RE: APPROVE RESUBDIVISION,RS#1122, FOR VACATION OF PORTION OF CERTAIN
ROADS, STREETS,OR ALLEYS (197TH WAY BETWEEN LOTS 13 AND 14) WITHIN
VANTAGE ACRES SUBDIVISION - GEORGE AND VICKI KENNEDY
WHEREAS,the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS,the Board has been presented with a request from George and Vicki Kennedy,
19373 197th Way, Hudson, Colorado 80642, for Minor Resubdivision, RS#1122, for vacation of
197th Way, between Lots 13 and 14, in Vantage Acres Subdivision,on the following described real
estate, to-wit;
Being part of the S1/2 of Section 17, Township 1
North, Range 65 West of the 6th P.M.,Weld County,
Colorado, and
WHEREAS,the applicants were present at said hearing, and
WHEREAS,Section 24-5-20 of the Weld County Code provides standards for review of said
Resubdivision, and
WHEREAS,the Board of County Commissioners heard all of the testimony and statements
of those present, studied the request of the applicant and the recommendation of the Weld County
Department of Planning Services and all of the exhibits and evidence presented in this matter and,
having been fully informed, finds that this request shall be approved for the following reasons:
1. The submitted materials are in compliance with the application requirements of
Section 24-5-20.E of the Weld County Code.
2. It is the opinion of the Board of County Commissioners that the applicant has shown
compliance with Section 24-5-20 of the Weld County Code, as follows:
A. Section 24-5-20.A—There is right-of-way shown on an approved plat or map
that has not been used for its intended purpose for the last twenty-one(21)
years, or since the recording of the approved plat. Vantage Acres
Subdivision, Filing #3, was recorded on February 2, 1966. This northern
portion of 197th Way, between Lots 13 and 14, within the Subdivision was
never constructed. The purpose of this portion of 197th Way was either for
possible future interconnectivity or access to a parcel located to the north.
The parcel to the north, which is not part of the Subdivision, has direct
access off of Weld County Roads 10 and 39. The applicants currently own
both lots on either side of the subject portion of 197th Way.
B. Section 24-5-20.B—Seventy percent(70%) of the landowners adjacent to
the proposed right-of-way vacation waive any objection to the vacation by
signing a petition. There are three properties that are adjacent to this portion

of 197th Way, and all three have signed a petition stating that they do not
object to this road right-of-way vacation.
C. Section 24-5-20.C — The vacation shall only be permitted when it is
compatible with the surrounding area and uses, is consistent with efficient
and orderly development, is consistent with Chapter 22 of the Weld County
Code, and does not deprive any parcel of adequate access to a public road
or street right-of-way. All surrounding properties have adequate access to
a County road or internal Subdivision road. Access to the adjacent parcel to
the north is off of Weld County Road 10, and said parcel to the north is not
part of Vantage Acres Subdivision.
NOW,THEREFORE,BE IT RESOLVED by the Board of County Commissioners of Weld
County,Colorado,that the application of George and Vicki Kennedy,for Resubdivision, RS#1122,
for vacation of 197th Way, between Lots 13 and 14, in Vantage Acres Subdivision, on the
hereinabove described parcel of land be,and hereby is,granted subject to the following conditions:
1. Prior to Recording Resubdivision Plat:
A. All pages of the plat shall be labeled RS-1122.
B. The plat shall include a 60-foot utility easement in the location of 197th Way,
as approved by the Utilities Coordinating Advisory Committee on
September 14, 2006. The applicants shall obtain sign-off from the utility
providers prior to recording the plat. The utility name and signature shall be
on the plat.
C. The following notes shall be placed on the plat:
1) Should noxious weeds exist on the property,or become established
as a result of the proposed development, the applicant/landowner
shall be responsible for controlling the noxious weeds, pursuant to
Chapter 15, Articles I and II, of the Weld County Code.
2) Effective January 1, 2003, building permits issued on the proposed
lots will be required to adhere to the fee structure of the County-Wide
Road Impact Program.
3) Effective August 1, 2005, building permits issued on the subject site
will be required to adhere to the fee structure of the Capital
Expansion Impact Fee and the Stormwater/Drainage Impact Fee.
2. The applicant shall submit two(2)paper copies of the plat for preliminary approval
to the Weld County Department of Planning Services.
3. The applicant shall submit a digital file of all drawings associated with the
Resubdivision application. Acceptable CAD formats are .dwg, .dxf, and .dgn

(Microstation);acceptable GIS formats are ArcViewshapefiles,Arclnfo Coverages
and Arclnfo Export files format type is .e00. The preferred format for Images is.tif
(Group 4). (Group 6 is not acceptable).
4. Upon completion of Conditions of Approval #1 and #2 above, the applicant shall
submit a Mylar plat, along with all other documentation required as Conditions of
Approval. The Mylar plat shall be recorded in the office of the Weld County Clerk and
Recorder by the Department of Planning Services. The plat shall be prepared in
accordance with the requirements of Section 24-4-40.D.6 through D.9 of the Weld
County Code. The Mylar plat and additional requirements shall be submitted within
sixty (60) days from the date of the Board of County Commissioners Resolution.
The applicant shall be responsible for paying the recording fee.
The above and foregoing Resolution was,on motion duly made and seconded,adopted by
the following vote on the 2nd day of October, A.D., 2006.

THE DEPARTMENT OF PLANNING SERVICES' STAFF RECOMMENDS THAT THIS
REQUEST BE APPROVED FOR THE FOLLOWING REASONS:
1. The submitted materials are in compliance with the application requirements of Section
24-5-20.E of the Weld County Code.
2. It is the opinion of the Department of Planning Services' Staff that the application has
shown compliance with Section 24-5-20 of the Weld County Code, as follows:
A. Section 24-5-20.A—There is right-of-way shown on an approved plat or map that

since the recording of the approved plat. Vantage Acres Subdivision Filing #3

Lots 13 and 14 within the subdivision was never constructed. The purpose of

Kennedy currently owns both lots on either side of this portion of 197th Way.

C. Section 24-5-20.C — The vacation shall only be permitted when it is compatible

This recommendation is based, in part, upon a review of the application materials submitted by
the applicant, other relevant information regarding the request, and responses from referral
agencies.
The Department of Planning Services' Staff recommendation for approval is conditional upon
the following:
1. Prior to Recording Resubdivision Plat:
A. All pages of the plat shall be labeled RS-1122. (Department of Planning

Dear Mr. Kennedy:
Your request for the vacation of a portion of street right-of-way between Lots 13 and 14A in
Vantage Acres has been reviewed by Department of Public Works staff. From a transportation
perspective, there is no reason this right-of-way cannot be vacated.
Because the streets in Vantage Acres are a part of a platted subdivision of land in the
unincorporated area of Weld County, the process for vacating the street is known as a "minor re-
subdivision."
The procedures for a minor re-subdivision are found in Section 24-5-20 of the Weld County Code.
A copy of that section is enclosed. Application for a minor re-subdivision is processed by the Weld
County Department of Planning and Zoning, in cooperation with this Department. Please call Mr.

MINUTES OF THE WELD COUNTY UTILITIES ADVISORY COMMITTEE
A regular meeting of the Weld County Utilities Coordinating Advisory Committee was held on Thursday,
September 14, 2006 10:00 a.m., in the Conference Room of the Department of Public Health and
Environment at1555 N. 17th Ave, Greeley, Colorado.
Members Present: Doug Melby, Don Somer, Jerry Adams, Don Carroll
Also Present: Jacqueline Hatch, Michelle Martin, Jesse Hein
CASE NUMBER: RS-1122
APPLICANT: George &Vicki Kennedy
PLANNER: Jacqueline Hatch
REQUEST: Resubdivision for the Vacation of Road, Street or Alley Right of Way(197`"Way
between Lots 13 & 14)within Vantage Acres Subdivision.
LEGAL: Part of 197'"Way in Vantage Acres Subdivision being part of the S2 of Section
17, Ti N, R65W of the 6th P.M., Weld County, Colorado.
LOCATION: Approximately % mile north of CR 8 and approximately 1/2 mile west of CR 41.
Jacqueline Hatch, Department of Planning Services presented Case RS-1122. The services for this site
include individual wells, septic system, United Power and Qwest. Staff is recommending that the applicant
provide a utility easement in compliance with Section 24-7-60 of the Weld County Code. This would
require the applicant to have 10 feet on either side of the new lot line.
Don Carroll, Department of Public Works, asked if the applicant has indicated whether there were any
existing utilities in the corridor or affected area. If so those should remain and the utility companies should
have access to those lines. This can be covered with a note on the plat. Ms. Hatch stated she does have
letters from United Power and Qwest. Qwest has no conflict with the vacation and United Power agrees
to vacate or abandon that part of 197th Way. Mr. Somer added that in the letter it states that if utilities are
found later those will still be upheld by easement. Ms. Hatch then read the letter from Qwest into the
record. Mr. Somer stated that their records presently show no lines are in the area but those records have
been wrong at times. If a line was found in the area it would need to stay there and the utility company
needs to be able to maintain it.
Jerry Adams indicated the utility board is proposing a 60 foot utility right-of-way easement where the road
was previously located. This would protect any utilities that may still be in the area. Mr. Carroll indicated
that the applicant may need to be advised that no structures can be inside the right-of-way. Ms. Hatch
indicated the applicants can build in a utility easement with sign off from utility providers.
Don Somer moved to approve with the condition that the 60 foot road right-of-way become a 60 foot utility
easement. Doug Melby seconded. Motion carried.

APPLICANT: Twin View Estates LLC
PLANNER: Michelle Martin
REQUEST: PUD Final Plat for nine (9) residential lots with Estate Zone Uses.
LEGAL: Lot B of RE-2953; part SW4 of Section 5, T4N, R68W of the 6th P.M., Weld
County, Colorado.
LOCATION: East of and adjacent to CR 3; north of and adjacent to CR 48
Michelle Martin, Department of Planning Services presented case PF-1085. The services include Little
Thompson Water District, septic systems, propane, Poudre Valley REA and Qwest. Staff is
recommending that the applicant provide the utility easements in compliance with Weld County Code
Section 24-7-60 and Section 27-9-40.
Don Carroll, Department of Public Works, asked if the open space could be utilized as a utility easement.
Lauren Light, representative for the applicant, indicated that would be fine. They are already working with
the water district to extend the water line across the open space.
Doug Melby asked for clarification with regards to sign off sheets. Ms. Martin stated that would be
required.
Jerry Adams summarized that the final plat would delineated to reflect that the open space can also be
used for utility easements and make sure there is a utility sign off sheet on the plat.
Don Carroll moved to approve with those conditions. Don Somer seconded. Motion carried.
