RE: AUTHORIZATION FOR THE WELD COUNTY ATTORNEY TO PROCEED WITH LEGAL
ACTION AGAINST JOHN AND LUPE VALDEZ FOR VIOLATION OF THE WELD
COUNTY CODE
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, John and Lupe Valdez, VI #0500339, are allegedly in violation of the Weld
County Code, and
WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has
not been corrected, and
WHEREAS, on the 14th day of February, 2006, a public hearing was held before the Board
of County Commissioners for the purpose of hearing testimony relating to said violation, and
WHEREAS, Randy Valdez, property owner's son, was present at said hearing, and
WHEREAS,the Board of County Commissioners deems it advisable to refer said violation
to the Weld County Attorney's Office for legal action, with an instruction for delay of action upon
such referral until May 14, 2006, to allow adequate time for the property owners to submit a letter
stating they are converting the principle dwelling into a temporary dwelling during the construction
on the new mobile home, submit a new building permit, and to remove the third mobile home, also
restore, remove or screen the noncommercial junkyard from all adjacent properties and public
rights-of-way to bring the subject property into compliance and for an inspection of the property by
the Department of Planning Services staff.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that VI #0500339 be, and hereby is, referred to the Weld County Attorney's
Office for legal action against John and Lupe Valdez to remedy the violation of the Weld County
Code, and any other persons occupying the properties, any persons claiming an interest in the
properties, and any persons acting in active concert with the identified parties, with an instruction
for delay of action upon such referral until May 14, 2006, to allow adequate time for the property
owners to submit a letter stating they are converting the principle dwelling into a temporary dwelling
during the construction on the new mobile home, submit a new building permit, and to remove the
third mobile home, also restore, remove, or screen the noncommercial junkyard from all adjacent
properties and public rights-of-way to bring the subject property into compliance.

REMEDY

RECOMMENDATION
The Department of Planning Services recommends that this case be referred to the County Attorney's
Office for immediate legal action.

To bring the property into compliance:
P. After our on-site meeting (11/10/05), I was of the understanding that within 30 days (by
12/15/05) a letter requesting the single wide be converted to a "Temporary During
Construction"and a building permit application for the double wide modular home would have
been completed and submitted to the Department of Building Inspections and Planning
Services. However, my records indicate that we have not received such.

► Within 60 days (by 01/15/05) the single wide mobile home (the mobile home located
furthest East on the lot)will have been removed from the property.
As we previously discussed you will have 6 months to complete work on your double wide
modular home. When you are close to a final, a TCO(Temporary Certificate of Occupancy)
will be issued for 30 days to allow you adequate time to remove the single wide mobile home.
Additionally, the derelict vehicles shall be relocated to there new location and screened from
all adjacent properties and public rights-of-ways.
Please keep in mind that if all of the above items have been completed prior to February 13,
2006, the Violation Hearing will be cancelled.
This hearing will take place in our Hearing Room, located at 918 10th Street, Greeley, Colorado. It is
recommended that you or a representative be in attendance to answer any questions the Board of
County Commissioners might have about the violations.
Please also be advised that I will be taking video and/or pictures from the road or adjacent properties
the business day before or as soon as possible to the above mentioned Violation Hearing date.
The Department of Planning Services' staff will be recommending that the Board of County
Commissioners authorize the County Attorney to proceed with legal action to remedy the violation. Our
records indicate that you were made aware of the nature of the violation including the action necessary
to correct the violation, and that you were given sufficient time to remedy this violation. If you have any

I have been unable to locate any building permits allowing the single wide mobile home to be
situated where it is located.
I have been unable to locate any building or zoning permits for the double wide mobile home.
Even the storage of a mobile home requires a building and zoning permit.

The"Noncommercial Junkyard"consisting of derelict vehicles shall be restored, removed or
screened completely from all adjacent properties and public right-of-ways.
The garage and shed will need to be inspected to ensure that they are not being utilized as a
dwelling unit and to make sure that any previous conversions making it into a dwelling unit
have been reversed.
The utilization of a camper/trailer-Recreational Vehicle as a dwelling unit within the
boundaries of a subdivision,such as Aristocrat Ranchettes, is not an allowed use. In order to
occupy these types of vehicles, they must be parked on an approved camp ground.
It is the intention of this office to assist and cooperate with you without imposing undue hardships; however,
we have no discretion in this matter if you fail to correct this violation. You have 30 (thirty) days from
October 12, 2005, to correct this zoning violation. Failure to do so will result in this office scheduling the

It has come to the attention of the Department of Planning Services'staff that the uses on your property may
not be in compliance with the Weld County Code, Chapter 23. The potential noncompliance(s) with the Weld
County Code are as follows:
The presence of a single wide mobile home without a building or zoning permit
To bring this aspect into compliance, depending on its intended use,a building and zoning permit
may both be required. For questions, I suggest you speak to one of our"On-Call" Planners. To
better serve the public, we have 2 locations open. Our North office is located at 918 10th Street,
Greeley, Colorado. At our North office, an"On-Call" Planner is available, Monday thru Thursday
from 7:30 a.m. - 11:30 a.m. Our Southwest office is located at 4209 CR 24.5, Longmont,
Colorado. At our Southwest office, an"On-Call" Planner is available Monday thru Thursday from
12:30 p.m. —4:30 p.m. You do not need to schedule an appointment, because individuals are
seen on a sign in basis. Neither office will have a planner available on Fridays for walk-ins. To
better serve you, please bring this letter with you.

The garage shall be converted back into a garage, a letter shall be completed and submitted
stating that no one will occupy the garage as a dwelling unit at any given time and an inspection
scheduled to verify the conversion has occurred.
The conversion of a shed into a dwelling unit
The shed shall be converted back into a shed, a letter shall be completed and submitted stating
that no one will occupy the shed as a dwelling unit at any given time and an inspection scheduled
to verify the conversion has occurred.
The utilization of a camper-trailer as a dwelling unit
Camper-trailers are not an approved dwelling unit unless located at an approved camp ground.
Therefore, the camper-trailer shall be abated as a dwelling and disconnected from all utilities. It
shall not be occupied on this property at any given time.
