HomeMy WebLinkAbout20060464.tiff RESOLUTION RE: AUTHORIZATION FOR THE WELD COUNTY ATTORNEY TO PROCEED WITH LEGAL ACTION AGAINST JOHN AND LUPE VALDEZ FOR VIOLATION OF THE WELD COUNTY CODE WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, John and Lupe Valdez, VI #0500339, are allegedly in violation of the Weld County Code, and WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has not been corrected, and WHEREAS, on the 14th day of February, 2006, a public hearing was held before the Board of County Commissioners for the purpose of hearing testimony relating to said violation, and WHEREAS, Randy Valdez, property owner's son, was present at said hearing, and WHEREAS,the Board of County Commissioners deems it advisable to refer said violation to the Weld County Attorney's Office for legal action, with an instruction for delay of action upon such referral until May 14, 2006, to allow adequate time for the property owners to submit a letter stating they are converting the principle dwelling into a temporary dwelling during the construction on the new mobile home, submit a new building permit, and to remove the third mobile home, also restore, remove or screen the noncommercial junkyard from all adjacent properties and public rights-of-way to bring the subject property into compliance and for an inspection of the property by the Department of Planning Services staff. After our on-site meeting (11/10/05), I was of the understanding that within 30 days (by 12/15/05) a letter requesting the single wide be converted to a "Temporary During Construction"and a building permit application for the double wide modular home would have been completed and submitted to the Department of Building Inspections and Planning Services. However, my records indicate that we have not received such. When you are close to a final, a TCO(Temporary Certificate of Occupancy) will be issued for 30 days to allow you adequate time to remove the single wide mobile home. Additionally, the derelict vehicles shall be relocated to there new location and screened from all adjacent properties and public rights-of-ways. Please keep in mind that if all of the above items have been completed prior to February 13, 2006, the Violation Hearing will be cancelled. This hearing will take place in our Hearing Room, located at 918 10th Street, Greeley, Colorado. It is recommended that you or a representative be in attendance to answer any questions the Board of County Commissioners might have about the violations. I have been unable to locate any building or zoning permits for the double wide mobile home. Even the storage of a mobile home requires a building and zoning permit. The garage and shed will need to be inspected to ensure that they are not being utilized as a dwelling unit and to make sure that any previous conversions making it into a dwelling unit have been reversed. The utilization of a camper/trailer-Recreational Vehicle as a dwelling unit within the boundaries of a subdivision,such as Aristocrat Ranchettes, is not an allowed use. In order to occupy these types of vehicles, they must be parked on an approved camp ground. It is the intention of this office to assist and cooperate with you without imposing undue hardships; however, we have no discretion in this matter if you fail to correct this violation.
