill-N-Park HEARING CERTIFICATION - CHARLES AND PHYLLIS NELSON / GARY WEIDEMAN (AmMJF#1119) PAGE 2 Peter Schei, Department of Public Works, stated he had no additional comments regarding the application. Mr. Nelson stated the amendment to the lotlines will increase the taxable value of the property,and will create an improvement to the overall subdivision. In response to Chair Geile, Mr. Nelson stated he has reviewed, and concurs with, the Conditions of Approval and Development Standards as proposed. No public testimony was offered concerning this matter. Commissioner Jerke moved to approve the request of Charles and Phyllis Nelson and Gary Weideman for a Site Specific Development Plan and Amended Major Subdivision Final Plat, AmMJF#1119, amending lotlines for Lots 9 through 11, Block 1, Hill-N-Park Subdivision, Filing 1, located within the R-5(Mobile Home Residential)Zone District,based on the recommendations of the Planning staff and the Planning Commission,with the Conditions of Approval and Development Standards as entered into the record. The motion was seconded by Commissioner Masden, and it carried unanimously.
